1. CALL TO ORDER: Meeting called to order at 6:35 p.m.
2. ROLL CALL: Present: PIERCE, LIEN, ASPITARTE, JACOBS, ZASTROW.
3. CONSENT AGENDA:
. Consent Agenda items are considered to be routine and are acted on with one motion. There will
be no separate discussion on these items unless the Chairman, a Commissioner, member of City
Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items
removed from the Consent Agenda will be placed on the Regular Agenda in a sequence
determined by the Rules of Order.
. Any item on the Consent Agenda that contains written recommendations from the City of Eagle
shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval motion

B. Findine:s of Fact and Conclusions of Law for A-01-06 & RZ-01-06 - Annexation and Rezone
from RUT to MU-DA - Brownstone CaDitol. Inc.: Brownstone Capitol, Inc., represented by
Doug Russell, ASLA, with The Land Group, Inc., is requesting approval of an annexation and a
rezone from RUT (Rural Urban Transition - Ada County Designation) to MU-DA (Mixed Use
with a Development Agreement) for a multi-family seventy (70) unit condominium housing
development. The development is to be located on a 5.85-acre site adjacent to the southeast corner
of Reid Merrill Park approximately 250-feet east of the intersection of East Shore Drive and East
Riverside Drive.
C. Findine:s of Fact and Conclusions of Law for A-4-06/RZ-4-06 & PP-4-06 - Annexation and
Rezone (with a DeveloDment Ae:reement) from RUT to R-2-DA and Preliminarv Plat for
Kathleen Estates Subdivision - Dave Yore:ason: Dave Yorgason with Capitol Development is
requesting annexation of9.99-acres and a rezone from RUT (Rural Urban Transition) to R-3-DA
(Residential three units per acre maximum with a development agreement) and preliminary plat
approval for Kathleen Estates Subdivision. The 35 lot subdivision (29 residential, 6 common)
consisting of 10.51-acres is located on the west side of North Park Lane approximately 1,320-feet
north of West State Street at 325 North Park Lane.
D. Findine:s of Fact and Conclusions of Law for A-5-06/RZ-5-06 & PP-06-05 - Annexation &
Rezone from RUT to R-2-DA and Preliminarv Plat for Park Lane Estates Subdivision -
Chad Moffat: Chad Moffat, represented by Eric Cronin, P. E. with The Land Group, Inc., is
requesting approval of an annexation and rezone from RUT (Rural Urban Transitional) to R-2-DA
(Residential two units per acre maximum with a development agreement) and preliminary plat
approval for Park Lane Estates. The 5. 14-acre subdivision will consist of 12 lots (7 residential, 5
common). The site is located on the west side of North Park Lane approximately 2.000-feet north
of West Floating Feather Road at 1835 North Park Lane.
Jacobs moves to approve the consent agenda as presented. Seconded by Zastrow. ALL

approximately I ,500-feet north of West State Street at 767 North Linder Road. This item was
continuedfrom the June 19, 2006 meeting.

Aspitarte moves to recommend approval for RZ-07-06 - Rezone from RR to R2-DA. Seconded
by Lien. ALL A YE...MOTION CARRIES.
Aspitarte moves to recommend denial PP-07-06, preliminary plat for Cabra Creek Subdivision.
The reason for the denial is the half street access and the unwillingness of the property owner to
the south to commit to developing their part of the property to complete the entrance/exit to the
subdivision. (The Applicant) is to provide assurance to the City that it will be a full street.
Seconded by Zastrow. ALL A YE..,MOTION CARRIES.
B. PPUD-01-06/CU-02-06/PP-08-06 - Eudora Estates (a.k.a. Alderwood No.2) Planned Unit
DeveloDment - RTB Investments. LLC: RTB Investments, LLC, represented by Wendy
Kirkpatrick with Landmark Engineering and Planning, is requesting conditional use, preliminary
development plan and preliminary plat approvals for Eudora Estates (a.k.a. Alderwood No.2)
Planned Unit Development, a 2 I -lot (16-buildable, 5-common) residential planned unit
development. The 4.7-acre site is located at 947 West State Street approximately 430-feet west of
South Grandean Way. Staffis requesting this item be continued to the July 5, 2006 meeting.

rezone from RUT (Rural Urban Transition) to R-2 (Residential-two units per acre maximum) and
preliminary plat approval for Stillwater Subdivision. The 24.89-acre, 33 lot subdivision (25
buildable, 8 common) is located at 2505 West State Street approximately 1,300 feet west of West
Ballantyne Road on the south side of West State Street. The applicant is requesting this item be
continued to the July 17, 2006 meeting.

One to Transitional Residential. Annexation. Rezone with Develooment Ae:reement from
RUT to R3-DA and Preliminarv Plat for Countrvland Subdivision - JLJ Enterprises, Inc.:
JLJ Enterprises Inc, represented by Van Elg and Phil Hull of The Land Group Inc, is requesting a
Comprehensive Plan Amendment to change the land use designation on the Comprehensive Plan
Land Use Map from Residential One to Transitional Residential, an annexation and rezone from
RUT (Ada County) to R-3-DA (up to three units per acres with Development Agreement-limiting
it to 2 units per acre), and preliminary plat approval to construct Country land Estates. a residential
development consisting of 17 lots (12 residential units and 5 common lots). The 6.6-acre site is
generally located 'I. mile west of Ballantyne Road and 'I. north of State Highway 44 at 2556 West
State Street.
Pierce introduces the item.
Van Elg, with the Land Group, reviews the application.
Nichoel Baird Spencer reviews the staff report and explains that because part of this application is a
comprehensive plan amendment, no action will be taken on the item at this time.
Pierce opens the public hearing.
Mike McDonald, 2477 W. Concord. Property abuts this area of the application. Wonders why they
are not going back to one acre parcels. Has concerns with the road. Believes there are too many
houses for a small area. Opposes the application.
Joe King, 170 N. Sierra View Way, President of the Ballantyne Ditch Company. Has concerns
regarding the ditch. Lives in Redwood Creek. Is in opposition of the project.
Panida Lachman. Lives in Countryside Subdivision. Believes there will be an impact to the traffic.
Opposes the project.
Susan Madsen, 466 Clear Point Way, Countryside Subdivision. Has concerns about the traffic this
project will create. Believes the lot sizes should be larger. Has concerns that the tot lot in their
subdivision will be used by people that will be living in the proposed subdivision.
Jon Houssin, 2640 W. Timberland Court. Concerns with traffic and density of the proposal. Would
like to see speed bumps in the surrounding subdivisions. Hoping to see one acre lots. Questions
drainage issues. Would be in favor of the project ifit has larger lots.
John Sayer, 2151 W. Forest Hill Court. Has concerns with the intersection at Ballantyne and State.
Believes that the road will be a cross street or short cut. Would like to see larger lots. Not sure if he is
opposed or for the project.
Mike Wright, 2631 W. Sky Wood Drive. President ofthe HOA. There are 17 children in their
subdivision. Would like to see speed bumps used. Discusses the problems with drainage swales. Has
concerns with traffic.
Bill Chandler, 205 N. Lost Canyon Place. Property is to the east of this area. Has concerns with
traffic. Is not in favor of speed bumps. Has concerns regarding drainage.
Tom Shea, 177 N. Lost Canyon. Neither opposes or for the project. Would like to see something
done about the drainage.
Jim Jewett, Developer of the project, discusses the size of the property and why it would be difficult to
have larger lots. Discusses the drainage and that there will not be swales used. Has had interest in the
size of the lots that would be in this project. Discusses traffic issues and traffic calming.

her property, concerns with drainage.

E. RZ-ll-06 & PPIFP-02-06 - Rezone from A-R to R-E-DA & Pumokin Patch Subdivision-
Emmett Price and Sons: Emmett Price and Sons, represented by Robin Labrie with Studio L is
requesting rezone from A-R (Agricultural-Residential) to R-E-DA (Residential-Estates with a
development agreement) and preliminary plat/final plat approval for Pumpkin Patch Subdivision.
The 4.94-acre, 2 lot subdivision is located at 2820 West Floating Feather Road approximately
1,200 feet east of Meridian Road on the north side of West Floating Feather Road.

Mark Beckman, 3050 W. Floating Feather Road. His property is directly north of this property. Is
looking to develop property surrounding this area. Believes this plan should go through.
Rick Roe, 1547 S. Island Glen. Believes the access should come from west.
Robin Labrie rebuts testimony.
Emmett Price, owner of the property, discusses the roadway and that there would be side yard set back
issues with the building department.
Pierce closes the public hearing.
Discussion amongst the Commission.
Pierce moves to (recommend) approval for RZ-ll-06 & PPIFP-02-06 - Rezone from A-R to R-E-
DA & Pumpkin Patch Subdivision - Emmett Price and Sons with the staff recommendation for
rezone 2.4 to include a cross access easement, 2.7, to add meandering with ADA compliance,
and 2.8 to strike the first sentence and put the applicant shall move or remove all structures
from the site prior to the City Clerk signing the final plat. A demolition permit shall be obtained
prior to the removal of any said structures. Site Specific Condition # 9, add: a 5 foot
meandering concrete sidewalk. Seconded by Lien. ALL A YE...MOTION CARRIES.
F. CPA-1-06 - ComDrehensive Plan Text Amendment Section 6.7G - Shawn Nickel: Shawn
Nickel, is requesting a Comprehensive Plan Text amendment to change Section 6.7G of the 2000
Eagle Comprehensive plan to include Office as an allowed use in the Eagle Road Mixed use area.
The site is located along Eagle Road between Ranch Drive and Floating Feather Road. The
applicant is requesting this item be remanded to staff.
Lien moves to remand CP A-1-06 back to staff. Seconded by Aspitarte. ALL AYE.. .MOTION
