CALL TO ORDER: Meeting called to order at 6:37 p.m.
ROLL CALL: Present: LIEN, BANDY, MARKS, PIERCE, ASPITARTE
CONSENT AGENDA:
Consent Agenda items are considered to be routine and are acted on with one motion.
There will be no separate discussion on these items unless the Chairman, a
Commissioner, member of City Staff, or a citizen requests an item to be removed from
the Consent Agenda for discussion. Items removed from the Consent Agenda will be
placed on the Regular Agenda in a sequence determined by the Rules of Order.
Any item on the Consent Agenda that contains written recommendations from the City of
Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda
approval motion unless specifically stated otherwise.

C. Findin2s of Fact and Conclusions of Law for RZ-15-04 - Rezone from A-R to
BP-DA - Glenn Mosell: Glenn Mosell, represented by The Land Group, Inc., is
requesting a rezone from A-R (Agricultural-Residential) to BP-DA (Business Park
with Development Agreement) for the construction of a self storage facility. The
4.32-acre parcel is located on the south side of Hill Road approximately 240-feet
East of State Highway 55 at 2835 East Hill Road.
D. Findin2s of Fact and Conclusions of Law for A-8-04 & RZ-13-04-
Annexation and Rezone from RUT to R-E - Bill Guhrke: Bill Guhrke,
represented by Land Consultants Inc., is requesting an annexation and rezone
from RUT (Rural Urban Transition) to R-E (Residential Estates - up to one
dwelling unit per two acres) for Venice Subdivision. The 5.03-acre development
is located south of Beacon Light Road, approximately 1/2 mile west of Eagle
Road at 885 West Beacon Light Road.
E. Findin2s of Fact and Conclusions of Law for PPIFP-4-04 - Venice
Subdivision - Bill Guhrke: Bill Guhrke, represented by Land Consultants Inc., is
requesting combined preliminary plat and final plat approval for Venice
Subdivision, a 2-10t (2-buildable) residential subdivision. The 5.03-acre
development is located south of Beacon Light Road, approximately 1/2 mile west
of Eagle Road at 885 West Beacon Light Road.
F. Findin2s of Fact and Conclusion of Law for FPUD-I-05 & FP-I-05 - Final
Development Plan and Final Plat for Shadow View (aka Shadow Rid2e) PUD
Subdivision - Hillview Development Corporation: Hillview Development
Corporation, represented by Land Consultants Inc., is requesting final
development plan and final plat approval for phase 2 of Shadow View
Subdivision PUD (also known as Shadow Ridge), a 52-lot (45-buildable, 7-
common) residential subdivision. This 14.6-acre phase of the Shadow Ridge
Subdivision PUD is located on the west side of Horseshoe Bend Road at 10943
through 11053 Horseshoe Bend Road.

Marks removes item 3B from the consent agenda.
Bandy moves to approve the consent agenda as amended. Seconded by Pierce.
ALL AYE.. .MOTION CARRIES.
Marks states item 3C on the February 7, 2005 meeting remains a concern for him
given further consideration. Marks would like a note to Council that although he
voted aye on this application and he recognizes that it meets all of the criteria for this
zoning he has some concern regarding this particular use.
Bandy moves to accept the minutes of February 7,2005 with the additional
remarks stated by Marks. Seconded by Marks. ALL AYE...MOTION
CARRIES.

5. PUBLIC HEARINGS:
Bandy notes the applicant has requested item 3C to be continued.
Bandy moves to continue item 3C RZ-8-97/CU-6-97/PPUD-1-97 MOD Brookwood Planned
Unit Development Modification - Aries Development to the February 28, 2005 meeting.
Seconded by Lien. ALL AYE...MOTION CARRIES.
A. A-I0-04 & RZ-16-04 Annexation and Rezone From RUT to BP - Red Cliff
Development: Red Cliff Development, represented by Bob Unger, is requesting an annexation
and rezone from RUT (Rural Urban Transition) to BP (Business Park) for Optimist Park
Subdivision No.2. The 9.8-acre site is located approximately 700-feet south of Hill Road on the
west side of Horseshoe Bend Road at 8811 North Horseshoe Bend Road.
Bandy introduces them item and states that items A & B will be heard the items at the same time,
and separate motions will be made.
City Attorney, John McFadden, notes that as the Planning and Zoning Commission is not the
recommending body in regards to the requested annexation. The Commissions role is to advise
on the requested zoning. It is the responsibility of the Council to make the decision on the
annexation request.
Bob Unger, 988 Longmont Ave. Ste. 200 Boise, Idaho representing Red Cliff Development. Mr.
Unger reviews the application.
City Planner, Jeff Lowe, reviews the staff report.
Bandy opens the public hearing.
Lynne Patton 8811 Horseshoe Bend Road Eagle, Idaho. This is the first she has heard of this
proposal and that their home would be a non-conforming use. They do not want their property
rezoned with the rest of this proposal. She is concerned that they wanted to keep their residence
with its current zoning. Discussion.
Cory Swane 623 Longbranch Boise, Idaho President of Red Cliff Development. Comments on
his unfamiliarity with Eagle Code and that he was unaware that they could not allow the
residence remain as an non-conforming use. Discussion.
Bandy moves to continue items A & B to the March 21, 2005 meeting leaving the public
hearing open. Seconded by Marks. ALL A YE...MOTION CARRIES.
B. PP-8-04 - Optimist Park No.2 Subdivision - Red Cliff Development: Red Cliff

Development, represented by Bob Unger, is requesting preliminary plat approval for Optimist
Park Subdivision No.2. The 9.8-acre, 7-10t commercial subdivision is located approximately
700-feet south of Hill Road on the west side of Horseshoe Bend Road at 8811 North Horseshoe
Bend Road.
See above motion.
C. RZ-8-97/CU-6-97/PPUD-1-97 MOD Brookwood Planned Unit Development
Modification - Aries Development: Aries Development LLC, represented by Michael
Hormaechea, is requesting a rezone from R-4 (Residential- up to four units per acre) to R-4-DA-
P (Residential - up to four units per acre maximum with development agreement - PUD) and a
modification to the conditional use and preliminary development plan for Brookwood
Subdivision. The modification consists of adding a 1.19-acre parcel to the previously approved
219-acre PUD to construct an office building. The site is generally located on the north side of
Floating Feather Road approximately 1400-feet east of Eagle Road at 470 East Floating Feather
Road. This item will be continued to the February 28, 2005 meeting.
