CALL TO ORDER: The meeting was called to order at 6:40pm. ROLL CALL: The following members were present: LIEN, DECKERS, GLA V ACH, and MARKS. Absent: BANDY. A quorum is present. CONSENT AGENDA: . Consent Agenda items are considered to be routine and are acted on with one motion. There will be no separate discussion on these items unless the Chairman, a Commissioner, member of City Staff, or a citizen requests an item to be removed from the Consent Agenda for discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in a sequence determined by the Rules of Order. . Any item on the Consent Agenda that contains written recommendations from the City of Eagle shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval motion unless specifically stated otherwise. Lien makes motion for Deckers to act as chair for this evening's meeting. Glavach seconds. All ayes...motion carries. A. Memo to City Council regarding Planning and Zoning Commission recommendations for FY 2006-2010 Transportation Improvement Program (TIP) Deckers introduced the item. Jeff Lowe, City Staff, summarized TIP priorities. Deckers clarified that #17 should be on the active list and read "striping on Hwy. 44" and motioned to approve the TIP with this modification. Lien Seconded. ALL AYES...MOTION CARRIES. UNFINISHED BUSINESS: None PUBLIC HEARINGS: A. CU-8-04 - Rod and Debi Wagner are requesting conditional use permit approval to operate a fall festival with events including a com maze, pumpkin patches, hayrides, children's outdoor play area, outdoor musical entertainment, and associated beverage and food vendor sales. The site is located on the north side of Mace Road and west of Eagle Road at 800 W. Mace Road. Marks recuses himself from this hearing because his employer has an economic interest. Deckers opens the public hearing. Mark Butler, 1640 W. Washam Rd., clarified that he, not LCI, is personally representing the Wagners. He outlined site location, discussed traffic and lighting, and indicated that helicopter rides would no longer be part of the festival. He then read four letters from Two Rivers residents into the record in support of keeping the festival. Jeff Lowe, City Staff, discussed conditional use permit and recommended approval. The application will expire in 2008. Festival to operate 10am-lOpm, 7 days/wk, and no longer than 45 days consecutive. Alcohol only served if City Council approves 3. 4. 5. All other vendor permits must be approved. Lighting must be shielded or pointed down. Applicant will comply with traffic control plan and water trucks will be maintained on site to discourage dust. Straw bales will buffer the stage area. Deckers, Glavach asked if there were any phone-in complaints to Sheriff Office or the City Code Enforcement Officer last year. Jeff answered no. Deckers asked about any live or amplified music. Applicant to address on rebuttal. Jaenna Bludd, 2319 E. Halsey Dr., supports the festival. Gail Stauffer, 476 W. Willow Trace, supports the festival. Betty Zorn, 58 W. 2nd St., supports the festival, wants to keep festival for grandchildren. Jeff Creed, 1337 E. State St., supports the pumpkin maze. Rich Montague, no address, supports Wagner Farms and keeping festival in operation. Rene Christener introduced Wendy Frasier, to speak for Two Rivers homeowners. She clarified that Dennis Baker does not speak for the homeowners, and the majority of residents support the festival. Joey Knickrum, 1403 Mace Rd., said she wants to keep the festival for her grandchildren but the balloons scare her horses. Maxine Mace, lives in farmhouse adjacent to Wagner's, she loves the festival. Tom Crawl, 5263 Trail Wind, Boise. Supports family-oriented festival. Tonya Ellison, 1811 W. Mace, predates Two Rivers. Supports Wagner Farm and the wholesome and educational activities. Alicia Gearhart, 26235 Lancing Lane, Middleton, likes family-oriented agricultural festival and learning opportunities for children. Joe Ivans, 1375 E. Pineridge, Boise, brings family to festival where kids feel safe. Good benefit and supports festival. Shana Branch, Two Rivers, has no complaints. Tom Conklin, 735 Palmetto, supports community festival and thinks this is what adds to quality of life in the Treasure Valley. Monty Jackson, 1073 S. Arbor Island, supports Wagner Farm operation and festival, part of what makes living in Eagle fun for kids. Pat Lusk, 1764 Rush Rd., supports festival. Wayne Richie, met Wagner's at the first year of the festival and has been coming back ever since. Most important is a great opportunities for kids. Richard Marks, 966 W. Hialeah, chose Eagle for community involvement, putting family first. . . Wagner family event brought him to area. Chuck Misner, 3307 Hansen, Boise, thinks the festival is the best family-oriented activity in the area, educational. Two Rivers Dr., angry that their newsletter was being used by Dennis Baker to oppose the festival. Five children and it's the best event in town. Wagner's are great neighbors. Michael Blood, 2319 E. Halsey, going to festival for five years. Looks forward to festival all year long. Nicki Clampitt, Meridian, has been part of festival and contribution to community for last 7 years. Doug Mason, 864 E. Ashford, Meridian, supports pumpkin festival and its contribution to children. Connie Crowell, 5263 E. Truman Dr., Boise, kids learn about farming and Eagle community; important for kids and community. Samaria Ride, 7165 Glenridge Dr., both her and husband work for Wagner's and support festival. On rebuttal, Mark Butler addressed music. Live music directed away from subdivision to the south and not after lOpm plus 10-ft hay-bale wall. Rod Wagner added 1 scheduled night of karaoke on Saturday night only and not after 10pm. Jeff Lowe, City Staff, addressed music and concluded that city sound ordinances would be adhered to, and alleviate any noise concerns. Deckers asked if permit went to Wagner's or the land. Staff indicated the permit went to land as long as new or other owners submitted to same. Discussion amongst the Commission. Deckers closed public hearing. Lien suggested we add clarification to noise ordinance. Deckers supports family event, rural identity. In favor of application with consideration for amplified sound. Glavach indicated that current noise ordinance should cover any sound issues, and that any additions should not be too restrictive. Attorney clarified that City ordinance only covers between lOpm and 7 am. Deckers suggested that staff and applicant meet to clarify any discrepancy between proposed sound and current noise ordinances. Glavach motioned to recommend approval to City Council, with site-specific "sound" verbiage. Lien seconded. ALL AYES...MOTION CARRIES. B. ZOA-6-04 - Joe Glaisyer is proposing to amend Eagle City Code Title 8 "Zoning", Chapter 2 "Zoning Districts and Map", Section 4 "Schedule of Building Height and Lot Area Regulations", to change the maximum lot coverage permitted in the R-E (Residential-Estates) zoning district from 10% to 25%. Deckers introduced item. Mark Butler, representing Glaisyer. Proposed amendment to 2-acre lots. 25% lot coverage, 75% open area. Tahoe Ridge. Lien asked how many interested parties have been turned away in respect to 10% limit. Jeff Lowe, City Staff, clarified lot size as it relates to lot coverage. Looked at recent permits issued, similar subdivision, 1.8 acres and above, and of 9 permits, average 4300sf, which was 7-10% lot coverage. Did not see any applications that were denied based on lot coverage percentage, and therefore the code is not in need of correction. Mark Butler on rebuttal: Glavach asked for clarification that lot coverage included all buildings, not just home. Discussion amongst the Commission. Deckers closed public hearing. Deckers agrees that something greater than 10% is needed as follows: ifR-1 at 35%, then R-E should be at 17%. . R1 at 37,000sfx 35% = 12,950sf . RE at 1.8 acres x 17% = 13,329sf Marks does not agree that the increase is appropriate. Deckers brought up rural identity again, but stands by 17%. Lien agrees that increase to 17% will allow for accessory buildings, not necessarily larger square footage homes. Marks suggested limit initial structure to 10% with allowance for additional outbuildings. Glavach says that these areas are purchased as "estates" which means NO rural identity but large square footage home, with large manicured lawn area, swimming pool, RV structure, etc. Deckers indicated that horses and/or livestock are not allowed in subdivision anyways, so increase is reasonable. Lien agrees to "raise the bar." Deckers reminded the initial reason for R-E was for density control and rural ranchette style development. The R-E zone developed different than the City anticipated, the designation became precisely what the City named it: estate homes. Marks feels max lot coverage is already excessive, but would approve additional percentage growth for outbuildings, i.e. keep initial structure at 10% lot coverage, with accessory structures to occupy an additional 5%. Deckers motioned to approve with 17% lot coverage, not 25% max. Glavach seconded the motion. THREE AYES...ONE NAY (Marks). MOTION CARRIES. NEW BUSINESS: A. Attorney clarified that the Commission can approve the findings with condition that staff and applicant meet to clarify verbiage. Deckers moved to approve with condition that staff and applicant present revised sound ordinance language to City Council. Lien seconded. INACTIVE — Refers to those projects wherein COMPASS, ACHD and or ITD has NOT committed or initiated the spending of funds 1. Improve Floating Feather Road east of Eagle Road to Edgewood Lane (needs utilities installed first), with two traffic lanes, a center tum lane, and meandering detached sidewalk where possible (as addressed in the 5-year work plan). 2. Accelerate the development of the extension of Highway 55 across the east end of Eagle Island to Chinden Boulevard generally as shown on the City of Eagle Transportation/Pathway Network Map #1 and within the 2025 Ada County Long Range Highway and Street Map. 3. Extend State Highway 16 south to Chinden Boulevard and eventually to I-84. 4. Construct vertical curb, gutter, a minimum five-foot (5') wide concrete sidewalk (separated from the Page 1 of 3 K\Planning Dept\TIP\TIP 2004 (for tip2006-2010) pz action.doe back of curb) and a bike lane along both sides of Eagle Road from Floating Feather Road to Beacon Light Road (subsequent to the installation of utilities), pursuant to Section 8.6 (0) of the City of Eagle 2000 Comprehensive Plan. The roadway should be a maximum of two lanes with a center turn lane only at driveways and/or street intersections that are expected to generate a minimum of 1000 vehicle trips per day, or where determined to be necessary for safety by ACHD. Any portion of a center tum lane which is not used for such a driveway or intersection should be landscaped. 5. Support the construction of Plaza Drive southward across State Highway 44 and connecting to Riverside Drive (generally in the north/south alignment with Palmetto Avenue) as a signalized intersection. Note: The City recognizes that this item is not a project per se; rather it is an access permitting exercise. Upon the approval of any access permit at this location, the City would like the intersection to be considered for project funding status. 6. The Ballantyne Road/State Highway 44/State Street intersections should be reconstructed as shown on the Transportation/Pathway Network Map #1 within the City of Eagle 2000 Comprehensive Plan and all other realignment options shall be discouraged. 7. Construction of the extension of Hill Road between Horseshoe Bend Road and E. State Street, as shown on the Transportation/Pathway Network Map #1 within the City of Eagle 2000 Comprehensive Plan, should be coordinated with development applications adjacent to the proposed roadway. With this construction, the installation of a center tree strip on Hill Road between SH 55 and State Street should be accommodated. The developer constructing the new section of Hill Road between Edgewood Lane and State Street will construct and landscape the center tree strip in that new location. For that portion of Hill Road abutting the proposed park, landscaped medians should be designed with crosswalks and areas to provide for the safe passage of pedestrians crossing Hill Road. 8. Install a traffic signal at the intersection of Hill Road and State Highway 55. 9. Construct a Park and Ride parking lot on the northwest corner of the intersection of Hill Road and State Highway 55. 10. Construct deceleration lanes on both the northbound and southbound of SH 55 for right hand turns both eastbound and westbound on Hill Road (priority should be on the southbound leg). 11. Acquire the right-of-way for a future connection on the north side of Chinden Boulevard in alignment with Discovery Way. 12. Construct a signalized intersection in alignment with the proposed Eagle Island State Park access on the south side of State Highway 44 (located approximately 2000-feet east of Park Lane), and to include a bridge crossing over the North Channel of the Boise River. Note: The City recognizes that this item is not a project per se; rather it is an access permitting exercise. Construct Chinden Boulevard as a minimum four -lane roadway from Eagle Road west into Canyon County. 14. Extend Aikens Street east to Second Street from its current terminus to Second Street, as shown on the Transportation/Pathway Network Map #2 of 2 within the City of Eagle 2000 Comprehensive Plan. 16. Acquire the appropriate amount of right-of-way and extend Idaho Street east from its current terminus to Stierman Way, as generally depicted on the Transportation/Pathway Network Map #2 of 2 within the City of Eagle 2000 Comprehensive Plan. 17. Encourage corridor studies of State Highway 44 and 20/26 west of Eagle Road with regard to turning movement improvements and traffic movement efficiency. COMPREHENSIVE PLAN PROVISIONS, WHICH ARE OF SPECIAL CONCERN REGARDING THIS PROPOSAL: Chapter 1 — Overview 1.3 The City of eagle Vision Statement a. known as a highly livable town that successfully balances many of the rural elements of its heritage with growth; B. ZONING ORDINANCE PROVISIONS, WHICH ARE OF SPECIAL CONCERN REGARDING THIS PROPOSAL: • ECC Section 8-1-2 LIVE ENTERTAINMENT EVENTS: Temporary concerts and other cultural events lasting less than seven (7) days or ongoing occasional events such as barn dances, square dances, weddings and receptions; temporary events such as corn mazes, hayrides, retail pumpkin patches and petting zoos lasting less than forty-five (45) days per calendar year. • ECC Section 8-2-3 states that a live entertainment event requires the approval of a conditional use permit within the A (Agricultural) zoning district. • ECC Section 8-7-3-5 (F) A conditional use permit shall not be considered as establishing a binding precedent to grant other conditional use permits. C. DISCUSSION: The Wagner Farms Fall Festival is an annual event that has grown in popularity over the recent years and with that growth, the festival has evolved from a corn maze to an event that includes more outdoor entertainment such hay rides, pumpkin patches, and various vendors selling food and beverages. Along with these activities, concerns have arisen with regard to increases in light glare, noise, and traffic. During a public meeting regarding the 2003 Wagner Festival, the Council endorsed the operation of the event with certain conditions that the applicant was to adhere to. During the 2003 event, it appeared that the implementation of the conditions were successful in mitigating the concerns of Page 6 of 10 KAPlanomg DeptEaBk Application Cth2004'CU-O8-04 stf doc nearby residents and businesses. STAFF RECOMMENDATION: Based upon the information provided to staff to date, staff recommends approval of the conditional use permit with the site specific conditions of approval and the standard conditions of approval provided below. SITE SPECIFIC CONDITIONS OF APPROVAL: 1. The site plan date stamped by the City on September 1, 2004, is the approved event layout plan. 2. This conditional use permit shall expire after the conclusion of the event in October of 2008. The applicant will need to apply for a new conditional use permit at that time for the continuation of the fall festival beyond 2008. The City will administratively review this conditional use permit on an annual basis. Prior to July 15 of each year in which the event is to be held, the applicant shall submit a site plan showing the locations of each activity (corn maze, hayride, parking etc.) and a letter from the Ada County Sheriff's Department acknowledging any complaints that may have been received by the Department from the previous year's event and the actions necessary to remedy any potentially objectionable activities. The administrative review will, in part, determine the action, if any, that shall be undertaken by the applicant to remedy any outstanding concerns that may have arisen during the previous year's event. 3. The use of helicopter aircraft is prohibited. 4. Operation of the event shall be limited to the hours between 10 a.m. and 10 p.m. The event may be held seven (7) days a week and no longer than forty-five (45) days from the first day of operation. 5. The sale and consumption of alcoholic beverages (if any) shall be allowed only through the City Council approval of an Open Container Permit. Adherence to all conditions of the Ada County Sheriff's Department is required. 6. All vendor permits shall be maintained in good standing with the city. 7. All site lighting is to be shielded to direct all light downward and not project horizontally onto any public right of way, private street, or onto the property line of any residentially zoned parcel of land or parcel of land used for residential purposes. 8. Comply with all requirements of the Ada County Highway District. The applicant shall use the traffic control measures employed in 2003 as approved by the ACHD (signs directing traffic to enter via Mace Road and exit via West Island Woods Drive). 9. The site shall remain free of litter and other debris. All large trash receptacles shall be screened from direct view of the adjacent properties. 10. No signs are proposed with this application and none are approved. 11. A water truck shall be maintained on site as a means to diminish the potential of airborne dust generated from vehicle traffic using the parking lot and driveway accesses. 12. Construct a minimum 9-foot high large straw bale wall around the area labeled "courtyard" on the approved site plan. The applicant shall comply with all requirements of the Ada County Highway District and/or the Idaho Transportation Department, including but not limited to approval of the drainage system, curbs, gutters, streets and sidewalks. A letter of approval from the highway district having jurisdiction shall be submitted to the City prior to issuance of any building permits. 2. Department of Environmental Quality approval of the sewer and water facilities is required prior to the issuance of any building permits. 3. All permits from Central District Health, Eagle Sewer District & Eagle Fire District shall be secured prior to issuance of building permits. 4. Written approval of all well water for any shared or commercial well shall be obtained from the Idaho Department of Water Resources shall be submitted to the City prior to issuance of any building permits. 5. Unless septic tanks are permitted, wet line sewers will be required and the applicant will be required to furnish the City Engineer with a letter from the sewer entity serving the property, accepting the project for service, prior to issuance of any building permits. 6. The applicant shall submit a letter from the appropriate drainage entity approving the drainage system and/or accepting said drainage; or submit a letter from a registered professional engineer certifying that all drainage shall be retained on -site prior to issuance of any building permits. A copy of the construction drawing(s) shall be submitted with the letter. 7. The applicant shall submit plans and calculations prepared by a registered professional engineer to handle the satisfactory disposal of all storm drainage on the applicant's site. Drainage system plans shall be submitted to the City Engineer for review and approval prior to issuance of any building permits. The plans shall show how swales, or drain piping, will be developed in the drainage easements. The approved drainage system shall be constructed, or a performance bond shall be submitted to the City Clerk, prior to issuance of any building permits or Certificate of Occupancy, whichever occurs first. The lot shall be so graded that all runoff runs either over the curb, or to the drainage easement, and no runoff shall cross any lot line onto another lot except within a drainage easement. All design and calculations shall meet the requirements of Ada County Highway District. Construction of the storm drain disposal system shall be complete before an occupancy permit is issued. 8. No ditch, pipe or other structure or canal, for irrigation water or irrigation waste water owned by an organized irrigation district, canal company, ditch association, or other irrigation entity, shall be obstructed, routed, covered or changed in any way unless such obstruction, rerouting, covering or changing has first been approved in writing by the entity. A Registered Engineer shall certify that any ditch rerouting, piping, covering or otherwise changing the existing irrigation or waste ditch (1) has been made in such a manner that the flow of water will not be impeded or increased beyond carrying capacity of the downstream ditch; (2) will not otherwise injure any person or persons using or interested in such ditch or their property; and (3) satisfied the Idaho Standards for Page 8 of 10 K:V kuming Dept\Eagle Applications CU\2004'CU-08-04 sttdoc Public Works Construction. A copy of such written approval and certification shall be filed with the construction drawing and submitted to the City prior to issuance of any building permits. 9. Street light plans shall be submitted and approved as to the location, height and wattage to the City Engineer (if applicable) prior to issuance of any building permits or Certificate of Occupancy, whichever occurs first. All construction shall comply with the City's specifications and standards. The applicant shall provide a recorded easement, acceptable to the City Engineer, for the purpose of installing and maintaining street light fixtures, conduit and wiring lying outside any dedicated public right-of-way, prior to issuance of any building permits. The applicant shall pay applicable street light inspection fees prior to Certificate of Occupancy. 10. Parking lot light plan shall be submitted and approved as to the location, height and wattage by the City Engineer. All construction shall comply with the City's specifications and standards. Lighting is required in the parking area and shall be properly illuminated to avoid accidents. Any lights used to illuminate the parking lot shall be so arranged as to reflect the light away from the adjoining property. 11. The parking area shall be paved and shall be maintained in good condition without holes and free of all dust, trash, weeds and other debris. 12. One set of building plans, for any non single-family residential use, shall be submitted to the Eagle Fire Department for approval. An approval letter from the Eagle Fire Department shall be submitted to the City prior to issuance of any building permits. The letter shall include the following comments and minimum requirements, and any other items of concern as may be determined by the Eagle Fire Department officials: a. "The applicant has made arrangements to comply with all requirements of the Fire Department." b. The fire hydrant locations shall be reviewed and be approved in writing by the Eagle Fire Department prior to the City Engineer signing the final plat. c. Minimum flow per hydrant shall be 1,000 gallons per minute for one and two family dwellings, 1,500 gallons per minute for dwellings having a fire area in excess of 3,600 square feet, and 1,500 gallons per minute for non-residential uses (i.e.; Commercial, Industrial, Schools, etc.). Flow rates shall inspected in accordance with all agencies having jurisdiction, and shall be verified in writing by the Eagle Fire Department prior to issuance of any building permits or certificate of Occupancy, whichever occurs first. d. The proposed fire protection system shall be reviewed and approved by the Eagle Fire Department prior to the issuance of a building permit. 13. Any recreation area, greenbelt area or pathway area along the Boise River, Dry Creek or any other area designated by the City Council or Eagle City Pathway/Greenbelt Committee for a path or walkway shall be approved in writing by the Eagle City Pathway/Greenbelt Committee prior to the issuance of a building permit. 14. Conservation, recreation and river access easements (if applicable) shall be approved by the Eagle City Pathway/Greenbelt Committee and shall be shown on the final plat prior to the issuance of a building permit. The applicant shall comply with the provisions of the Eagle City Code, pertaining to floodplain and river protection regulations (if applicable) prior to the issuance of a building permit. 16. The applicant shall obtain written approval of the development relative to the effects of the Boise River Flood Plain (if applicable) from the Corps of Engineers prior to the issuance of a building permit. 17. The applicant shall obtain approval of the development relative to its effects on wetlands or other natural waterways (if applicable) from the Corps of Engineers and the Idaho Department of Water Resources and/or any other agency having jurisdiction prior to the issuance of a building permit. 18. Basements in the flood plain are prohibited. 19. The Americans with Disabilities Act, Uniform Building Code, Eagle City Code, and all applicable County, State and Federal Codes and Regulations shall be complied with. All design and construction shall be in accordance with all applicable City of Eagle Codes unless specifically approved by the Commission and/or Council. 20. New plans, which incorporate any required changes, shall be submitted for staff approval. Staff may elect to take those plans to the Design Review Board and/or the Planning and Zoning Commission for review and approval. 21. Any changes to the plans and specifications upon which this approval is based, other than those required by the above conditions, will require submittal of an application for modification and approval of that application prior to commencing any change. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest submits application to the City of Eagle for a change to the planned use of the subject property. 22. Approval of any Design Review shall expire without notice to the applicant on the date of expiration of the Design Review, as stipulated in Eagle City Code (one year from the Planning and Zoning Commission approval date). 23. The City's action on the application does not grant the applicant any appropriation of water or interference with existing water rights. The regulation of building lot coverage is a planning tool used to regulate the intensity of the use of a parcel as well as to promote a certain character of the area or district in which the parcel is located. In a review of building permits recently issued for dwelling units located on lots within the R-E zoning district, staff submits the following for your consideration: • Nine (9) permits were issued with building footprints (house and garage ground floors) ranging in size from 2,617-square feet to 6,380-square feet for an average 4,618-square foot footprint. • The amount of lot coverage ranged from 3% to 7.5% for an average of 5.5% in lot coverage. Staff is not aware of an instance wherein building plans were submitted showing that the lot coverage was in excess of the 10% maximum allowed and thus prompting the denial of a building permit being issued; that is, there does not appear to be a high demand for any deviation from this particular lot area regulation. It would seem unnecessary to amend a standard that is under utilized or has not been an issue of concern to date. A variance procedure is available to pursue relief for those that may encounter a hardship with regard to lot size, lot coverage, width, depth, and setbacks. This issue has also arisen with other area two -acre lot developers. When the two -acre lot development was occurring in Ada County, (i.e.: Canterbury) the County's maximum lot coverage was 20%. Even that is not sufficient. The homebuyers for two -acre lots are not interested in farming. These folks desire substantial size homes typically to include sizeable gazebos, covered patios and usually at least one detached structure. We have lost many sales due to this unnecessary constraint and ask you to support this requested change. DISCUSSION: The Wagner Farms Fall Festival is an annual event that has grown in popularity over the recent years and with that growth, the festival has evolved from a corn maze to an event that includes more outdoor entertainment such hay rides, pumpkin patches, and various vendors selling food and beverages. Along with these activities, concerns have arisen with regard to increases in light glare, noise, and traffic. During a public meeting regarding the 2003 Wagner Festival, the Council endorsed the operation of the event with certain conditions that the applicant was to adhere to. During the 2003 event, it appeared that the implementation of the conditions were successful in mitigating the concerns of nearby residents and businesses. STAFF RECOMMENDATION PROVIDED WITHIN THE STAFF REPORT: Based upon the information provided to staff to date, staff recommends approval of the conditional use permit with the site specific conditions of approval and the standard conditions of approval provided within the staff report. PUBLIC HEARING OF THE COMMISSION: A. A public hearing on the application was held before the Planning and Zoning Commission on September 20, 2004, at which time testimony was taken and the public hearing was closed. The Commission made their recommendation at that time. B. Oral testimony in opposition to this proposal was presented to the Planning and Zoning Commission by (will be written to reflect testimony) C. Oral testimony in favor of this proposal was presented to the Planning and Zoning Commission by individual (other than the applicant/representative) (will be written to reflect testimony) COMMISSION DECISION: The Commission voted to recommend (will be written to reflect decision) SITE SPECIFIC CONDITIONS OF APPROVAL: 1. The site plan date stamped by the City on September 1, 2004, is the approved event layout plan. 2. This conditional use permit shall expire after the conclusion of the event in October of 2008. The applicant will need to apply for a new conditional use permit at that time for the continuation of the fall festival beyond 2008. The City will administratively review this conditional use permit on an annual basis. Prior to July 15 of each year in which the event is to be held, the applicant shall submit a site plan showing the locations of each activity (corn maze, hayride, parking etc.) and a letter from the Ada County Sheriff's Department acknowledging any complaints that may have been received by the Department from the previous year's event and the actions necessary to remedy any potentially objectionable activities. The administrative review will, in part, determine the action, if any, that shall be undertaken by the applicant to remedy any outstanding concerns that may have arisen during the previous year' s event. 3. The use of helicopter aircraft is prohibited. 4. Operation of the event shall be limited to the hours between 10 a.m. and 10 p.m. The event may be Page 6 of 13 K:\Planning Dept\Eagle Applications\CU\2004\CU-08-04 pzf.doc held seven (7) days a week and no longer than forty-five (45) days from the first day of operation. 5. The sale and consumption of alcoholic beverages (if any) shall be allowed only through the City Council approval of an Open Container Permit. Adherence to all conditions of the Ada County Sheriff s Department is required. 6. All vendor permits shall be maintained in good standing with the city. 7. All site lighting is to be shielded to direct all light downward and not project horizontally onto any public right of way, private street, or onto the property line of any residentially zoned parcel of land or parcel of land used for residential purposes. 8. Comply with all requirements of the Ada County Highway District. The applicant shall use the traffic control measures employed in 2003 as approved by the ACID (signs directing traffic to enter via Mace Road and exit via West Island Woods Drive). 9. The site shall remain free of litter and other debris. All large trash receptacles shall be screened from direct view of the adjacent properties. 10. No signs are proposed with this application and none are approved. 11. A water truck shall be maintained on site as a means to diminish the potential of airbome dust generated from vehicle traffic using the parking lot and driveway accesses. 12. Construct a minimum 9-foot high large straw bale wall around the area labeled "courtyard" on the approved site plan. STANDARD CONDITIONS OF APPROVAL: 1. The applicant shall comply with all requirements of the Ada County Highway District and/or the Idaho Transportation Department, including but not limited to approval of the drainage system, curbs, gutters, streets and sidewalks. A letter of approval from the highway district having jurisdiction shall be submitted to the City prior to issuance of any building permits. 2. Department of Environmental Quality approval of the sewer and water facilities is required prior issuance of any building permits. 3. All permits from Central District Health, Eagle Sewer District & Eagle Fire District shall be secured prior to issuance of building permit. 4. Written approval of all well water for any shared or commercial well shall be obtained from the Idaho Department of Water Resources shall be submitted to the City prior to issuance of any building permits. 5. Unless septic tanks are permitted, wet line sewers will be required and the applicant will be required to furnish the City Engineer with a letter from the sewer entity serving the property, accepting the project for service, prior to issuance of any building permits. 6. The applicant shall submit a letter from the appropriate drainage entity approving the drainage system and/or accepting said drainage; or submit a letter from a registered professional engineer Page 7 of 13 K:\Planning Dept\Eagle Applications\CU\2004\CU-08-04 pzf.doc certifying that all drainage shall be retained on -site prior to issuance of any building permits or Certificate of Occupancy, whichever occurs first. A copy of the construction drawing(s) shall be submitted with the letter. 7. The applicant shall submit plans and calculations prepared by a registered professional engineer to handle the satisfactory disposal of all storm drainage on the applicant's site. Drainage system plans shall be submitted to the City Engineer for review and approval prior to issuance of any building permits. The plans shall show how swales, or drain piping, will be developed in the drainage easements. The approved drainage system shall be constructed, or a performance bond shall be submitted to the City Clerk, prior to issuance of any building permits. The lot shall be so graded that all runoff runs either over the curb, or to the drainage easement, and no runoff shall cross any lot line onto another lot except within a drainage easement. All design and calculations shall meet the requirements of Ada County Highway District. Construction of the storm drain disposal system shall be complete before an occupancy permit is issued. 8. No ditch, pipe or other structure or canal, for irrigation water or irrigation waste water owned by an organized irrigation district, canal company, ditch association, or other irrigation entity, shall be obstructed, routed, covered or changed in any way unless such obstruction, rerouting, covering or changing has first been approved in writing by the entity. A Registered Engineer shall certify that any ditch rerouting, piping, covering or otherwise changing the existing irrigation or waste ditch (1) has been made in such a manner that the flow of water will not be impeded or increased beyond carrying capacity of the downstream ditch; (2) will not otherwise injure any person or persons using or interested in such ditch or their property; and (3) satisfied the Idaho Standards for Public Works Construction. A copy of such written approval and certification shall be filed with the construction drawing and submitted to the City prior to issuance of any building permits. 9. Street light plans shall be submitted and approved as to the location, height and wattage to the City Engineer (if applicable) prior to issuance of any building permits or Certificate of Occupancy, whichever occurs first. All construction shall comply with the City's specifications and standards. The applicant shall provide a recorded easement, acceptable to the City Engineer, for the purpose of installing and maintaining street light fixtures, conduit and wiring lying outside any dedicated public right-of-way, prior to issuance of any building permits. The applicant shall pay applicable street light inspection fees prior to Certificate of Occupancy. 10. Parking lot light plan shall be submitted and approved as to the location, height and wattage by the City Engineer. All construction shall comply with the City's specifications and standards. Lighting is required in the parking area and shall be properly illuminated to avoid accidents. Any lights used to illuminate the parking lot shall be so arranged as to reflect the light away from the adjoining property. 11. The parking area shall be paved and shall be maintained in good condition without holes and free of all dust, trash, weeds and other debris. One set of building plans, for any non single-family residential use, shall be submitted to the Eagle Fire Department for approval. An approval letter from the Eagle Fire Department shall be submitted to the City prior to issuance of any building permits or Certificate of Occupancy, whichever occurs first. The letter shall include the following comments and minimum requirements, and any other items of concern as may be determined by the Eagle Fire Department officials: a. "The applicant has made arrangements to comply with all requirements of the Fire Department." b. The fire hydrant locations shall be reviewed and be approved in writing by the Eagle Fire Department prior to the City Engineer signing the final plat. c. Minimum flow per hydrant shall be 1,000 gallons per minute for one and two family dwellings, 1,500 gallons per minute for dwellings having a fire area in excess of 3,600 square feet, and 1,500 gallons per minute for non-residential uses (i.e.; Commercial, Industrial, Schools, etc.). Flow rates shall inspected in accordance with all agencies having jurisdiction, and shall be verified in writing by the Eagle Fire Department prior to issuance of any building permits or certificate of Occupancy, whichever occurs first. d. The proposed fire protection system shall be reviewed and approved by the Eagle Fire Department prior to issuance of a building permit. 13. Any recreation area, greenbelt area or pathway area along the Boise River, Dry Creek or any other area designated by the City Council or Eagle City Pathway/Greenbelt Committee for a path or walkway shall be approved in writing by the Eagle City Pathway/Greenbelt Committee prior to issuance of a building permit. 14. Conservation, recreation and river access easements (if applicable) shall be approved by the Eagle City Pathway/Greenbelt Committee and shall be shown on the final plat prior to issuance of a building permit. 15. The applicant shall comply with the provisions of the Eagle City Code, pertaining to floodplain and river protection regulations (if applicable) prior to issuance of a building permit. 16. The applicant shall obtain written approval of the development relative to the effects of the Boise River Flood Plain (if applicable) from the Corps of Engineers prior to issuance of a building permit. 17. The applicant shall obtain approval of the development relative to its effects on wetlands or other natural waterways (if applicable) from the Corps of Engineers and the Idaho Department of Water Resources and/or any other agency having jurisdiction prior to issuance of a building permit. 18. Basements in the flood plain are prohibited. 19. The Americans with Disabilities Act, Uniform Building Code, Eagle City Code, and all applicable County, State and Federal Codes and Regulations shall be complied with. All design and construction shall be in accordance with all applicable City of Eagle Codes unless specifically approved by the Commission and/or Council. 20. New plans, which incorporate any required changes, shall be submitted for staff approval. Staff may elect to take those plans to the Design Review Board and/or the Planning and Zoning Commission for review and approval. Any changes to the plans and specifications upon which this approval is based, other than those required by the above conditions, will require submittal of an application for modification and approval of that application prior to commencing any change. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest submits application to the City of Eagle for a change to the planned use of the subject property. 22. Approval of any Design Review shall expire without notice to the applicant on the date of expiration of the Design Review, as stipulated in Eagle City Code (one year from the City Council approval date). 23. The City's actions on the application does not grant the applicant any appropriation of water or interference with existing water rights. The applicant indemnifies and holds the City harmless for any and all water rights, claims in any way associated with this application. CONCLUSIONS OF LAW: 1. The application for this item was received by the City of Eagle on September 1, 2004. 2. Notice of Public Hearing on the application for the Eagle Planning and Zoning Commission was published in accordance for requirements of Title 67, Chapter 65, Idaho Code and the Eagle City ordinances on September 6, 2004. Notice of this public hearing was mailed to property owners within three -hundred feet (300-feet) of the subject property in accordance with the requirements of Title 67, Chapter 65, Idaho Code and Eagle City Code on September 2, 2004. Requests for agencies' reviews were transmitted on September 2, 2004, in accordance with the requirements of the Eagle City Code. 3. The Commission reviewed the particular facts and circumstances of this proposed conditional use permit application (CU-8-04) with regard to Eagle City Code Section 8-7-5 "Action by the Commission and Council", and based upon the information provided concludes that the proposed conditional use permit is in accordance with the Eagle City Code because: The proposed conditional use; A. Will, in fact, constitute a conditional use as established in Section 8-2-3 of Eagle City Code Title 8 since a Live Entertainment Event (corn maze) may be permitted in the A (Agricultural) zoning district if a conditional use permit is approved by the City Council; B. Will be harmonious with and in accordance with the general objectives or with any specific objective of the Comprehensive Plan and/or this title (Eagle City Code Title 8) since the Comprehensive Plan encourages those elements that promote a rural feel in the midst of an urbanized setting and, is consistent with Title 8 (Zoning) since a Live Entertainment Event (corn maze) is permitted within the A (Agricultural) zoning district; C. Will be served adequately by essential public facilities that are currently available to the site such as highways, streets, police and fire protection, sanitary and refuse disposal, or as conditioned herein; F. Will not create excessive additional requirements at public cost for public facilities and services and will not be detrimental to the economic welfare of the community since the event is temporary and does not require permanent facilities to be constructed; G. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property or the general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors since the Live Entertainment Event (corn maze) is conditioned herein to direct all lighting away from the adjacent properties, to control dust with watering trucks, and to monitor and direct traffic in a controlled manner; H. Will have vehicular approaches to the property which are designed as not to create an interference with traffic on surrounding public thoroughfares as the site will be accessed via a public roadway and entry and exit to the site is to function as a one- way configuration; and Will not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance since the activities are occurring in an area away from the Boise River to lessen impacts on that area and, upon land that is currently being farmed wherein no natural, scenic or historic features are known to exist. 4. Pursuant to Eagle City Code 8-7-3-5 (F), a conditional use permit shall not be considered as establishing a binding precedent to grant other conditional use permits. And of course the crowning glory, The Great Pumpking Cannon Shoot Out. This was awesome. To see pumpkins shot from a few feet to over 3,000 feet was a fete in its self. That there has been some discussion about closing some or part of his operation. WE are writing in favor of his operation and our reasons are as follows: 1. WE at the N. Channel Business Center "Business's " mostly due to location are not involved, promoted, attractive enough to all the community functions that the down town core is involved in, like the Easter Hunt, Eagle Fun days, Parade, Rodeo, Carnival, Booths, Fireman's Nut Feed, music concerts or even the Country Christmas. The best this complex can do is advertise and donate to some of these functions because technically were on the South side of the Bypass which makes us technically "out of the loop" for these functions and we receive little draw or interest from the participants. 2. The Fall functions on the other hand ARE on our side of town and WE benefit as business's, as well as provide information & directions to participants for both Wagner's Pumpkin Patch and the Fireman's Halloween Forest. WE provide Directions, coupons, drawings, advertising and points of interest to these and other traditional activities that go on during the fall. None of these business's including the Wagner's "Get Rich" off of the Pumpkin Patch function but it does provide many opportunities for these business in the N. Channel Business center to participate in and draw in NEW customers & collaborate with the neighboring business's in the complex and community. 9/10/03 rage 2orl r ,3. WE have a Convenience store, coffee shop, a Restaurant, a bank and most recently added an ice cream shop and a sandwich shop. These business's also provide shelter from the weather, a place for groups to meet, a place for parents to wait for their kids or even do errands and WE as a whole complex benefit During these times and activities. 4. In this growing economy there are diminishing community functions that are multi -age appropriate and attractive to both boys & girls of all ages. These functions are affordable and provide outdoor, interaction with people and nature as well. We understand there is some concern with the helicopter. Is'nt this the SAME company that the City of Eagle and the Fireman use for their functions? There is NO noise concerns when the City uses the helicopter services in the same area? The Helicopter ride•provides beautiful scenery and gives a short geography of the neighboring lands and rivers. It's an activity for families as well as special activities for couples of all ages. Although the noise factor maybe an issue for some, it's a TEMPORARY nuisance,as in 30 days and a small issue against all the other GREAT qualities Wagner's provide at their function. Why would the helicopter noise be any different from someone mowing the yard, a combine harvesting crop, crop duster or loud construction vehicles? Like it or not, These are TEMPORARY inconveniences of progress. Wagner's have incorporated their function including the helicopter long before MOST of the residents moved to THAT area. Wagner's Pumpkin Patch & Functions should not be limited, removed or refused to this community. Our children are now 10 ,12 , and 15 years old . We have always been able to drop them off at the corn maze and know they are completely safe . They are charter members . It has come to my attention that developers in the area are upset about the spectacle and traffic caused in and around the area of the Pumpkin Fest. As a developer myself, and native of the area, I strive in all endeavors to maintain as much of the local culture, heritage, and ambiance as possible. After all, it is exactly these factors that make Boise, Eagle, and all surrounding areas attractive to prospective businesses and residents. I commend the Eagle City Council and planning representatives on a job well done thus far. However, the fact that the City Council is considering closure of the Pumpkin Fest in order to further the goals of a local developer is appalling to me. It is not the responsibility of the community to blend with the development; rather it is the developer's responsibility to blend with the community. The Pumpkin Fest is a local celebration of fall, Halloween, and the lifestyle so valued by the citizens of Eagle and Ada County. As such, as with all public gathering and events, there is bound to be some minor disturbances due to traffic, noise, lights, and parking. However, I hardly feel the disturbances caused by the Pumpkin Fest warrant interrupting or canceling the event. My children look forward each year to the variety of entertainment provided by Wagner Farms at the Pumpkin Fest. From hay rides to helicopter rides the event is well planned, well managed, and well received. Nowhere in this area is there a fall celebration that offers families more, for less, than the Pumpkin Fest. Minor inconveniences for a month each year are well worth the value added to the community and the families within the community. Let me offer my whole -hearted support to Wagner Farms and the Wagner family trying to maintain a festival welcomed each year by families throughout the area. Perhaps developers in the area are due a message, that the community values its sense of rural beginnings and rural flavor. Rod Wagner has leased parts of our farm since 1987. I have seem tremendous changes in this area. These changes have brought many more people and much more traffic. Both farming practices and farming as a way of life have changed as well. What had been a very good and satisfying way of life has become a struggle for most farmers. Despite the many obstacles, Mr. Wagner has been a good custodian of this land. He has always taken the initiative in meeting and overcoming the various challenges that have confronted him. One particularly creative approach to marketing the corn growing in these fields has been the Corn Maize, which he has been creating here since 1999. While the Corn Maize generates additional traffic for approximately one month each Fall, it is far less annoying and troublesome than the traffic and congestion created by the invasion of the subdivisions. The same people who have completely changed the character of this land and my way of life are now the ones complaining about Mr. Wagner's corn field. These people should have recognized the annual Corn Maize as something that would be a part of life in living here. This is not a new event. It seems very unfair for people to move to an area and pull the rug out from under a hard working farmer who has been trying to make a living from this land for the past 16 years. I do not understand laws that would deny Mr. Wagner the results of his work on this land last Fall, this Spring, and this Summer. Rod Wagner has leased parts of our farm since 1987. I have seem tremendous changes in this area. These changes have brought many more people and much more traffic. Both farming practices and farming as a way. of life have changed as well. What had been a very good and satisfying way of life has become a struggle for most farmers. Despite the many obstacles, Mr. Wagner has been a good custodian of this land. He has always taken the initiative in meeting and overcoming the various challenges that have confronted him. One particularly creative approach to marketing the corn growing in these fields has been the Corn Maize, which he has been creating here since 1999. While the Corn Maize generates additional traffic for approximately one month each Fall, it is far less annoying and troublesome than the traffic and congestion created by the invasion of the subdivisions. The same people who have completely changed the character of this land and my way of life are now the ones complaining about Mr. Wagner's corn field. These people should have recognized the annual Corn Maize as something that would be a part of life in living here. This is not a new event. It seems very unfair for people to move to an area and pull the rug out from under a hard working farmer who has been trying to make a living from this land for the past 16 years. I do not understand laws that would deny Mr. Wagner the results of his work on this land last Fall, this Spring, and this Summer. However, I do want to go on record as supporting and endorsing Mr. Wagner's Corn Maize and the obvious enjoyment and delight it provides for the families and young people who go through it. This is ALWAYS the favorite field trip of the students. The Wagner crew has always had the trip well planed and well organized, making sure there is educational content. We would miss this opportunity if the Council were to revoke the privilege. As a parent, I can tell you we have spent many days and nights visiting the maze. The entire festival is a wonderful experience for kids of all ages and adults. The maze itself is fun, different and challenging. The festivals, food, music, pumpkins, games, slide, hayrack rides, party picnic area, and staff have brought back some small town appeal as Eagle is bursting at the seams. I grew up in Eagle and I am reminded of our Fourth of July "town" celebrations when I visit the maze. We only have this Fall Festival for 6 weeks but remember the fun for the entire year! I have to confess that I am indirectly involved with the maze as Rod Wagner is my brother. I have watched the maze grow from a teen hangout to a family fun filled adventure. We NEED this, our community needs this, our children love this experience. I do not profit from the maze, this is not my motivation. Please do not allow this to be taken away. Debi Wagner and Nikki Clampett run a smooth, clean and extremely organized event. The maze was at this site before the development that neighbors the property. The maze has employed many teens that live in the development. Debi has made changes and improvements each year to accommodate the surrounding property. If the Council needs proof, then the council should visit this year's event so a judgment can be made. The Council will not be disappointed. There has always been great participation and enjoyment for schools, nursing homes, mental and physical handicapped organizations, young and old. To be able to watch these participants pick out a pumpkin the size of which some can't even lift. To realize that some people do not even know what a corn stalk looks like let a lone where that piece of corn that they eat originates. To watch the people get their faces painted, to bite into a crisp carmel apple, to breath in the essence of fall. It would be drastic for this event not to occur. Families, schools, institutions all look forward to this event each year. For some to go on a helicopter ride — for a minimum charge what an experience. The Pumpkin Shoot is a marvel to watch because of the engineering technology and work that the participants put into their machines each year. This event is not only educational for most, but a joy; and in some cases, the only event that some can attend in a year. When the land located on Mace Road was annexed into the City of Eagle, the property owners were assured at public meetings that our agricultural lifestyle would remain unchanged. Then when Dennis Baker asked for property owner's support of his Two Rivers subdivision project, we were once again reassured that our agricultural lifestyles would be respected and remain unchanged, This has been far from the truth. My water assessment has tripled in 5 years due to legal issues with Dennis Baker. There have been complaints from the subdivision about hay trucks going back and forth from the hay fields located at the end of Mace Road and now this barrage against Wagner Farms Cons Maze. Corn Mazes are not only a way for farmers to support their families; they offer activities that share the agricultural spirit upon which Eagle was founded with community members not involved in agriculture. These activities range from hay rides, viewing farm animals, straw piles, maze runs, and helicopter rides that offer bird's eye views of agricultural activities. After being involved in education for 20 years, I can assure you that these kinds of activities are great for kids of all ages. Every community could benefit from more of these types of wholesome activities. Why then would any new property owner in the Two Rivers subdivision be upset with the Com Maze activities? It may be due to Dennis Baker inadvertently failing to disclose his prior promise and commitment to local families to retain their agricultural heritage when he built his subdivision and not due to any wrongdoing on Wagner Farm's part. The efforts that go into making this place a creative learning environment for children and families are based in the wholesome backbone of our nation, the farmers. How can you justify degrading the American Farmer? They have supported this country since the beginning. The children in our area do not get the experience that comes with working a farm. They do not get to ride tractors and pick vegetables. Things that happen on a family farm are back breaking, hard, and true work. With the creation of the Treasure Valley Pumpkin Festival, kids from all ages get to come and experience this fundamental part of our society. Classes from schools around the Treasure Valley come every year to learn about farming and why it is important. Kids learn what kind of foods come from farms and how they harvest those foods. They get the experience of picking their own pumpkins, coloring them, and taking them home. They have a large corn maze that families love to do together. It is a normal occurrence that the children are the ones to find their families way out of the maze. Adults get to have an exciting experience of watching the pumpkin launching that you have referenced. Safety is the biggest feature in this event. The launchers are aimed at the private -land that the Treasure Valley Pumpkin Festival sits on. There have been zero instances of one of these launchers even coming close to the Boise River, let alone crossing it. It is simply an erroneous allegation that the Treasure Valley Pumpkin Festival aimed at a building and shot it with a pumpkin. Keep in mind, it is a family oriented event first and foremost! That is not the kind of value that founded this festival. Any sort of mischief of this sort would be completely frowned upon and action 9/4/03 iagcvi�. would be taken. There has never been a need for action of this sort! Pumpkin launching happens across the US. The Guinness World Record is held back East. Adults from around the Treasure Valley have created launchers and entered the competition every year in hopes to beat the record. Again, safety first. In the evenings entertainment for families is provided. This comes in the form of LOCAL entertainment. Supporting local artists in this setting has become a wonderful affiliation. A great deal of the performers are children that have been blessed with a great talent that they seldom are able to show off. It is not understood to me how you can be so against something that is a quality family investment in this society. There are far too few things for children to do that is safe, educational and fun in the Treasure Valley area. It would be a grave adversity to stop something so wonderful from existing. If you had yourself, gone to one of these events, you would know that the quality of family life that is exhibited is immeasurable. I think you should make a point of attending this years event and asking the many families that attend their point of view. There are families that attend every year. They bring with them new families to share the excitement with. I own and operate a food concession at the Festival. Rod and Debbie have worked extremely hard to make this family oriented event both fun and educational. Debbie is a great advocate for agriculture. She and her crew spend many long hours preparing for the busloads of school children that visit the pumpkin farm. I am a native Idahoan, and my family has farmed in this valley for 3 generations. As I see the subdivisions slowly encroach upon our farmland. I feel there is now a greater need to educate our young people on the benefits of agriculture. On the weekends most of the patrons are young families, at night there are quite a few Middle School students, but again mainly with their families. We have never had any problems with rowdy kids, or drunken adults. The setting is not conducive to this type of activity. The entertainment, featuring local bands playing country and folk music again doesn't encourage bad behavior. There is a beer booth, however strict policies are in effect to monitor its operation. It is very disappointing when someone works as hard as the Wagners to be positive influence on their community, with a good wholesome family event, and they are met with such difficulty. I have been participating at the event the last two years as a concessionaire. Attendance continues to grow, despite the numerous other "festivals" cropping up in our valley. Wagners don't resort to the "terror" aspects as do others, but continue to spotlight the harvest. Mrs. Wagner and her well trained staff host and educate many classes from local schools on the many different facets of agricultural in our area. Perhaps your council should be contacting the local schools, which have participated in this worthwhile program. Its refreshing to see youngsters, who may never have had the opportunity to visit a farm, playing on a haystack, walking thru a straw maze or trudging along in a corn maze. Not to mention riding on a tractor pulled trailer to an actual pumpkin patch, picking a growing pumpkin, not selecting one from a cardboard box at a local supermarket! In my past experience, I have never encountered any disruptive behavior. All areas of the event are well supervised, with more staff at this one event, than most. Most attendees are families; entertainment and games are geared in that direction. The Wagners are to be commended for offering a wholesome family oriented event to our area. Events such as hayrides, a com maze, and a pumpkin shootout have made the event a great draw for people living in the BoIse/Meridian/Eagle area. With these types of activities the Festival is geared more toward the family, as well as catering to the adult population. For businesses within this area, the traffic created from the festival means an increase in business activity, which is paramount. As a sponsor of this event, Boise Weekly is concerned to hear that it may not be taking place this year for a number of reasons. We would be extremely saddened if the Treasure Valley Pumpkin Fest did not take place during the fall months of 2003. Boise Weekly supports Wagner Farris and their Treasure Valley Pumpkin Fest, and the family orientated event that they provide to the people of the Treasure Valley. I sincerely ask for your full re -consideration of this matter. The six Citadel radio stations have worked with the Wagner family for the past several years on varied projects, including the Treasure Valley Pumpkin Festival. We have found these people to be some of the best examples of true Idaho spirit, giving of themselves and their many talents freely for the good of others. I find some of the allegations of noisy misbehaviors at the Pumpkin Fest hard to envision. Our latest endeavor with Rod and Debi Wagner was the "Cover the Blue Turf' Food Drive held this summer at Boise State University in conjunction with KQFC radio. This record -breaking benefit for the Idaho Foodbank was recognized both locally and nationally. Much of the reason for the huge success of this event, which involved over 500 volunteers and took place on 24 hour -a -day scale, was because of Rod and Debi Wagner. Their experience, professionalism and knowledge gleaned from their Pumpkin Festival greatly added to the success of one of our biggest undertakings. The Idaho Foodbank has recently recognized them as "Volunteers Extraordinaire." As residents of Eagle, my family and I look forward to the Treasure Valley Pumpkin Festival every year and consider it one of the finest family events in the valley. It would be a great loss for Eagle and the entire valley to see this event constricted.
