EAGLE PLANNING AND ZONING COMMISSION
Special Meeting Minutes
August 10, 2004
The Planning and Zoning Commission met in regular session on Vice-Chairman Crook
presiding.
1.
CALL TO ORDER: Called to order at 12:10 p.m.
2.
ROLL CALL: The following members were Present: LIEN - present via
speaker phone, CROOK, GLA V ACH. Absent: DECKERS, BANDY.A
quorum is present.

A.. CPA-2-03 - Comprehensive Plan Amendment from Residential One to
Commercial- Rick & Nita Musick: Rick & Nita Musick, represented by Land
Consultants, Inc., is requesting a Comprehensive Plan Amendment to change the land
use designation on the Comprehensive Plan Land Use Map from Residential One (up to
one dwelling unit per acre) to Commercial. The site is located on the south side of
West State Street approximately 400-feet east of Linder Road, at 4526 West Old Valley
Road. (This item was continued from the August 10,2004 meeting).
Crook introduces the item.
Mark Butler, 52 N. Second Street Eagle, Idaho. Butler notes that he spoke last night
regarding this application, but stands for any questions the Commission may have.
City Staff, Jeff Lowe, reviews the staff report.
Crook opens the public hearing.
No one chooses to speak.
Butler notes they would prefer commercial zoning, but if choose to deny the application
a recommendation of mixed use would be preferable.
Crook closes the public hearing.
Discussion amongst the Commission.
Crook moves to deny CPA-2-03 Comprehensive Plan Amendment from
Residential One to Commercial Rick & Nita Musick with the recommendation
that a mixed use designation would be more appropriate which was approved last
night. Seconded by Glavach. ALL A YE...MOTION CARRIES.
B. CPA-3-03/RZ-8-03 - Comprehensive Plan Amendment from Residential One
to Commercial and Mixed Use and Rezone from A-R to C-2-DA and MU-DA-
Park Hampton. LLC.: Park Hampton, LLC, represented by Land Consultants, Inc., is
requesting a Comprehensive Plan Amendment to change the land use designation on
the Comprehensive Plan Land Use Map from Residential One (up to one dwelling unit
per acre) to Commercial and Mixed Use, and a rezone from A-R (Agricultural-

Residential-up to one dwelling unit per five acres) to C-2-DA (General Business
District with Development Agreement) and MU-DA (Mixed Use with Development
Agreement). The site (Lots 1 and 2, Block 1, & Lots 1,2,4,5,6,8, & 9, Block 2, of
Flint Estates Subdivision) is located on the northeast comer of Park Lane and West
State Street, at 3950, 3450 & 3300 West State Street, 3415, 3855, and 3850 West Flint
Drive, and 312 North Park Lane. (This item was continued/rom the August 10,2004
meeting).

Butler presents the application.
City Staff, Jeff Lowe, presents the staff report. Bill Vaughan, Zoning Administrator,
provides additional information including a concept plan for a music academy on some
of the property in question today.
Lowe reads a letter into testimony submitted by residents on Flint Drive. See attached
letter.
Crook opens the hearing for public testimony.
John Wood, 3300 W. State Street Eagle, Idaho is the applicant. Mr. Wood describes his
interaction with some of the homeowners on Flint Drive and he expresses what he feels
is their land use desires. Presents a color copy of the concept plan for the music
academy for the Commission to review.
Tom Fister 3605 Flint Drive Eagle, Idaho. Mr. Fister rebuts testimony give my Mr.
Wood regarding eliminating the CC&R's for Flint Drive. Would rather not have high
density or multi-family units. Has concerns with the proposed music academy and the
impact on traffic and noise pollution. Reiterates the what was submitted in the letter
and those residents desire.
Foad Roghani, 175 S. Rosebud Lane Eagle, Idaho. Mr. Roghani owns the business
directly across Highway 44 from this application. Feels that a music academy would be
an asset to the community. In favor of mixed use at that location. And would also have
concerns with traffic flow and would hope that it would be appropriately addressed.
Tim Cenell1601 Floating Feather Road Eagle, Idaho. Is who is trying to get the music
school up and going in Eagle. Feels the school will be good for the community, and
explains a bit more about the vision for the school.
Vaughan notes that the concept plan for the music academy is not an item to be acted
on today, it was merely presented to provide additional information to the commission.
Butler requests zoning clarification on lots in question for this application.

City Staff, Vaughan addresses the Commission regarding staff's recommendations.
City Staff, Nichoel Baird-Spencer, provides clarification on the comprehensive plan
amendment that was approved last night in relation to this property in question.
Crook closes the public hearing.
Calls a 5-minute break.
Discussion amongst the Commission.
Crook moves to deny CPA-3-03/RZ-8-03 Comprehensive Plan Amendment from
Residential One to Commercial and Mixed Use and Rezone from A-R to C-2-DA
and MU-DA Park Hampton, LLC., the Commission would consider approval
following staff recommendations for the two lots on the southeast corner abutting
Highway 44, also known as lots 5 and 8, inclusive of staffs comments in their
presentation referring to lots abutting Highway 44 alignment with Eagle Island
State Park and the additions and deletions to prohibited uses. Seconded by Lien.
ALL A YE...MOTION CARRIES.
C. CPA-I-04 - Comprehensive Plan Amendment from Residential Two to Mixed
Use - La2Una Pointe. LLC: Laguna Pointe, LLC, represented by Land Consultants,
Inc., is requesting a Comprehensive Plan Amendment to change the land use
designation on the Comprehensive Plan Land Use Map from Residential Two (up to
two dwelling units per acre) to Mixed Use. The 9.31-acre site is located on the east side
of Eagle Road, at 2260 South Eagle Road.
(This item was continued/rom the August 10,2004 meeting).

regarding the Park Lane planning area in particular and as a result believe we s ou
clearly state what is of utmost importance to us.

The plan states, "Uses along Flint Drive shall preserve a residential street while
properties abutting State Street shall be mixed residential with limited retail and office
uses that promote trip capturing."
Item 1: We are in favor of the proposed re -zone of the Flint Estates lots that abut State
Street. (With their existing boundaries, as exhibited on the proposed planning map
7/20/04 at the senior citizens hall). To be re -zoned to mixed residential with limited
retail and office use that promote trip capturing. We ask that we are provided with a
berm that includes a solid vinyl fence. An example of this can be seen on the northwest
corner of State Street and Ballantyne.
The proposed Park Lane plan has areas for High Density Residential and Medium
Density Residential They do not include our street known as Flint Drive.
Item 2: We do not want to have duplexes or any multi -family homes on the
properties along Flint Drive.
When Flint Estates were formed they were made up of five and six acre lots. In the last
proposed comprehensive plan they were slated for R-1 zoning density. Many of us
made improvements to our property, including constructing buildings. Those decisions
to do so and structure placement were based on that proposed R-1 density.
Item 3, Density: Some of us want it to remain as the planned R-1. Others will accept a
transitional residential density with the greater density adjacent to Park Lane, graduating
to R-1 next to the Colony Subdivision. We all agree that density along Flint Drive
should not be greater than R 2.
