I. CALL TO ORDER: Meeting called to order at 6:30 p.m.
2. ROLL CALL: Present: PIERCE, LIEN, ASPITARTE, JACOBS, ZASTROW.
3. CONSENT AGENDA:
. Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chainnan, a Commissioner, member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in
a sequence determined by the Rules of Order.
. Any item on the Consent Agenda that contains written recommendations from the City of
Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda
approval motion unless specifically stated otherwise.

B. Findines of Fact and Conclusions of Law for A-03-06 & RZ-3-06 - Annexation and
Rezone From RUT to R-4-DA - Donna Weston: Donna Weston, represented by Craig
McCullough with Doumecq Development, is requesting annexation and rezone from RUT
(Rural Urban Transition - Ada County Designation) to R-4-DA (Residential four units per acre
with a Development Agreement). The 4.86-acre site is located on the west side of Horseshoe
Bend Road approximately 1,200-feet south of Floating Feather Road at 10895 Horseshoe
Bend Road.
Aspitarte moves to accept the consent agenda. Seconded by Lien. ALL AYE...MOTION
CARRIES.

5. PUBLIC HEARINGS:
A. A-OI-06 & RZ-OI-06 - Annexation and Rezone From RUT to MU-DA - Brownstone
Capitol. Inc.: Brownstone Capitol, Inc., represented by Doug Russell, ASLA, with The Land
Group, Inc., is requesting approval of an annexation and a rezone from RUT (Rural Urban
Transition- Ada County Designation) to MU-DA (Mixed Use with a Development
Agreement) for a multi-family seventy (70) unit condominium housing development. The
development is to be located on a 5.85-acre site adjacent to the southeast comer of Reid
Merrill Park approximately 250-feet east of the intersection of East Shore Drive and East
Riverside Drive. This item was continued/rom the May 15,2006 meeting.
Pierce introduces the item.
Doug Russell, with the Land Group, Inc., reviews the application and gives overview of the site.
Stands for questions from the Commission.
Joanne Butler, 251 E. Front Street, Boise, representing the applicant. They have submitted "draft"
restrictive covenants to the City to look at. There will be limited common areas, some common
areas only serving a particular unit. There will be an owner's association. States that the proposed
use is compatible with the comprehensive plan. Stands for questions from the Commission.

Pierce opens the public hearing.
Joe King, 170 N. Sierra View Way, Eagle. President of the Ballentyne Ditch Company. The
entrance of the project parallels the Ballentyne ditch. The ditch company requires that to be put
into a 48" concrete pipe and have plans to have this from their head gate near Lonesome Dove
which runs all the way to Riverside Drive. There is a levy that was put in by the Corps of
Engineers and is officially titled the Ballentyne Levy, which has been there since about 1886.
Patricia Minkiewicz, 3047 Deerfield Court, Eagle. Asks about off street parking for visitors.
Believes some condominium areas have too narrow of streets for fire engines and school buses to
get through. Questions if the only off street parking will be at Merrill Park.
Matthew, 5539 Sudley Lane, Boise. Runs a business here in Eagle. In favor of the project.
Believes this is an opportunity for Eagle to put the "mixed" back in mixed use. Discusses the 35'
height limit and overflow parking.
Tom Britton, 1057 E. Riversend Drive. Discusses the look of the project, believes it would be a
good feature for Eagle.
Doug Russell rebuts testimony.

Aspitarte moves to recommend for approval A-OI-06 & RZ-OI-06 - Annexation and Rezone
from RUT to MU-DA - Brownstone Capitol, Inc. with amending 3.9 to read "Provide a site
plan for Design Review approval showing pedestrian pathways to be located on both of the
driveway throughout the development prior to submitting a design review application".
3.10, change to read "signs around east and west property lines "15 (fifteen) feet", 3 (three)
stories, "15 (fifteen) feet". Change 3.22.1 to 3.22. Seconded by Jacobs. ALL
AYE...MOTION CARRIES.
B. A-07-06/RZ-07-06/PP-07-06 - Annexation and Rezone (with a development al!reement)
from RR to R2-DA and Preliminary Plat for Cabra Creek Subdivision - Donald &
Tricia Flvnn: Donald and Tricia Flynn, represented by Shawn Nickel with SLN Planning,
Inc., is requesting approval of an annexation and a rezone from RR (Rural Residential-Ada
County designation) to R-2-DA (Residential-two units per acre maximum with a development
agreement) and preliminary plat approval for Cabra Creek Subdivision, a 26 lot (23-buildable,
3-common) residential subdivision. The 13.63-acre site is located on the west side of North
Linder Road approximately 1 ,500-feet north of West State Street at 767 North Linder Road.
The applicant is requesting this item be continued to the June 19,2006 meeting.
Lien moves to continue A-07-06/RZ-07-06/PP-07-06 to the June 19,2006 meeting. Seconded
by Jacobs. ALL AYE...MOTION CARRIES.
C. A-4-06/RZ-4-06/PP-4-06 - Annexation and Rezone (with a Development al!reement)
from RUT to R-2-DA and Preliminary Plat for Kathleen Estates Subdivision - Dave
YOl'l!ason: Dave Yorgason with Capitol Development is requesting annexation of9.99-acres
and a rezone from RUT (Rural Urban Transition) to R-3-DA (Residential three units per acre
maximum with a development agreement) and preliminary plat approval for Kathleen Estates
Subdivision. The 35 lot subdivision (29 residential, 6 common) consisting of I 0.51-acres is

Aspitarte moves to approve A-4-06/RZ-4-06/PP-4-06 - Annexation and Rezone (with a
Development agreement) from RUT to R-2-DA and Preliminary Plat for Kathleen Estates
Subdivision with the recommendation to City Council that they look at developing a better
use of open space, and that they look at the pathway, lot 8, block 3, that they look at a
pocket park at either lot 9 or lot 7, block 3, for a better utility as opposed to the plan that
was presented tonight. Seconded by Jacobs. ALL AYE...MOTION CARRIES. Aspitarte
amends his motion to have as a condition rather than a recommendation. Seconded by
Jacobs. ALL AYE...MOTION CARRIES.
D. A-5-06/RZ-5-06/PP-06-05 - Annexation & Rezone from RUT to R-2-DA - Park Lane
Estates Subdivision - Chad Moffat: Chad Moffat, represented by Eric Cronin, P. E. with
The Land Group, Inc., is requesting approval of an annexation and rezone from RUT (Rural
Urban Transitional) to R-2-DA (Residential two units per acre maximum with a development
agreement) and preliminary plat approval for Park Lane Estates. The 5.14-acre subdivision
will consist of 12 lots (7 residential, 5 common). The site is located on the west side of North
Park Lane approximately 2, OOO-feet north of West Floating Feather Road at 1835 North Park
Lane.

Curt Betts, 1835 N. Park Lane. In favor of the project. Discusses the well and septic system.
Patricia Minkiewicz, 3047 W. Deerfield Court. Opposing the project. Discusses other
subdivisions that the applicant has brought through the process and that there are several home
owners that have filed ajudicial appeal. Feels this application does not transition well with
surrounding lots.
Chad Moffat, 1842 S. Lakemoor. Discusses the Betts property and their request to keep their
existing septic tank. Wants this subdivision to match the existing Moffat Subdivision.
Patricia Minkiewicz, 3047 W. Deerfield Court. Discusses traffic issues on Park Lane. Does not
believe that any more subdivisions in this area should be approved.
