Minutes - 2006 - Planning & Zoning - 04/17/2006 - Regular THE CITY OF EAGLE PLANNING AND ZONING COMMISSION April 17, 2006 Minutes ORIGINAL I. CALL TO ORDER: Meeting called to order at 6:30 p.m. 2. ROLL CALL: JACOBS, MARKS, PIERCE. Absent: Lien, Aspitarte. Chris Lokken from the Mayor's Youth Advisory Council is also present. Commissioner Aspitarte arrives at 6:31 p.m. 3. CONSENT AGENDA: . Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Chairman, a Commissioner, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. . Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval motion unless specifically stated otherwise. A. Minutes of April 3, 2006. B. Findines of Fact and Conclusions of Law for A-9-05/RZ-13-05/CU-12-05/PPUD-13- 05/PP-OI-06 - Leeacv Preliminary Development Plan & Development Aereement - Eaele Sienature Sports Development. LLC: Eagle Signature Sports Development, LLC, represented by Todd Santiago, is requesting annexation of I 59.09-acres, a rezone of +/-719- acres from A (Agricultural) and RR (Rural Residential-Ada County Designation) to R-2-DA- P (Residential two units per acre maximum with a development agreement - PUD), and conditional use, planned unit development preliminary development plan and preliminary plat (phase one only) approvals for the Legacy Planned Community. The entire development consists of 719-acres (maximum of 1,653-residiential lots with a maximum of 38-acres of commercial and is located approximately 1,850-feet north of State Highway 44 between Linder Road and State Highway 16. The first phase of the preliminary plat is comprised of 228.79 acres with 386 lots (344 residential, 41 common, and I academy lot). Aspitarte moves to approve the consent agenda. Seconded by Pierce. A-IS-OS & RZ-22-05 - Annexation and Rezone from RUT to R-E - M and H Development: M and H Development LLC, represented by Sabrina Whitehead with Briggs Engineering, Inc., is requesting annexation and rezone from RUT (Rural Urban Transition) to R-E (Residential Estates). The 18.98-acre site is located on the south side of West Beacon Light Road approximately lI,-mile east of Ballantyne Lane at 1101 West Beacon Light Road. This item was continuedfrom the April 3, 2006 meeting. B. PP-15-05 - Liehthouse Subdivision - M and H Development: M and H Development LLC, represented by Sabrina Whitehead with Briggs Engineering, Inc., is requesting preliminary plat approval for Lighthouse Subdivision. The 18.93-acre, 11 lot (9 buildable, 2 common) subdivision is located on the south side of West Beacon Light Road approximately lI,-mi1e east of Ballantyne Lane at 1101 West Beacon Light Road. Discusses other subdivisions in the area that have been approved. Asks that the Commission recommend approval of this project. Mike Williams, City Planner, reviews the staff report. Questions from the Commission to City Attorney, John McFadden regarding a LID. Marks opens the public hearing. Annette Reed, 2645 Ustick Road, Meridian. Believes that this subdivision is a good plan. In favor ofthe subdivision. She is the realtor for the sellers of the property. Al Thompson, 1386 Nova Lane, Meridian. Used to live at the project location for 40 years. Believes it would be a great site for homes. Beverly Thompson, 1386 Nova Lane, Meridian. Would like to see beautiful homes built at the location. Todd Hill, Developer of the project. Plans on upgrading the landscaping plans for the project. Paul Hunter, 1605 N. 13th Street, Boise. Did a nutrient project for Briggs Engineering for groundwater quality. Soil samples, nutrient pathogens, groundwater study, etc. Discusses nitrate Issues. Sabrina Whitehead rebuts testimony. Marks closes the public hearing. Discussion amongst the Commission. Commission expresses concerns regarding the letter from Eagle Fire Department and that there is no one from the department here to testifY. Jacobs moves to recommend approval for A-IS-OS & RZ-22-05 - Annexation and Rezone from RUT to R-E - M and H Development. Seconded by Aspitarte. ALL AYE.. . MOTION CARRIES. Jacobs moves to accept item B - PP-15-05 - Lighthouse Subdivision - M and H Development with the recommendation to City Council that they look at the feasibility of requiring water and sewer services through a Local Improvement District and that the Council hears from the Eagle Fire District regarding their letter of denial. Seconded by Pierce. ALL AYE... MOTION CARRIES C. A-OI-06 & RZ-OI-06 - Annexation and Rezone From RUT to MU-DA - Brownstone Capitol. Inc.: Brownstone Capitol, Inc., represented by Doug Russell, ASLA, with The Land Group, Inc., is requesting approval of an annexation and a rezone from RUT (Rural Urban Transition) to MU-DA (Mixed Use with a Development Agreement) for a multi- family seventy (70) unit condominium housing development. The development is to be located on a 5.85-acre site adjacent to the southeast comer of Reid Merrill Park approximately 250-feet east of the intersection of East Shore Drive and East Riverside Drive. Staff is requesting this item be continued to the May 1, 2005 meeting. Marks moves to continue A-OI-06 & RZ-OI-06 - Annexation and Rezone from RUT to MU- DA - Brownstone Capitol, Inc., to the May 1, 2006 meeting. Seconded by Pierce. ALL A YE...MOTION CARRIES. D. A-03-06 & RZ-3-06 - Annexation and Rezone From RUT to R-4 - Donna Weston: Donna Weston, represented by Craig McCullough with Doumecq Development, is requesting annexation and rezone from RUT (Rural Urban Transition) to R-4 (Residential four units per acre). The 4.86-acre, 17 lot subdivision (13 residential, 4 common) is located on the west side of Horseshoe Bend Road approximately 1,200 feet south of Floating Feather Road at 10895 Horseshoe Bend Road. PP-02-06 - Brutsman Subdivision - Donna Weston: Donna Weston, represented by Craig McCullough with Doumecq Development, is requesting preliminary plat approval for Brutsman Subdivision. The 4.86-acre, 17 lot (13 residential, 4 common) subdivision is located on the west side of Horseshoe Bend Road approximately 1 ,200-feet south of Floating Feather Road at 10895 Horseshoe Bend Road. The applicant is requesting this item be remanded to staff. Marks introduces the items. ALL AYE...MOTlON CARRIES. 6. NEW BUSINESS: A. FPUD-OI-06 & FP-02-06 - Final Development Plan and Final Plat for Coast To Coast (Laeuna Pointe) Subdivision - Coast 2 Coast. LLC: Coast 2 Coast, LLC, represented by Bryan Martin, P.E., with Toothman-Orton Engineering Company, is requesting final development plan and final plat approval for Coast To Coast (Laguna Pointe) Subdivision, a 56-lot (44-buildable, 12-common,) planned residential development. The site is located east of Eagle Road approximately Yo-mile north of Chinden Boulevard at 2260 South Eagle Road. Mark Butler reviews the application and discusses some of the issues with the flood. Brian Martin with Toothman-Orton Engineering discusses the floodplain and floodway issues currently happening in the area of the project. Commissioner Aspitarte recuses himself. Creston Thornton, one of the developers of this project. Designed this project to be able to take the water in case of a flood. Believes the project will be safe, especially when the project is finished. Mike Williams, City Staff, reviews the Staff Report. There are some concerns from the City and would like to add some conditions such as an As Built Survey. Would like a letter from Flood Control District #10 approving access points and access for getting equipment on site. Brian, Toothman-Orton Engineering discusses the condition proposed by the City. Proposed flood plain storage and will resubmit back to the City. Would like to wait until construction is complete before an as-built. Creston Thornton, Laguna Pointe and Coast to Coast Development discusses the lots and other flooding issues. Discussion amongst the Commission. Pierce moves to recommend approval for FPUD-OI-06 & FP-02-06 - Final Development Plan and Final Plat for Coast To Coast (Laguna Pointe) Subdivision - Coast 2 Coast, LLC, with the condition that a letter is given by the Flood Control #10 with the approved access points and have "as builts" prior to the issuance of building permits.
