SPECIAL MEETING
June 1, 2004

The Planning and Zoning Commission met in special session on June 1, 2004 Chairman Bandy
presiding.

B. Findin2s of Fact and Conclusions of Law for FPUD-3-04 & FP-5-04 - Final
Development Plan and Final Plat for Windine Creek PUD Subdivision -
Salmon Point LLC: Salmon Point LLC, represented by Ron Bath, is requesting
final development plan and final plat approval for Winding Creek Subdivision, an
85-lot (58-residential, 17-commercial, lO-common) commercial and residential
PUD subdivision. The 15.3-acre site is located on the north side of State Street
approximately loa-feet east of Palmetto Avenue at 988 State Street.
Glavach moves to approve the Consent Agenda as presented. Seconded by Lien. ALL
A YE...MOTION CARRIES.
5. OLD BUSINESS:
PUBLIC HEARINGS:
ZOA-3-04 - The City of Eagle is proposing to amend Eagle City Code Title 8
"Zoning", Chapter 8 "Area of City hnpact", Section 1 "Area of City hnpact Boundary"
to add to the Eagle Area of City hnpact the property contained within the area west
from the intersection of the centerlines of Linder Road and Homer Road, westerly
along the center line of the Farmers Union Canal to the centerline of State Highway 16,
southerly along the centerline of State Highway 16 to State Highway 44(State
Street)and further to the centerline of State Highway 20/26 (Chinden Boulevard), east
along the centerline of State Highway 20/26 to the existing area of city impact line at
the intersection of the center lines of Linder Road and State Highway 20/26.
Crook introduces the item.

Nichole Baird Spencer City Staff presents the staff report.
Crook opens the public hearing.
Mark Butler, 1640 W Washam Road, Eagle. Mr. Butler gives a brief history of the first
attempt to move the impact area boundary and providing a comprehensive plan for this area.
Mr. Butler states that most of the owners west of Linder Road west to Highway 16 want to be
within the City of Eagle area of impact. States we need to work as closely as possible with the
people located in this area.
Douglas Carnahan 4410 W Chinden Blvd. Mr. Carnahan and his neighbors have been doing

there own planning for the area in question. Mr. Carnahan provides a handout with charts to
aid in his presentation. If Meridian has interest in them and is able to meet their needs then
they want to be excluded in the City of Eagles area of impact.
Teri Bath, 1729 Whidby Lane, Eagle. Ms. Bath with the Chamber of Commerce states the
chamber is taking the middle of the road and wants the City to take into account the people that
are to be affected by this decision so they can get the highest and best use for their property.
Nichole Baird Spencer stands to provide rebuttal. Ms Spencer states that an area of impact is
only a line. Hope to have more of an answer from the City of Meridian within the next few
months but would like to have this matter approved and sent on to the City Council.
Douglas Carnahan stands again to explain the water service which is already in place and states
that it is more of a sewer issue.
Crook closes the public hearing.
Lien states that she is in agreement with the boundary change as there is very little opposition
to this proposal.
Glavach agrees with Lien and as there is very little opposition to the proposal he is in favor of
the change.
Discussion on the notification process.
Mayor Merrill addresses the Commission on the notification process and the properties that
have not been notified not being a part of this application at this time.
Crook does not see any harm with moving ahead with this application. Since these are fairly
natural boundaries it makes sense to move the western line to Highway 16.
Glavach moves to approve ZOA-3-04. Seconded by Lien. ALL
