THE CITY OF EAGLE
PLANNING & ZONING COMMISSION MINUTES
December 20, 2004 at 6:30 p.m.
The Planning and Zoning Commission met in regular session on December 20, 2004, with
Chairman Bandy presiding.
1. CALL TO ORDER: The meeting was called to order at 6:30 p.m.
2. ROLL CALL: The following members were Present: LIEN, BANDY, DECKERS.
Absent: MARKS. A quorum is present.
3. CONSENT AGENDA:
Consent Agenda items are considered to be routine and are acted on with one motion.
There will be no separate discussion on these items unless the Chairman, a
Commissioner, member of City Staff, or a citizen requests an item to be removed from
the Consent Agenda for discussion. Items removed from the Consent Agenda will be
placed on the Regular Agenda in a sequence determined by the Rules of Order.
Any item on the Consent Agenda that contains written recommendations from the City of
Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda
approval motion unless specifically stated otherwise.

5. PUBLIC HEARINGS:
A. A-8-04 & RZ-13-04 - Annexation and Rezone from RUT to R-E - Bill Guhrke,
represented by Land Consultants Inc., is requesting an annexation and rezone from RUT
(Rural Urban Transition) to R-E (Residential Estates - up to one dwelling unit per two
acres) for Venice Subdivision. The 5.03-acre development is located south of Beacon
Light Road, approximately 1/2 mile west of Eagle Road at 885 West Beacon Light Road.
This item is requested to be continued to the January 3.2005 meeting.
Bandy introduces item and staff explains request for continuation.
Bandy moves to continue A-8-04 & RZ-13-04 as requested. Lien seconds. ALL
A YES...MOTION CARRIES.
B. PPIFP-4-04 - Venice Subdivision - Bill Guhrke, represented by Land Consultants Inc.,
is requesting combined preliminary plat and final plat approval for Venice Subdivision, a
2-lot (2-buildable) residential subdivision. The 5.03-acre development is located south of
Beacon Light Road, approximately 1/2 mile west of Eagle Road at 885 West Beacon
Light Road. This item is requested to be continued to the January 3, 2005 meeting.
Bandy introduces item and staff explains request for continuation.

C. A-9-04 & RZ-14-04 - Annexation and Rezone from RUT to A and R-E - Mark and
Linda Butler, represented by Land Consultants, Inc., is requesting an annexation and
rezone from RUT (Rural Urban Transition) to A (Agricultural) and R-E (Residential-
Estates - up to one dwelling unit per two acres) for Loch Lomond Subdivision No.2. The

16.02-acre development is located west of Park Lane, approximately 600-feet north of
Floating Feather at 1681 North Park Lane.
Bandy introduces item.
Applicant, Mark Butler, 52 N. 2nd St., gives PowerPoint presentation on Loch Lomond.
Jeff Lowe, City Staff, discusses item and does not recommend approval based on private
road and lighting issues.
Commission agrees that issue of private roads needs to be addressed.
Deckers sees the problem with this particular private road is the lack of future ability to
interconnect. Perhaps have some sort of right-of-way dedicated to the City for future road
connections.
Deckers believes the fact that property owners have requested the annexation mitigates
any "shoestring" annexation issues.
Staff indicates that Parks and Pathways have not reviewed this application.
Staff on not requiring a striped pedestrian lane: low volume of traffic due to low density
would not present a problem.
Applicant on how pathways will cross driveway cuts: Can stripe areas that cross or look
into stamped concrete to be reviewed and approved by Design Review Board.
Bandy would like condition #11 changed to read stamped concrete instead of striped.
Deckers does not favor lighting in the cul-de-sac or on Park Lane.
Bandy suggests we add language that lighting for this development be similar to others in
the area and change condition #12 to read that if Council approves the private road,
lighting will not be required on Park LanelBraveheart intersection or in the cul-de-sac.
Add new condition #15 that pathways crossing driveways and Braveheart Lane be
stamped or textured concrete.
Deckers moves to approve A-9-04 & RZ-14-04 as amended. Lien seconds. ALL
AYES... MOTION CARRIES.
D. PPIFP-5-04 - Loch Lomond Subdivision No.2 - Mark and Linda Butler, represented
by Land Consultants, Inc., is requesting combined preliminary and final plat approval for
Loch Lomond Subdivision No.2, a 9-lot (8-buildable, I-common) residential
subdivision. The 16.02-acre development is located west of Park Lane, approximately
600-feet north of Floating Feather Road at 1681 North Park Lane.
Bandy introduces item.
Staff, Commission, and Applicant testimony already considered from above item.
Deckers moves to approve PPIFP-5-04 with staff recommendations. Lien seconds.
TWO A YES, ONE NAY ...MOTION CARRIES. Deckers descending opinion is that
we should require a public road and interconnection to the West. Also makes
recommendation that application be sent to Parks & Pathways prior to submitting
to Council. Bandy recommends joint meeting with Council to discuss the recurring
issue of private roads.

E. ZOA-8-04 - The City of Eagle is proposing to amend Eagle City Code Title 8 "Zoning",
Chapter 7 "Zoning Administration and Enforcement", Section 8 "Notice Requirements",
to adopt standards for neighborhood meetings prior to the submittal of development
applications to the City of Eagle. This item is continued from the December 6, 2004
meeting.
Bandy introduces item.
Jeff Lowe, City Staff, presents modifications as previously discussed.
