CPA-1-03/RZ-7-03 - Comprehensive Plan Amendment from Residential Four to Central Business District and Rezone from R-4 to CBD-DA - G. Greeorv Hall: G. Gregory Hall, represented by Land Consultants, Inc., is requesting a Comprehensive Plan Amendment to change the land use designation on the Comprehensive Plan Land Use Map from Residential Four (up to four dwelling units per acre) to Central Business District, and a rezone from R-4 (Residential - up to four dwelling units per acre) to CBD-DA (Central Business District with Development Agreement). The site is located on the west side of North Eagle Road, approximately 8oo-feet north of West State Street, at 223 North Eagle Road. The site is located on the south side of West State Street approximately 400-feet east of Linder Road, at 4526 West Old Valley Road. LLc.: Park Hampton, LLC, represented by Land Consultants, Inc., is requesting a Comprehensive Plan Amendment to change the land use designation on the Comprehensive Plan Land Use Map from Residential One (up to one dwelling unit per acre) to Commercial and Mixed Use, and a rezone from A-R (Agricultural-Residential-up to one dwelling unit per five acres) to C-2-DA (General Business District with Development Agreement) and MU-DA (Mixed Use with Development Agreement). The site (Lots 1 and 2, Block 1, & Lots 1,2,4,5, 6, 8, & 9, Block 2, of Flint Estates Subdivision) is located on the northeast comer of Park Lane and West State Street, at 3950, 3450 & 3300 West State Street, 3415, 3855, and 3850 West Flint Drive, and 312 North Park Lane. LLC: Laguna Pointe, LLC, represented by Land Consultants, Inc., is requesting a Comprehensive Plan Amendment to change the land use designation on the Comprehensive Plan Land Use Map from Residential Two (up to two dwelling units per acre) to Mixed Use, and a rezone from RUT (Rural Urban Transition - Ada County designation) and A-R (Agricultural-Residential-up to one dwelling unit per five acres) to MU-DA (Mixed Use with Development Agreement)*. The 12.42-acre site is located on the east side of Eagle Road, at 2260 South Eagle Road.(This item was continued from the June 28, 2004 meeting)(Staff requests this item be continued to the August 9,2004 meeting). A-4-04 & RZ-6-04 - Annexation and Rezone - Citv of Eaele: The City of Eagle, represented by William E. Vaughan, AICP, is requesting approval of a City-initiated annexation and rezone with development agreements for the properties generally located on the southwest and northeast corners of State Highway 44 and Linder Road. The multi-site rezones are proposed to be from RR (Rural Residential), RUT (Rural Urban Transition), and R4 & R2 (Residential) to A-R (Agricultural Residential), R-2-DA and R-3-DA (Residential with development agreement), C-I-DA (Neighborhood Business District with development), and PS (Public/Semi-Public)(This item was continued from the July 19, 2004 meeting) Crook introduces the item. Zoning Administrator, Bill Vaughan, reviews the development agreements included in the Commissions information packet as well as other pertinent information regarding the proposed annexation. Mark Butler 52 N. Second Street Eagle, Idaho. Discusses the need to annex these properties. Discusses the Humphries property. Would like to see a bit more flexibility with the proposed zoning, also clarifies the size of the property. Hopes the Commission will move this forward with the other annexations considered tonight. General discussion. Vaughan provides additional comment based on Mr. Butler's testimony. Crook inquires if anyone from the audience wishes to speak to this item. No one chooses to speak. Crook moves to close the public hearing for items Van Treeck, Shank, Sedona, Senora, Senora II, and Copperfield, leaving the public hearing open for the Humphries property. Seconded by Glavach. ALL A YE...MOTION CARRIES. Crook moves to approve agenda item SE, specifically in regard to the Van Treeck, Shank, Sedona, Senora Creek, Senora Creek II, Copperfield properties that we approve the development agreements as currently presented and move those forward. Seconded by Glavach. Discussion. Crook amends the motion to specifically hold back the Humphries Properties for further discussion at the August 16, 2004 meeting leaving the public hearing open. RZ-2.0J MOD - Rezone from RUT and A-R to MU-DA - Coast 2 Coast LLC.: Coast 2 Coast LLC., represented by Land Consultants Inc., is requesting a rezone from RUT (Rural Urban Transition - Ada County designation) and A-R (Agricultural-Residential-up to one dwelling unit per five acres) to MU-DA (Mixed Use with Development Agreement) and, a modification to the development agreement previously approved by the City affecting 9.5-acres of the overall 117-acre site. The site is located on the east side of Eagle Road, at 2260 South Eagle Road. Crook introduces the item. Mark Butler, 52 N. Second St. Eagle, Idaho. Butler presents the application. Comments on the written comment from the developer to the South and expresses his clients desire to utilize the plan they submitted, not the alternative plan proposed by Mr. Torfin. They agree with staff s conditions of approval. City Staff, Jeff Lowe, presents the staff report. Discussion. Crook opens the public hearing. David Olson, 1335 S. Gosling PI. Eagle, Idaho. Would like to preserve their current quality of life in regards to noise and traffic. Mr. Olson's main concern is the leeway the proposed zoning could allow, not the options which were presented but the "what if' factor. Also traffic in regards to safety issues is a concern for him. Jody Zeneke 336 E. River Quarry Eagle, Idaho. Has major concerns with a proposed night club and the noise ordinance. Peels like this applicant should compliment Lakemoor as that application has already been approved. Has a problem with the size of the proposed restaurant. Would like to know how they will successfully market the residential lots adjacent to the commercial properties. Doesn't know how to fix the problem, but doesn't like what is proposed. Dan Torfin representing B.W. Inc. 250 S. Beechwood St. Boise, Idaho. Has previously testified regarding this item. Comments on the impact this application will have on their Lakemoor Development which has already been approved. Has concerns with the compatibility of the proposed commercial zone next to the already approved residential zones in Lakemoor. Displays examples of what they feel is more appropriate zones for property adjacent to their adjoining development. Shannon Cook 2260 S. Eagle Road Eagle, Idaho. Mr. Cook is one of the developers of this property. He addresses the comments which seem to be re-occurring regarding this proposal. It is not their desire to have a business that would become a noise nuisance. They are proposing extensive berming to address some of the noise issues and provide buffering as well. Butler provides rebuttal comments. States there is a Design Review requirement associated with design criteria. Discussion regarding definition of compatibility and reasonableness of changes sought. Discussion amongst the Commission. Creek East PUD: Southers Properties, represented by Phil Hull with The Land Group is requesting final development plan approval for Winding Creek East, a 44-unit multi-family residential PUD. The 3.9-acre site is located on the north side of State Street approximately l00-feet east of Palmetto A venue. Crook introduces the item. Phil Hull 462 E. Shore Dr. Eagle, Idaho, with The Land Group, representing Southers Properties. Mr. Hull presents the application. City Staff, Jeff Lowe, reviews the staff report. General discussion. Glavach moves to approve FPUD-4-04 Final Development Plan for Winding Creek East PUD with the following changes to staff recommendation item 6: change to be a 3" rolled curb with gutter and 4' concrete sidewalk from back of curb separated by a 5' wide landscape strip.
