ROLL CALL: Present: ASPIT ARTE,BANDY, MARKS, PIERCE. A quorum is present. Absent: LIEN. 3. Kelli Fairless. the Executive Director of Valley Re~ional Transit, gives a presentation on the Valley Regional Transit - Public Transportation Regional Plan. [6:00 p.m. - 6:30 p.m.] Ms. Fairless goes through a power point presentation providing information on Valley Regional Transit and the regional plan. 4. CONSENT AGENDA: Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Chairman, a Commissioner, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval motion unless specifically stated otherwise. A. Minutes of May 16,2005. B. Findin~s of Fact and Conclusions of Law for PPIFP-2-05 - Creekview Subdivision - Thomas G. Maile: Thomas G. Maile is requesting combined preliminary plat and final plat approval for Creekview Subdivision, a 2-10t residential subdivision. The 4.85-acre development is located approximately 3400 feet east of Ballantyne Road on the south side of Rush Road at 1013 W. Rush Road. Marks moves to approve the consent agenda as presented. A-IO-04 & RZ-16-04 Annexation and Rezone From RUT to BP - Red Cliff Development: Red Cliff Development, represented by Bob Unger, is requesting an annexation and rezone from RUT (Rural Urban Transition) to BP (Business Park) for Optimist Park Subdivision No.2. The 9.8-acre site is located approximately 700-feet south of Hill Road on the west side of Horseshoe Bend Road at 8811 North Horseshoe Bend Road. The applicant is requesting this item be continued to June 20, 2005. A-4-05 & RZ-6-05 Annexation and Rezone From RUT to R-E - Lynn and Gayle McKee: Lynn and Gayle McKee are requesting an annexation and rezone from RUT (Rural Urban Transition) to R-E (Residential Estates). The 6.49-acre site is located on the southeast Corner of Beacon Light Road and Ballantyne Road at 1963 W. Beacon Light Road. A-5-05 & RZ-8-05 Annexation and Rezone From RUT to PS-DA - Ea~le Sewer District: Eagle Sewer District, represented by Daren Fluke of J-U-B Engineers Inc., is requesting an annexation and rezone from RUT (Rural Urban Transition) to PS-DA Public/Semipublic with a Development Agreement. The 53.2-acre site is located on the south side of the State Highway 44 alternative route approximately 200 feet west of Ballantyne Road, at 1993 W. State Street. D. CU-4-05 - Wastewater Treatment Facility Expansion - Ea~le Sewer District: Eagle Sewer District, represented by Daren Fluke with J-U-B Engineers Inc., is requesting a Conditional Use Permit to allow for expansion of the wastewater treatment facility. The 53.2- acre site is located on the south side of the State Highway 44 approximately 200 feet west of Ballantyne Road, at 1993 West State Street. Bandy introduces the item. Items C and D will be heard at the same time, but separate motions will be made after the conclusion of the public hearing and discussion amongst the Commissioners. Daren Fluke with J-U-B Engineers 250 S. Beachwood Boise, Idaho, representing Eagle Sewer District. Mr. Fluke reviews the application. Mr. Fluke addresses noise, odor control and aesthetic issues and how the applicant proposes to address each City Planner, Mike Williams presents the Staff report. Bandy opens the public hearing. Fred Kunkler, 1601 W. State St. Eagle, Idaho. Mr. Kunkler is concerned with the lack of detail the applicant presented in regards to what type of structures and facilities will be placed on the site. Fluke rebuts testimony regarding proposed location and amenities. States that the site makes sense as it is adjacent to the current facilities. Bandy closes the public hearing. Discussion amongst the Commission. Marks would like to see more of a landscape buffer east and west side of the project property. Discussion regarding amending the site specific condition regarding landscape buffering. Marks moves that should the Council approve the annexation proposed in A-5-05 & RZ-8- 05 Annexation and Rezone From RUT to PS-DA - Eagle Sewer District, the Commission recommends approval of the proposed rezone. Seconded by Aspitarte. Discussion. Marks amends his motion to include changes to the following site specific conditions of approval: 2.19: The front set back shall be 75', with a 10' high berm, and the side set backs shall be 50' with a 7' high berm. Site specific condition 2.11: Omit the word meandering from the motion. Site specific condition 2.20 shall read: Buildings and structures shall not exceed 50% coverage of the site. Second concurs with the amendment. ALL A YE...MOTION CARRIES. Bandy moves to approve CU-4-05 - Wastewater Treatment Facility Expansion. Seconded by Marks. Discussion. Bandy moves to amend the motion to change site specific condition of approval language to read: the front set back shall be 75' with a 10' high berm, and the side set backs shall be 50' with a 7' high berm. All overhead utilities and associated poles serving the existing residences shall be removed and placed underground to meet the requirements of Title 8 & 9. The landscape screening and location of the proposed pump house on Lot 1, Block 1 should be reviewed and approved by the Design Review Board prior to submitting application for the final plat. STAFF RECOMMENDATION: Staff recommends approval with the site specific conditions of approval and the standard conditions of approval provided below. SITE SPECIFIC CONDITIONS OF APPROVAL: 1. Comply with all requirements of the City Engineer. 2. Comply with all requirements of the development agreement for RZ-9-05. 3. The applicant shall have an on -site meeting with the City Forester to survey all existing trees. Subsequent to the on -site meeting, construction fencing shall be installed (pursuant to the City Forester's direction) to protect all trees that are to be preserved, prior to the commencement of any construction on the site. 4. All living trees that do not encroach upon the buildable area of the lot or upon any area planned for streets and sidewalks shall be preserved, th a te""ined unless removal is permitted by the City Forester. A detailed landscape plan showing how the trees will be integrated into the landscaping areas (unless approved for removal by the City Forester and the Design Review Board) shall be provided for Design Review Board approval prior to the issuance of any building permits. 5. The applicant shall submit a design review application showing: 1) proposed subdivision signage, 2) landscape plan showing perimeter fencing (if proposed) and berming, fencing, and planting details within the required 35-foot wide buffer area along Floating Feather Road, 3) proposed street trees located within the ten (10') foot wide planting strip adjacent to the interior roads, 4) screening and architectural details of the irrigation pump house located in Lot 1, Block 1 and 5) planting details within the proposed and required landscape islands and knuckles and required buffers for approval by the Design Review Board prior to City approval of a final plat. 6. All utility poles providing service to the existing structures on the site shall be removed and service lines shall be buried underground, prior to the issuance of any building permits for the site, existing distribution lines are not required to be buried. The applicant shall submit a design review application showing: 1) proposed subdivision signage,. The design review application shall be reviewed and approved by the Design Review Board prior to the submittal of a final plat. 7. The applicant shall place a note on the final plat which states that the buffer area abutting Floating Feather Road and the entry island is to be located within common lots to be owned and maintained by the homeowner's association except that an alternative method of compliance may be permitted by the City along the frontage of the existing home planned to be retained (Lot 9 Block 2) . Provide a statement in the 2.4 The development shall comply with the Eagle City Code, as it exists in final form at the time an application is made and the conditions within this agreement shall be satisfied. 2.5 pat-hways� Note: The comprehensive plan shows this path south of this property where it is better suited due to existing development to the north (Downing Downs).
