Minutes
1. CALL TO ORDER: Called to order at 6:30 p.m.
2. ROLL CALL: Present: BANDY, MARKS, PIERCE, ASPITARTE. Absent: LIEN.
A quorum is present.
3.
CONSENT AGENDA:
Consent Agenda items are considered to be routine and are acted on with one motion.
There will be no separate discussion on these items unless the Chairman, a
Commissioner, member of City Staff, or a citizen requests an item to be removed from
the Consent Agenda for discussion. Items removed from the Consent Agenda will be
placed on the Regular Agenda in a sequence determined by the Rules of Order.
Any item on the Consent Agenda that contains written recommendations from the City of
Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda
approval motion unless specifically stated otherwise.
A. Minutes of February 18,2005.
B. Findin2s of Fact and Conclusion of Law for CU-9-04 - Bank/Financial
Institution with drive-up service - Syrin2a Bank: Syringa Bank, represented by
CSHQA, is requesting conditional use approval to construct a bank facility with
three drive-up service lanes. The 1.04 acre site is generally located on the
northwest comer of State Highway 44 and north Horseshoe Bend Road in the
Eagle Promenade Shopping Center at 3172 East State Street.
Bandy removes item 3A from consent agenda as it was not in the packet for review. (note
item A should read January 18,2005 minutes.)
Marks moves to approve the consent agenda item 3B. Seconded by Aspitarte. ALL
AYE...MOTION CARRIES.
4. PUBLIC HEARINGS:
Bandy moves item 4D up on the agenda to be discussed at this time.
D. PP- 7-04 - Symphony Subdivision - Park Hampton LLC: Park Hampton LLC is
requesting preliminary plat approval for Symphony Subdivision, a 24-10t (2-residential, 18-
commercial, 4-common) commercial/residential subdivision. The 16.05-acre development is
generally located at the northeast comer of State Highway 44 and Park Lane. This item was
continued from the January 18, 2005 meeting
City Planner, Jeff Lowe, notes that the applicant would like to have the item continued for 30
days to give him time to meet with adjoining property owners to discuss development in the area.
The item would be heard at the March 7, 2005 meeting.
Marks moves to continue item 4D PP-7-04 Symphony Subdivision Park Hampton LLC. to
the March 7,2005 meeting. Seconded by Pierce. ALL AYE...MOTION CARRIES.
A. A-8-04 & RZ-13-04 - Annexation and Rezone From RUT to R-E - Bill Guhrke: Bill
Guhrke, represented by Land Consultants Inc., is requesting an annexation and rezone from RUT
(Rural Urban Transition) to R-E (Residential-Estates - up to one dwelling unit per two acres) for
Venice Subdivision. The 5.03-acre development is located south of Beacon Light Road,

approximately 1/2 mile west of Eagle Road at 885 West Beacon Light Road.
B. PP/FP-4-04 - Venice Subdivision - Bill Guhrke: Bill Guhrke, represented by Land
Consultants Inc., is requesting combined preliminary plat and final plat approval for Venice
Subdivision, a 2-lot (2-buildable) residential subdivision. The 5.03-acre development is located
south of Beacon Light Road, approximately one-half mile west of Eagle Road at 885 West
Beacon Light Road.
Bandy introduces the item and notes that items A and B will be heard at the same time with
separate action motions being made.
Mark Butler, 52 N. 2nd St. Eagle, Idaho with Land Consultant Inc. Butler reviews the
applications.
City Planner, Jeff Lowe, reviews the staff reports. General discussion between Commission and
Lowe.
Bandy opens the public hearing.
Lisa McNeilly, 2741 N. Ana Cordes Lane. Has concerns regarding the existing private road and
the maintenance issues that may arise. Would like to know who is responsible if damage is done
to the private road? Feels the street light is a good idea. Expresses irrigation right issues.
Mark McNeilly adds nothing further but concurs with Lisa McNeilly's comments.
Butler rebuts testimony. States that any patches made to the private road could be conditioned to
be meet ACHD standards. Also discusses the street light requirement and suggests perhaps it
could be placed on the existing Idaho Power pole currently on site.
Bandy closes the public hearing.
City Attorney, John McFadden, comments on CC&R requirements.
General discussion.
Marks moves A-8-04 & RZ-13-04 - Annexation and Rezone From RUT to R-E, adding a
notation that it does not meet the minimum requirements of 50' but it does measure the 45'
from the right of way and based on the existing structure we approve it as it sits. Seconded
by Aspitarte. ALL A YE...MOTION CARRIES.
Bandy moves to approve PP/FP-4-04 Venice Subdivision with the site specific conditions of
approval with the following changes. Site specific condition of approval #5: Add language
that the developer shall explore taping into existing power line in the easement on the west
side of the property. Site specific condition #8: The developer shall pay a proportionate
amount of maintenance for the private road way and also a recommendation that the
developer and other property owners within this area get together and discuss upgrading
or amending their CC&R's. Add site specific condition #12: Recommend the development
of an irrigation plan to be submitted to the city engineer for review and approval.
Seconded by Marks. Discussion. ALL A YE...MOTION CARRIES.
C. RZ-15-04 - Rezone from A-R to BP-DA - Glenn Mosell: Glenn Mosell, represented by
The Land Group, Inc., is requesting a rezone from A-R (Agricultural-Residential) to BP-DA
(Business Park with Development Agreement) for the construction of a self storage facility. The
4.32-acre parcel is located on the south side of Hill Road approximately 240- feet East of State
Highway 55 at 2835 East Hill Road. This item was continuedfrom the January 18, 2005
meeting.

Doug Russell 462 E. Shore Drive Eagle, Idaho. Mr. Russell is with The Land Group which
represents Mr. Glenn Mosell. Russell reviews the application.
City Planner, Jeff Lowe, reviews the staff report.
Bandy opens the public hearing.
Mark Butler, 52 N. Second St. Eagle, Idaho. Comments on the comprehensive plan language.
Butler feels this is exactly the type of use that would be appropriate, and what Council
envisioned when looking at land use designations in this area.
Russell rebuts testimony.
Bandy closes the public hearing.
Discussion amongst the Commission.
Marks moves to approve RZ-15-04 - Rezone from A-R to BP-DA with the site specific and
standard conditions of approval adding a condition that there shall be no access to
Highway 55. Seconded by Pierce. ALL AY...MOTION CARRIES.
Marks would like a note to Council that although he voted aye on this application and he
recognizes that it meets all of the criteria for this zoning he has some concern regarding this
particular use.
D. PP-7-04 - Symphony Subdivision - Park Hampton LLC: Park Hampton LLC is
requesting preliminary plat approval for Symphony Subdivision, a 24-lot (2-residential, 18-
commercial, 4-common) commercial/residential subdivision. The 16.05-acre development is
generally located at the northeast comer of State Highway 44 and Park Lane. This item was
continued from the January 18,2005 meeting.

5. NEW BUSINESS:
A. FPUD-I-05 & FP-I-05 - Final Development Plan and Final Plat for Shadow View (aka
Shadow Rid2e) PUD Subdivision - Hillview Development Corporation: Hillview
Development Corporation, represented by Land Consultants Inc., is requesting final development
plan and final plat approval for phase 2 of Shadow View Subdivision PUD (also known as
Shadow Ridge), a 52-lot (45-buildable, 7-common) residential subdivision. This 14.6-acre phase
of the Shadow Ridge Subdivision PUD is located on the west side of Horseshoe Bend Road at
10943 through 11053 Horseshoe Bend Road.

corresponding Planning and Zoning Commission meeting). Discussions regarding the development of
adjacent properties in the area, as well as the future improvements being studied for SH 44, have created
the need to consider the timing, necessary improvements, and cohesion of this project with future projects.
