ROLL CALL: Present: ASPITARTE, BANDY, PIERCE. Absent: Marks, Lien. A quorum is present. 3. CONSENT AGENDA: . Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Chairman, a Commissioner, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. . Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval motion unless specifically stated otherwise. Findilll!S of Fact and Conclusions of Law for FPUD-2-0S & FP-3-0S - Final Development Plan and Final Plat for Banburv Meadows PUD Subdivision No.7 - Banburv Meadows LLC: Banbury Meadows, LLC, represented by Johnson Engineering, is requesting final development plan and final plat approval for Banbury Meadows Subdivision Phase 7, a 73-10t (70-buildable, 3-common) residential subdivision. This 20.87-acre (approx.) phase of Banbury Meadows PUD is located on the west side of Eagle Road approximately Yz-mile north of Chinden Blvd. The site is within the Eagle City Limits. Findin2s of Fact and Conclusions of Law for CPA-I-OS & RZ-I-OS & CD-I-OS Comprehensive Plan Amendment From Residential Four to Central Business District. Rezone With Development A2reement From R-4 to CBD-DA and Conditional Use Permit - Ea2le Hei2hts Baptist Church: Eagle Heights Baptist Church, represented by CSHQA, is requesting a Comprehensive Plan Amendment to change the land use designation on the Comprehensive Plan Land Use Map from Residential Four (up to four units per acre) to Central Business District, a rezone from R-4 (Residential up-to four dwelling units per acre) to CBD-DA (Central Business District with Development Agreement), and a conditional use permit to construct a residential/commercial development. The 1.83-acre site is generally located on the south east comer of East Mission Drive and Eagle Road at 291 North First Street. c. D. Findin2s of Fact and Conclusions of Law for PP-3-0S - Lakemoor Subdivision -BW Ea2le. LLC: BW Eagle, LLC, represented by Dan Torfin, is requesting preliminary plat approval for Lakemoor Subdivision. The 178.52-acre, 240-10t (l42-residential, 53- commercial, 45-common) subdivision is located on the east side of Eagle Road approximately lOoo-feet north of Chinden Boulevard. Aspitarte requests to remove item 3D, Findings of Fact and Conclusions of Law for PP-3-05 - Lakemoor Subdivision, from the consent agenda for discussion. Pierce moves to approve the remaining items on the consent agenda as presented. Seconded by Aspitarte. ALL A YE...MOTION CARRIES. Aspitarte comments that the historical information and flood plain should be included in the findings. Dan Torfin, representing BW Eagle, comments on information from a letter from the Idaho Historical Society and requests it to be entered for the record. He believes that the requirement for BW Eagle to construct it was eliminated and there was a general condition that they would work with the City of Eagle and Idaho Transpiration Department for construction of the sidewalk. Bandy moves to approve the Findings of Fact and Conclusions of Law for PP-3-0S - Lakemoor Subdivision with the following modifications: Page S of 23 modify paragraph to read "staff is aware of preservation of existing historical assets on the site, e.g. both the Oregon Trail and associated campsites", and move down from that paragraph as it states. Item No. 24, on Site Specific Conditions of Approval, modify that paragraph with staff's language to demonstrate that the developer is not responsible for constructing the sidewalk, south of its property boundary, connecting to City Market on Eagle Road and Chinden. Seconded by Aspitarte. ALL A YE...MOTION CARRIES. 4. UNFINISHED BUSINESS: None. 5. PUBLIC HEARINGS: A. A-I2-04 & RZ-I8-04 - The City of Ea2le: The City of Eagle is proposing an annexation and rezone from RR (Residential) to A-R (Agricultural-Residential), PS(Public/Semi- Public), R3(Residential 3), R4(Residential 4), MU-DA(Mixed Use with a Development Agreement. The 620+/- acre is divided by State Highway 16 the eastern area is generally located east of State Highway 16, west of Palmer Lane, south of Beacon Light Road and approximately 4,300-feet north of State Highway 44. The western portion is generally located west of State Highway 16, east of Pollard Lane, South of the Farmers Union Canal and approximately 2600 feet north of Floating Feather Road. Zoning Administrator, Bill Vaughan, requests that item 5A, A-12-04 & RZ-18-04, be continued to the June 20, 2005 meeting. Bandy moves that item SA, A-I2-04 & RZ-18-04, be continued to the June 20, 200S meeting. Seconded by Pierce. ALL A YE...MOTION CARRIES. B. A-2-0S/RZ-4-0S/CU-2-0S/PPUD-I-OS/PP-4-0S/PP-S-OS - Ea21e Creek Planned Unit Development - Goldcreek Developers. LLC: Goldcreek Developers, LLC, represented by The Land Group Inc., is requesting an annexation and rezone from RUT (Rural Urban Transition) to R-3-DA-P (Residential up to three units per acre with development agreement and PUD), an annexation and rezone from RR (Residential Rural) to R-2-DA-P (Residential up to two units per acre with development agreement and PUD), conditional use permit, preliminary development plan, and two preliminary plat approvals for Eagle Creek planned unit development. The east phase consists of a 21.93-acre, 69-lot (56-buildable, 13-common) residential subdivision located west of Park Lane at 655 Park Lane. The west phase consists of a 33.36-acre, 89-10t (72-buildable, 17-common) residential subdivision located east of Linder Road at 839 Linder Road. This item was continued from the April 4, 2005 meeting. This item has been re-noticedfor the May 2. 2005 meeting. C. PP-8-04 - Optimist Park No.2 Subdivision - Red Cliff Development: Red Cliff Development, represented by Bob Unger, is requesting preliminary plat approval for Optimist Park Subdivision No.2. The 9.8-acre, 7-10t commercial subdivision is located approximately 700-feet south of Hill Road on the west side of Horseshoe Bend Road at 8811 North Horseshoe Bend Road. Staff is requesting this item be remanded to schedule a new hearing date. Bandy moves that item SC, PP-8-04 - Optimist Park No.2 Subdivision - Red Cliff Development be remanded to staff to schedule a new hearing date. Seconded by Aspitarte. ALL A YE...MOTION CARRIES. D. This item was continued from the March 21, 2005 meeting. This applicant is requesting this item to be continued to the May 2, 2005 meeting. Bandy moves that item 5D, PP -2-05 - Covenant Subdivision - Hillview Development Corporation - The City of Eagle, be continued to the May 2, 2005 meeting. Seconded by Pierce. NEW BUSINESS: A. 05-03-CU/05-04-MSP - West Valle v Baptist Church: West Valley Baptist Church, represented by Royce Shoemate, is requesting the approval of a conditional use permit and master site plan to construct a 7,776-square foot (approximate) church facility with a 50-foot high cross. The 5.78-acre site is located approximately 1000-feet east of Park Lane at 3633 West Floating Feather Road. This site is located in the Eagle Area of Impact. Bandy introduces the item. James Gibson, project architect, reviews the application and explains the project. City Planner, Mike Williams, reviews the staff report. Aspitarte and Bandy would like for the staff report to read "Parsonage use only for the house". Bandy moves that item No. 6A, 05-03-CU/05-04-MSP - West Valley Baptist Church, be approved with the following changes in the Site Specific Conditions of Approval: Item No. I which reads "only the use (church) is approved with this application, inclusive of existing residence be used as a parsonage". Modification of item No.4, strike at the end of the first sentence "and Park Lane abutting this site". The height of steeple/cross should not exceed fifty feet. Seconded by Aspitarte. According to our records, historic properties recorded in the area include 1.) a visible segment of the Oregon Trail in the S 1/2 of Section 21, and 2.) a historic house in the N1/2 of Section 28. Enclosed are a map and site form describing the segment of Oregon Trail. If this area will be impacted in construction, our office would be happy to photograph and document any remnants of the trail.
