3. CONSENT AGENDA:
. Consent Agenda items are considered to be routine and are acted on with one motion.
There will be no separate discussion on these items unless the Chairman, a
Commissioner, member of City Staff, or a citizen requests an item to be removed
from the Consent Agenda for discussion. Items removed from the Consent Agenda
will be placed on the Regular Agenda in a sequence determined by the Rules of
Order.
. Any item on the Consent Agenda that contains written recommendations from the
City of Eagle shall be adopted as part of the Planning & Zoning Commission's
Consent Agenda approval motion unless specifically stated otherwise.

5. PUBLIC HEARINGS:
A. RZ-18-06 - Rezone from A-R (Al!:ricultural-Residential) to MU-DA (Mixed Use
with development al!:reement) - Pete Cintorino: Pete Cintorino, represented by
Bryan Martin with Toothman-Orton Engineering Company, is requesting a rezone
from A-R (Agricultural-Residential) to MU-DA (Mixed Use with development
agreement). The 11.25-acre site is located on the northeast comer of West State
Street and Park Lane at 3950 West State Street (Lots 1,4, and 9, Block 2 Amended
Plat of Flint Estates). The applicant is requesting that this item be remanded to
staff.
B. PP-13-05 - Resler Subdivision - Pete Cintorino: Pete Cintorino, represented by
Bryan Martin with Toothman-Orton Engineering Company, is requesting preliminary
plat approval for Resler Subdivision. The 11.25-acre, 16 lot commercial subdivision
is located on the northeast comer of West State Street and Park Lane at 3950 West
State Street (Lots 1,4, and 9, Block 2 Amended Plat of Flint Estates). The applicant
is requesting that this item be remanded to staff.
C. A-16-05 & RZ-23-05 - Annexation and Rezone from RR (Rural Residential) to
A-R (Al!:ricultural Residential).City of Eal!:le/Kuester/Deckers: The applicants are
requesting approval of an annexation and rezone from RR (Rural Residential) to A-R
(Agricultural Residential). The 18.84-acre site is generally southwest of the
intersection of Floating Feather Road and Palmer Lane at 1707 & 1725 N. Palmer
Lane.

Pierce moves to recommend (approval 00 A-16-0S & RZ-23-0S - Annexation and
Rezone from RR to A-R. Seconded by Jacobs. Discussion. Pierce moves to amend
the motion to recommend (approval 00 RZ-23-0S - Rezone from RR to A-R.
Seconded by Aspitarte. ALL A YE...MOTION CARRIES.
D. CU-OI-06 - Buildinl!: Heil!:ht Exception - Meridian Joint School District No 2:
Meridian Joint School District No.2, represented by Wayne Thowless with LKV
Architects, is requesting conditional use permit approval for a building height
exception of 38' 6" for the Galielo Math and Science Magnet School. The site is
located on the east side of North Linder Road approximately 1,700-feet north of West
State Street on Lot 1, Block 3, Senora Creek Subdivision. Staffis requesting that
this item be continued to the February 27,2006 meeting.

Lien moves to continue CU-OI-06 - Building Height Exception to the February 27,
2006 meeting. Seconded by Pierce. ALL A YE...MOTION CARRIES.
6. NEW BUSINESS:
A. OS-34-CU/OS-28-MSP and OS-33-MSP - Conditional Use Permit and Master Site
Plan For an Electric Substation and Master Site Plan for an Associated 138 kV
Subtransmission Line - Idaho Power: Idaho Power, represented by Kristi Pardue,
is requesting the approval of a conditional use permit and master site plan to construct
an electrical substation located on a 2.58 acre site at the southeast comer of Beacon
Light and Linder Roads. Idaho Power is also requesting to construct an associated
138 kV subtransmission line adjacent to North Linder Road north of Highway 44 to
Beacon Light Road. This site is located in the Eagle Area of Impact.

Michael Williams, City Planner, reviews the staff report. Recommends approval of the
substation but denial of the subtransmission lines. Discusses the need to meet with Idaho
Power.
Discussion amongst the Commissioners and Staff. Idaho Power owns the property. The
Planning and Zoning Commission and City Council are a recommending body to the
County. City Attorney, John McFadden, discusses costs of the project.
Aspitarte moves to recommend for denial file number OS-34-CU and OS-28-MSP
and 05-33-MSP, the Idaho Power application. Moves to recommend denial of the
transmission line application. Moves to recommend the denial of the substation
location application. The reason for the recommendation of the transmission lines is
that we want to start a dialogue with Idaho Power, that there was no pre-application
contact on the transmission lines with staff. The reason for the denial on the
substation siting is due to the growth in that particular area. We feel that the
substation siting conflicts with our long term plans for that area and it's on a corner
where the best and highest use would be something else. Seconded by Lien.
Discussion. Aspitarte moves to amend his motion and recommend for denial file

number OS-34-CU/OS-28-MSP and OS-33-MSP - Idaho Power application for
Conditional Use Permit and Master Site Plan For an Electric Substation. The
reason for denial of the substation is that the Planning and Zoning Commission
believes that the substation is not properly sited and should be moved and that in a
period of five to six years that that area will be annexed into the City and that they
will have to come back in front of Planning and Zoning for approval if not built
earlier. Moves to recommend for denial the Master Site Plan for an associated 138
kV sub transmission line and the reason for that was that we do not feel that there
was any pre-application contact on the transmission lines with staff or the City of
Eagle and there wasn't any concerted effort made by Idaho Power to work
cooperatively with the City of Eagle. The application is not in compliance with both
the land use map or the approved above ground transmission utility corridor map.
Second (Lien) concurs with the amendment. Discussion. ALL AYE... MOTION
CARRIES.

C. Staff: Staff needs a volunteer to take part in a work group and have a conference call
to establish an economic feasibility study for the Village Center area. Commissioner
Aspitarte volunteers.
