October 18,2004 at 6:30 P.M
The Planning and Zoning Commission met in regular session on October 18, 2004, with Vice-
Chairman Deckers presiding.

CALL TO ORDER: The meeting was called to order at 6:35 p.m.
ROLL CALL: The following members were Present: DECKERS, GLA V ACH,
MARKS. Absent: LIEN, BANDY
CONSENT AGENDA:

Consent Agenda items are considered to be routine and are acted on with one
motion. There will be no separate discussion on these items unless the Chairman,
a Commissioner, member of City Staff, or a citizen requests an item to be
removed from the Consent Agenda for discussion. Items removed from the
Consent Agenda will be placed on the Regular Agenda in a sequence determined
by the Rules of Order.
Any item on the Consent Agenda that contains written recommendations from the
City of Eagle shall be adopted as part of the Planning & Zoning Commission's
Consent Agenda approval motion unless specifically stated otherwise.

Findines of Fact and Conclusions of Law for PP/FP-I-04 - Sydney and
Reese Subdivision - Marearet Jones: Margaret Jones with Sydney & Associates
LLC, represented by James Murray with CSHQA, is requesting combined
preliminary plat and final plat approval for Reese Subdivision, a re-subdivision of
Lot 17, Block 3, of Merrill Subdivision No.2. The 1.04-acre, 2-lot commercial
development is located south of East Plaza Drive, at 781 East Plaza Drive.

Findines of Fact and Conclusions of Law for FPUD-5-04 & FP-7-04-
Shadow Ridee Subdivision - Hillview Development Corporation: Hillview
Development Corporation, represented by Land Consultants Inc., is requesting
final development plan and fmal plat approval for phase I of Shadow Ridge
Subdivision PUD, a 92-lot (77-buildable, 15-common) residential subdivision.
This 25-acre phase of the Shadow Ridge Subdivision PUD is located on the west
side of Horseshoe Bend Road at 10711 through 10867 Horseshoe Bend Road.
Findines of Fact and Conclusions of Law for PP-6-04 - Westover Lakes
Subdivision - Naev Sprinecreek: Nagy Springcreek LLC, represented by Land
Consultants Inc., is requesting preliminary plat approval for Westover Lakes
Subdivision, a 32-lot (26-buildable, 6-common) residential subdivision. The
26. 18-acre site is located west of Eagle Road, at 2267 South Eagle Road.
Findines of Fact and Conclusions of Law for RZ-9-04 - Westover Lakes
Subdivision - Naev Sprinecreek: Nagy Springcreek LLc., represented by Land
Consultants Inc., is requesting a rezone from A-R (Agricultural-Residential) to R-
2 (Residential- up to two dwelling units per acre). The 26.18-acre site is located
west of Eagle Road, at 2267 South Eagle Road.
Findines of Fact and Conclusions of Law for Laeuna CPA -1-04 - Laeuna
Pointe LLC: Laguna Pointe, LLC, represented by Land Consultants, Inc., is
requesting a Comprehensive Plan Amendment to change the land use designation
on the Comprehensive Plan Land Use Map from Residential Two (up to two

previously submitted to the City for review included this property, a 9.3 I-acre
portion of the approximately 117 -acre site.

DECKERS seconds. ALL A YES...MOTION CARRIES.
DECKERS moves to approve consent agenda item A, minutes of the 10/4/04
meeting, with the following amendment:
Clarify the motion for PP-6-04 that a surety or funding mechanism is
required for future sidewalk construction along Eagle Road.

PUBLIC HEARINGS:
A. A-6-04 & RZ-ll-04 - Annexation and Rezone From RUT to PS - Ada
County Hiehwav District - Doherty & Associates: The Ada County Highway
District is requesting approval of an annexation and rezone from RUT to PS
(Public/Semi-Public) for the construction of a park and ride lot. The .79-acre
parcel is located on the southwest comer of the intersection of State Highway 44
and East Riverside Drive.
Deckers opens the item.
Karen Doherty, Doherty & Associates, representing ACHD Commute-Ride,
presents item. Will lease property from ITD; receive funds from Federal Transit
Authority. Start construction in fall of 2005.
Jeff Lowe, City Staff, presents application and recommends approval.
Deckers asks if preliminary plat will be required after annexation/rezone.
Staff indicates no, just Design Review.
Marks asks for clarification that property is owned by ITD and indicates that there
is currently no crosswalk. Wants to know if public safety will be addressed and if
so, where in process.
Staff on rebuttal: Commission can put special recommendations in their Findings
or write letter to lTD.
Karen on rebuttal: will initiate dialogue with ITD regarding crosswalk.
No public testimony.
Deckers closes public hearing.

GLA V ACH moves to approve A-6-04 & RZ-ll-04 with note that ITD and
ACHD look at crosswalk to be introduced at intersection of Riverside Drive
and State Hwy. 44. MARKS seconds. ALL A YES... MOTION CARRIES.
ZOA-7-04 - Zonine Ordinance Amendment to amend ECC Section 8-8-3:
The City of Eagle is proposing to amend Eagle City Code Title 8 "Zoning",
