The Planning and Zoning Commission met in regular session on Chairman Bandy
presiding.

Comprehensive Plan Amendment from Residential Four to Central
Business District and Rezone from R-4 to CBD-DA - G. Greeorv Hall:
G. Gregory Hall, represented by Land Consultants, Inc., is requesting a
Comprehensive Plan Amendment to change the land use designation on the
Comprehensive Plan Land Use Map from Residential Four (up to four
dwelling units per acre) to Central Business District, and a rezone from R-4
(Residential- up to four dwelling units per acre) to CBD-DA (Central
Business District with Development Agreement). The site is located on the
west side of North Eagle Road, approximately BOO-feet north of West State
Street, at 223 North Eagle Road.
E. Findines of Fact and Conclusions of law for CPA-2-03-
Comprehensive Plan Amendment from Residential One to Commercial
- Rick & Nits Musick: Rick & Nita Musick, represented by Land
Consultants, Inc., is requesting a Comprehensive Plan Amendment to
change the land use designation on the Comprehensive Plan Land Use Map
from Residential One (up to one dwelling unit per acre) to Commercial.
The site is located on the south side of West State Street approximately
400-feet east of Linder Road, at 4526 West Old Valley Road.
F. Findines of Fact and Conclusions of Law for CP A-3-03IRZ-8-03 -
Comprehensive Plan Amendment from Residential One to Commercial
and Mixed Use and Rezone from A-R to C-2-DA and MU-DA- Park
Hampton. LLc.: Park Hampton, LLC, represented by Land Consultants,
Inc., is requesting a Comprehensive Plan Amendment to change the land
use designation on the Comprehensive Plan Land Use Map from
Residential One (up to one dwelling unit per acre) to Commercial and
Mixed Use, and a rezone from A-R (Agricultural-Residential-up to one
dwelling unit per five acres) to C-2-DA (General Business District with
Development Agreement) and MU-DA (Mixed Use with Development

Agreement). The site (Lots 1 and 2, Block 1, & Lots 1,2,4,5,6,8, & 9,
Block 2, of Flint Estates Subdivision) is located on the northeast comer of
Park Lane and West State Street, at 3950, 3450 & 3300 West State Street,
3415,3855, and 3850 West Flint Drive, and 312 North Park Lane.
G. Findines of Fact and Conclusions of Law for FPUD-4-04 - Final
Development Plan for Windine Creek East PUD: Southers Properties,
represented by Phil Hull with The Land Group is requesting final
development plan approval for Winding Creek East, a 44-unit multi-family
residential PUD. The 3.9-acre site is located on the north side of State
Street approximately 100-feet east of Palmetto A venue.
Crook moves to approve the Consent Agenda as presented. Seconded by Glavach.
BANDY & DECKERS ABSTAIN. ALL A YE...MOTION CARRIES.

5. PUBLIC HEARINGS:
Bandy would like to act on item B & C.
Bandy notes that item 5B, A-4-04 & RZ-6-04 Annexation and Rezone City of Eagle,
the remaining property owner (Humphries property) has withdrawn their portion of the
application and thus no further action is needed.
City Staff, Jeff Lowe, provides additional clarification on item 5B.
5C: RZ-2-03 MOD - Rezone from RUT and A-R to MU-DA - Coast 2 Coast
LLC.: Coast 2 Coast LLc., represented by Land Consultants Inc., is requesting a rezone
from RUT (Rural Urban Transition - Ada County designation) and A-R (Agricultural-
Residential-up to one dwelling unit per five acres) to MU-DA (Mixed Use with
Development Agreement) and, a modification to the development agreement previously
approved by the City affecting 9.5-acres of the overall 117 -acre site. The site is located
on the east side of Eagle Road, at 2260 South Eagle Road.
Bandy introduces the item.
Mark Butler, 52 N. Second St. Eagle, Idaho representing Coast 2 Coast LLc. Butler
states they did not understand that the Commission wanted a revised concept plan.
Requests additional direction from the Commission. Discussion.
This item will remain on the agenda and be heard after item 5A
A. PPIFP-1-04 - Sydney and Reese Subdivision - Marearet Jones: Margaret Jones,
represented by George Transtrom with Heartland Construction, LLC, is requesting
combined preliminary plat and final plat approval for Sydney and Reese Subdivision, a
re-subdivision of Lot 17, Block 3, of Merrill Subdivision No.2. The 1.04-acre, 2-lot
commercial development is located south of East Plaza Drive, at 781 East Plaza Drive.
This item was continued from the July 6, 2004 meeting.

City Staff, Jeff Lowe, states that the applicant left a voice message earlier today
requesting this item be continued to the first meeting in September.
Bandy moves to continue this item to the September 7,2004 meeting. Seconded by
Deckers. ALL AYE.. .MOTION CARRIES.
B. A-4-04 & RZ-6-04 - Annexation and Rezone - City of Eaele: The City of Eagle,
represented by William E. Vaughan, AICP, is requesting approval of a City-initiated
annexation and rezone with development agreements for the properties generally
located on the southwest and northeast comers of State Highway 44 and Linder Road.
The multi-site rezones are proposed to be from RR (Rural Residential), RUT (Rural
Urban Transition), and R4 & R2 (Residential) to A-R (Agricultural Residential), R-2-
DA and R-3-DA (Residential with development agreement), C-I-DA (Neighborhood
Business District with development), and PS (Public/Semi-Public. This item was
continued from the August 2, 2004 meeting. Six of the development agreements
associated with this application were acted on at the August 2, 2004 meeting. The
applicant for the remaining development agreement (Humphries property) has
withdrawn their application. Thus no further action is needed on this item.

Crook provides some history on this application for the Commissioners who were not
present at the previous meetings where this item was heard. Lowe provides additional
background.
Mark Butler, 52 N. Second Street Eagle, Idaho, representing Coast 2 Coast LLC. Mr.
Butler suggests that the Commissioners who missed the August 2nd meeting obtain the
tape of the meeting and review it so that they have first hand knowledge of the
discussion and testimony that took place. Butler reviews the application in regards to
berming and landscape buffering, development access,
Glavach states that a Dave Monroe, with the State of Idaho Building Division, phoned
him to state that he has concerns with noise. Mr. Monroe lives in Island Woods.

Deckers moves to continue this application to the September 7th meeting. Asking
staff to add to this application that the elevation concept drawings for uses in the
southern portion shall be prepared prior to this application going to City Council.
The applicant should propose language to the CC&R's to enhance the noise
restriction in this area. The applicant show revised concept plans and landscape
plans for a 40' buffer to the south. Staff needs to work with the applicant to
further consider the set back from Eagle Road, how much is within the right-of-
way and how much is beyond the right-of-way. Modify the uses as stated this
evening. This should all be prepared for the September 7th meeting. Seconded by
Crook. Discussion. Deckers would like to retract his motion. Second concurs.
Deckers would like to discuss whether or not the applicants proposed uses are in
conflict with Lakemore's proposed uses. Discussion amongst the Commission.
Deckers makes the same motion he made earlier. Seconded by Crook. ALL
A YE...MOTION CARRIES.
D. RZ-8-04 - Rezone From A-R to PS - Ada County Hiehwav District: Ada County
Highway District, represented by Doherty & Associates, Inc., is requesting a rezone
from A-R (Agricultural-Residential) to PS (Public/Semi-Public) for the construction of
a park and ride lot. The AI-acre parcel is located on the south side of North Ballantyne
Road and north of the intersection of West Highway 44 and West State Street, at 1993
West State Street.
Bandy introduces the item.
Karen Doherty, 575 E. Park Center Blvd. Boise, Idaho representing Ada County
Highway District. Ms. Doherty presents the application.
City Staff, Jeff Lowe, presents the staff report.
Bandy opens the public hearing.
Jeff Madson, 466 N. Clearpoint Way Eagle, Idaho. Mr. Madson questions the future
alignment of Ballantyne. Also questions the benefit the City of Eagle would have from
this lot.
Joe Roseland, Assistant Traffic Engineer with Ada County Highway District, 3775
Adams Street Garden City, Idaho. Explains the future alignment of Ballantyne. Also
says the use would be a good car-pooling meeting place, and perhaps a van pool
location. Discusses other proposed locations in Eagle.
Bandy closes the public hearing.
