1. CALL TO ORDER: Meeting called to order at 6:33 p.m.
2. ROLL CALL: Present: BANDY, MARKS, LIEN, PIERCE. Absent: ASPITARTE. A
quorum is present.
3. CONSENT AGENDA:
. Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chairman. a Commissioner, member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda
in a sequence determined by the Rules of Order.
. Any item on the Consent Agenda that contains written recommendations from the City of
Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda
approval motion unless specifically stated otherwise.
A. Minutes of July 18,2005.
B. FindiDl~s of Fact and Conclusions of Law for A-7-0S/RZ-ll-OS . Annexation and
Rezone from RUT to R-t - Capital Development: Capital Development is requesting
annexation and rezone from RUT (Rural Urban Transition) to R-1 (Residential I unit per
acre). The 70.56-acre, 82 lot subdivision (72 buildable, 10 common) is located on the
northeast comer of Meridian Road and Chinden Boulevard.
C. Findin2s of Fact and Conclusions of Law for PP-IO-OS - Castleburv West Subdivision-
Capital Development: Capital Development is requesting preliminary plat approval for
Castlebury West Subdivision. The 70.56-acre. 82 lot subdivision (72 buildable, 10 common)
is located on the northeast corner of Meridian Road and Chinden Boulevard.
Lien moves to approve the consent agenda as presented. Seconded by Pierce. ALL
AYE...MOTION CARRIES.
4. UNFINISHED BUSINESS: None
5. PUBLIC HEARINGS:
A. Church Facilitv Expansion - CU-IO-OS - Ea21e Church of the Nazarene: Eagle Church
of the Nazarene, represented by Jim Main with Design West Architects, is requesting a
conditional use permit to construct a 9,934-square foot building expansion. The 21.38-acre
site is located on the south side of West State Street approximately 3,200-feet west of Eagle
Road at 1001 West State Street.
B. Variance From the Fiftv Foot Floodwav Setback from Drv Creek - V-I-05 - Ea21e
Church of the Nazarene: Eagle Church of the Nazarene, represented by Jim Main with
Design West Architects, is requesting variance approval to construct a building expansion
within the fifty foot (50') fIoodway setback from Dry Creek. The 21.38-acre site is located
on the south side of West State Street approximately 3,200-feet west of Eagle Road at 1001
West State Street.
Bandy introduces the items. City Attorney, John McFadden, states that the applications can be
heard together as they are related.
Jim Main, with Design West Architects, 9 12th Avenue South, Nampa reviews the applications

for both the expansion and the variance.
City Planner, Barb Cerda, reviews the staff reports. She asks the commission to put a condition
requiring a pathway plan be submitted for review by the Parks and Pathway Committee.
Building Official, Mike Mongelli, reviews the floodplain/flood way aspects of the application and
potentials of a flood event. Removal of the existing buildings would benefit the flood way. Mr.
Mongelli stands for questions from the commission.
Bandy opens the public hearing.
Tim Bunn, Pastor of the Eagle Church of the Nazarene, 1460 W. Rush Road, is thankful to the
staff for a favorable recommendation. He would like to continue working with the City.
Bandy closes the public hearing.
Jim Main states that there is a pathway in the churches master plan. The church's budget would
not allow that at this time but they are willing to do it upon the next phase.
Discussion amongst the commission.
Lien moves to approve CU-IO-OS - Eagle Church of the Nazarene with the language that
staff comes up with regarding the pathway. Seconded by Pierce. ALL A YE...MOTION
CARRIES.
Discussion amongst the commission. Bandy states that the intent of motion for No.7 the intent
of the Site Specific Condition of Approval is that the pathway will be required.
Lien moves to approve V-I-OS - Variance from the Fifty Foot Floodway Setback from Dry
Creek. Seconded by Pierce. ALL A YE...MOTION CARRIES.
C. Child care Facilitv - CU-08-05 - Jennifer Vandersnick: Jennifer Vandersnick, represented
by Chris Pearson, is requesting conditional use approval to construct a 3,500-square foot
childcare facility. The O.18-acre site is located on the south side of East Iron Eagle Drive
approximately 660-feet east of East Plaza Drive within Rocky Mountain Business Park (Lot
3, Block 1, Merrill Subdivision No.5).
Bandy introduces the item.
Jennifer Vandersnick, 417 South Fitness Place, reviews the application.
City Planner, Barb Cerda, reviews the staff report and stands for commission questions. There
are concerns about fencing and an outdoor play area.
Bandy opens the public hearing.
No one from the public chooses to speak.
Bandy closes the public hearing.
Jennifer Vandersnick discusses the fence. There are questions about the outdoor activity. Ms.
Vandersnick states that the children are only there for 3 hours at a time once in the morning and
once in the afternoon.
Lien moves to approve CU-08-0S - Childcare Facility. Seconded by Pierce. ALL
A YE...MOTION CARRIES.
D. Bellemeade Planned Unit Development - PP-9-0S/CU-7-0S/PPUD-3-0S - Tom Ricks and
John Wood: Tom Ricks and John Wood, represented by Becky McKay with Engineering
Solutions. LLP, are requesting preliminary development plan, conditional use, and
preliminary plat approvals for Bellemeade Planned Unit Development, a 62-lot (48-
buildable, 14-common) planned residential development. The 15.75-acre site is located north

of West State Street on the east side of Park Lane at 312 North Park Lane, 3850 West Flint
Drive, and 3855 West Flint Drive.
Becky McKay with Engineering Solutions reviews the application.
Tom Ricks, one of the developers of the project, gives an overview of the types of
buildings/homes they would like to put on the area. They are planning on only having one builder
for the area. The area will be done in a Sun Valleyrruscan type of look.
Mike Williams, City Planner, reviews the staff report. There were concerns by staff regarding
density. The applicants did provide updated information prior to the meeting which was given to
the commission to review. Staff also had concerns about the open space. Staff would like a letter
from the Army Corp of Engineers regarding a 404 Permit and that this development would not
require it. Mr. Williams stands for questions. Commissioner Marks has concerns about the style
of the existing homes. There are also concerns about Block 1, Lot 18 and that it should not be
able to be subdivided in the future. City Attorney, John McFadden comments on limiting the re-
subdivision of the lot.
Bandy opens the public hearing.
Becky McKay with Engineering Solutions discusses the existing homes in the area. The homes
will be updated to mesh with the new dwellings. Commissioner Lien asks Mr. Ricks who would
be the target market. Mr. Ricks believes that people do not want the upkeep of larger lots and that
lots closer to schools brings the market.
Bandy closes the public hearing.

Bandy moves to recommend approval for CU-7-05/PPUD-3-05/PP-9-05 with the following
modifications to the Site Specific Conditions of Approval: No.2, add to that statement:
Comply with the requirements of the City Engineer including a letter from Corps of
Engineers regarding the determination of the necessity of a 404- Permit. Site Specific
Condition No. 17: make a note that that condition applies to all lots and blocks except for
Block 1, Lot 18. Add Site Specific Condition No. 22, regarding Block 1, that side setbacks
will be reduced from seven and a half feet to five feet. Add Site Specific Condition No. 23,
regarding Block I, Lot 18, this lot shall remain a residential lot and shall not be redeveloped.
Seconded by Lien. ALL A YE...MOTION CARRIES.

E. Combined Preliminarv and Final Plat for Erland Subdivision No.1 - PPIFP-3-05 - Bob
Erland: Bob Erland, represented by Tim Mokwa with Toothman-Orton Engineering, is
requesting combined preliminary plat and final plat approval for Erland Subdivision No.1 (a
re-subdivision of parcel "c" of Merrill Subdivision), for a 2-lot commercial subdivision. The
1.638-acre development is located on the south side of East Iron Eagle Drive approximately
1,800 feet west of Edgewood Lane.

application and staff report.
City Planner, Mike Williams reviews the staff report.

Tim Mokwa reviews staffs testimony. He would like to proceed with the plat regardless of the
utilities. Mike Williams discusses parking issues and breakdown of landscaping.
Discussion amongst the commission.
Bandy moves to recommend approval PP/FP-3-05 - Erland Subdivision No.1 with the
following modifications to the Site Specific Conditions of Approval: No.5, include the
statement the first line after landscaping plan: including landscaping requirements for
anticipated parking for both parcels. At the end of item No.5, strike City Clerk signing the
final plat and replace that with prior to the issuance of a building permit. Item No.8,
include after cross access agreements on the first line insert, or plats for the properties to
the east and the west prior to the City Clerk signing the final plat. Item No. 13, the second
line after the parenthetical statement, on each lot prior to the issuance of a permit.
Seconded by Lien. ALL A YE...MOTION CARRIES.
6. NEW BUSINESS: None
7. REPORTS:
A. Commission: Timeframes for staff to get applications ready. Possibility of making
application time up to an 8 week time frame. Commission would like more
time to review packets.
B. City Attomey: None.
C. Staff: Reiterates the concerns of the time lines for applications. Sewer District Development
Agreement.
Pierce moves that staff convey to the City Council that at their next meeting that the
application process be extended from 6 weeks to 8 weeks to allow the commissioners more
time to review. Seconded by Lien ALL A YE...MOTION CARRIES.
