1. CALL TO ORDER: Meeting called to order at 6:33 p.m.
2. ROLL CALL: Present: BANDY, LIEN, PIERCE, ASPITARTE. Absent: MARKS. A
quorum is present.
3. CONSENT AGENDA:
. Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chairman, a Commissioner, member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in
a sequence determined by the Rules of Order.
. Any item on the Consent Agenda that contains written recommendations from the City of
Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda
approval motion unless specifically stated otherwise.
A. Minutes of September 19, 2005.
B. Findim!:s of Fact and Conclusions of Law for A-ll-05/RZ-15-05 - Dustin Simpson:
Dustin Simpson, represented by Angela Cornish and Doug Bergey with Associated Land
Surveyors, is requesting annexation and rezone from RUT (Rural Urban Transition) to R-E
(Residential Estates). The 5-acre site is located on Tabasco Trail approximately SOD-feet east
of Park Lane at 3664 Tabasco Trail.
C. Findings of Fact and Conclusions of Law for PP/FP-4-05 - Esperanza Estates - Dustin
Simpson: Dustin Simpson, represented by Angela Cornish and Doug Bergey with Associated
Land Surveyors, is requesting preliminary/final plat approval for Esperanza Estates (a re-
subdivision of Lot 2, Block 1, Tabasco Subdivision). The 5-acre, 2-lot subdivision is located on
Tabasco Trail approximately SOO-feet east of Park Lane at 3664 Tabasco Trail.
D. Findings of Fact and Conclusions of Law for RZ-16-05 - Beverlv Gross: Beverly Gross,
represented by Charlene Quade with Richard Cummins Law Offices, is requesting approval of
a rezone from A-R (Agricultural- Residential) to R-2-DA (Residential-two units per acre) with
development agreement. The .65 acre site is located in the southeast comer of Lot 6, Block 3
of Rocket Bar Subdivision at 2139 North Edgewood Road.
Lien moves to approve the consent agenda. Seconded by Pierce. ALL A YE...MOTION
CARRIES.
4. UNFINISHED BUSINESS:
A. A-ll-04/RZ-17-04/CU-I0-04/PPUD-3-04/PP-9-04N AC-2-04 Eaglefield Estates
Subdivision Planned Unit Development - D.H. Development. LLC: Eaglefield, LLC,
represented by Landmark Engineering & Planning Inc., is requesting an annexation and rezone
from RR (Residential Rural) to R-2-P (Residential up to two units per acre PUD), R-4-P
(Residential up to four units per acre PUD) and MU-P (Mixed Use PUD), conditional use,
preliminary development plan, preliminary plat and vacation of right-of-way approvals for
Eaglefield Estates Subdivision planned unit development. The 142.4-acre, 419-lot (377-
buildable-362 single family lots and 15 four-plex lots, and 44 common) residential subdivision
is generally located 650-feet west of Linder Road and north of State Highway 44. This item
was continuedfrom the September 19,2005 meeting.
Bandy introduces the item.
Clint Boyle, with Landmark Engineering, gives overview of the application and highlights new

information provided to the Commission. Requests feedback from the Commission regarding the
density in this area and stands for questions.
Nichoel Baird Spencer, City Planner, reviews the new information presented by the applicant.
Discusses information in the Comprehensive Plan and stands for questions from the Commission.
Bandy asks for comments from the public.
Bill Krom, 2924 W. Deerfield Court, comments on the Architectural Design for the project and
marketing in Eagle. Commissioner Lien asks about approximate prices of the homes.
Sue Sullivan, Idaho Transportation Department, presents a map to the Commission. Discusses
major intersections, forecast traffic and pedestrian refuge.
Gene Harding, 3065 Floating Feather, discusses association fees within the subdivision. States
that they have been working hard to keep the City's water system in tact and that the City does not
have its own water system. United Water wanted to be the water supplier for the project.
J.D. Simplot, 6126 W. State Street, believes this project would bring more affordable housing to
Eagle and is not sure why City Staff is recommending the removal 72 lots. States that they are
providing a water system for the City of Eagle. Would like to see the application approved with
the 72 lots.
Peter Harris, Eagle, Idaho, discusses the smaller lot sizes in other areas in Eagle, varying setbacks,
and lot widths. The Gables would go through an extensive Design Review process. These would
be more like town homes.
Clint Boyle rebuts testimony. Chairman Bandy asks when the original application was submitted
which was December of 2004. Commissioner Pierce asks about open space.
Bandy closes the public hearing.
A short recess is called.
Meeting reconvenes at S:OS p.m.
Discussion amongst the Commission. Susan Buxton, City Attorney, explains the water system and
the Ordinance that was presented to the Commission at the last meeting and stands for questions.
Bandy moves to remand this item back to staff for further evaluation and have staff draft
the Commission's recommendations that density calculations be made over the entire
development and that recommendations be made in the transitional unit to show a
transition from a higher density on the Park Lane development to the lower density of the
Floating Feather development. Any other additional items that have come up in the last
couple of weeks, such as the ITD recommendations, and the Holladay Engineering
recommendations that these be included in their recommendations, also consistent with all
the other comments made during deliberations by the board, and recommendations on the
mixture of product type and housing styles. Seconded by Aspitarte. ALL AYE.. . MOTION
CARRIES.
Susan Buxton and Nichoel Baird Spencer elaborate to the public what the Commission would like
to see from Staff.
5. PUBLIC HEARINGS:
A. A-9-05/RZ-13-05/CU-12-05/PPUD-13-05 - Legacv Planned Unit Development: Signature
Sports Development, LLC, represented by Darren Fluke of JUB Engineering is requesting
annexation of 192.63-acres, a rezone of 762.3S-acres from A (Agricultural) and RR (Rural
Residential-Ada County Designation) to R-2-DA-P(Residential two units per acre maximum
with a development agreement - PUD), and conditional use, planned unit development
preliminary development plan approvals for the Legacy Planned Community. The entire
development consists of 762.3S-acres (1, 164-residiential lots with SA-acres of commercial and
291. I-acres of golf course and open space). This item was continuedfrom the September 12,

2005 special meeting. Staff is requesting this item be continued to October 24, 2005 for a
special meeting.
Bandy moves to continue item SA, Legacy Planned Unit Development, to October 24, 2005.

6. NEW BUSINESS:
A. Transportation Improvement Program
Bandy introduces the item.
Nichoel Baird Spencer reviews the handouts for the Transportation Improvement Program that the
Commission does each year and asks for the Commission to review and take into consideration
any projects that may need to be added or removed from the list. Toni, with COMPASS, discusses
proposed round-a-bouts and the new transportation bill.
Bandy moves to approve the City of Eagle recommendations for the 2006/20010 TIP
Program to include objects number 1 through 4 that are provided in staff's report to the
Commissioners. Seconded by Lien. ALL AYE...MOTION CARRIES.
