Minutes - 2004 - Planning & Zoning - 04/19/2004 - Regular ORIGINAL EAGLE PLANNING AND ZONING COMMISSION April 19, 2004 6:30 PM The Planning and Zoning Commission met in regular session on April 19, 2004 Chairman Bandy presiding. 1. CALL TO ORDER: 2. ROLL CALL: The following members were present LIEN, BANDY, DECKERS, CROOK, GLA V ACH. A quorum is present. CONSENT AGENDA: A. Minutes of April 5, 2004. Deckers moves to approve the Consent Agenda as presented. Seconded by Glavach. ALL A YE...MOTION CARRIES. 4. OLD BUSINESS: 3. 5. PUBLIC HEARINGS: A. CU-2-04 - Mobile Office with drive-up service - Home Federal: Home Federal, represented by Insight Architects, is requesting conditional use approval to place a mobile office (pre-manufactured bank facility) on-site with one drive-up service lane. The .63-acre site is generally located on the northeast corner of Eagle Road and East Riverside Drive in the Eagle River Commercial Development. Bandy introduces the item. Russ Phillips, 1789 Broadway Ave, Boise, representing the applicant presents the application. Mr. Phillips has one change to a site specific condition regarding the timeline for removing the temporary facility Jeff Lowe, City Staff presents the staff report. Mr. Lowe states that staff would have no problem changing the wording for the timeline. Discussion between the Commissioners and Mr. Lowe on the timeline for the removal of the mobile office after signing the zoning permit or the occupancy permit. Bandy opens the public hearing. Bandy closes the public hearing. Mr. Phillips stands for rebuttal. Deckers moves to approve CU-2-04 - Mobile Office with drive-up service - Home Federal with staff recommendations and site specific conditions of approval with the following additions and changes to site specific condition #1, To state, "the mobile office shall be removed from the site no later than 1 ¥Z years from the date Page 1 of 5 K:\P&Z\MINU1ESITe¡qx>raty MÍI1UIeI. Leave the last sentence in as already stated. Add all the recommended stated conditions in the April 7th letter from John Schwartz, Construction Manager of Eagle River, any of those recommended conditions that are not already specifically stated should be added. We will defer to Design Review for landscaping, screening and architectural issues. Seconded by Lien. ALL A YE...MOTION CARRIES. A-I-O4/RZ-I-04/PP-I-04 - Tan erose Subdivision - Geor e Crandlemire: George Crandlemire, represented by Tealeys Land Surveying, is requesting an annexation and rezone from RUT (Rural Urban Transition) to R-E (Residential-Estates - up to one dwelling unit per two acres), and preliminary plat approval for Tanglerose Subdivision, a 13-lot (II-buildable, 2-common) residential subdivision. The 24.1O-acre development is located south of Beacon Light Road, approximately 1500 feet west of N. Eagle Road (This item was continued from the March 15,2004 Planning & Zoning Meeting) Bandy introduces the item. The annexation, rezone and preliminary plat will all be heard together with separate motions. Pat Tealey, 2501 Bogus Basin Road, representing the applicant presents the application. Mr. Tealey has no concerns with the staff report for the annexation and rezone but states that is not the case with the preliminary plat report. Jeff Lowe, City Staff presents the staff report. B. Discussion between the Commissioners and Mr. Lowe on irrigation, septic issues and the lack of approval from the fire department. Bandy opens the public hearing. Chris Comstock, N. Skyview Lane, Eagle, has concerns with the lack of approval from the fire department. The lots are separated enough so there should be limited fire liability. Cheryl Bloom, 2153 N. Holybrook Place, Ms. Bloom is concerned that the developer is not ready to propose this application. The application should be continued until there is fire approval. Ms. Bloom finds the plat boring and has a lack of amenities. Need to look at traffic issues and connectivity between this application and the Pony Subdivision application. This is going to add increased traffic onto Beacon Light Road. Also, there is a lot of real estate available with two acre parcels. Ms. Bloom states we should be looking at what is good for the City of Eagle and not the landowner's pocket book Jack VanWylk, 1520 W.Rush Road, Concerned about annexation of additional parcels we should be looking at the whole strip and not piecemeal annexation. Mr. Tealey stands for rebuttal. Would like to provide creativity but the zone does not allow it. The additional trips this subdivision will provide is minor for a major arterial road. Deckers asks Mr. Tealey questions about concerns he has with the timing from Central District Health and the Fire Department. Bandy closes the public hearing. Jeff Lowe stands to answer Mr. Deckers questions. Deckers is concerned about approving the preliminary plat application before the approvals are complete. Specifically the Fire Department and sewage issues so would like to continue this application. Does not have an issue with approving the annexation and rezone at this time. John McFadden, City Attorney recommends that the annexation and rezone be continued along with the preliminary plat so they all run together. Deckers asks Mr. Tealey if there is an advantage to them for getting the rezone and annexation but not the preliminary plat approval at this time. Mr. Tealey states that there are entitlement issues with this application. These are two separate applications and to get the rezone to an R-E zone is an advantage to the applicant. Deckers moves to continue A-I-04/RZ-I-04/PP-I-04 - Tanglerose Subdivision - George Crandlemire to the June 14, 2004 Planning & Zoning Meeting and anticipate having alternated means of compliance from the Fire Department by then. Seconded by Crook. ALL A YE...MOTION CARRIES. C. A-2-04/RZ-2-04/PP-2-04 - Pony Subdivision No. 2E. - Thomas & Connie Jones: E. Thomas & Connie Jones, represented by Tealeys Land Surveying, is requesting an annexation and rezone from RUT (Rural Urban Transition) to R-E (Residential-Estates - up to one dwelling unit per two acres), and preliminary plat approval for Pony Subdivision No.2, a 13-lot (9-buildable, 4-common) re')idential subdivision. The 21.55-acre development is located south of Beacon Light Road, approximately 1500 feet east of North Ballantyne Lane. (This item was continued from the March 15, 2004 Planning & Zoning Meeting) Bandy introduces the item. Pat Tealey representing the applicant presents the application. Mr. Tealey states that there are the same issues with this application as with the previous application. The nutrigen pathogen study is taking place at this time. Jeff Lowe, City Staff presents the staff report. Lowe states that this application is very similar to the previous application. This subdivision also has a lack of municipal system to provide fire compliance. The original Pony Subdivision was originally platted in 1992. Bandy opens the public hearing. Has the same concern as the previous application and that is the need to annex the entire strip and not one parcel at a time. His parcel is adjacent to the proposal and has concerns about the surface irrigation water and not using domestic well water to irrigate. Anne Ritter, 1270 W Beacon Light. Ms. Ritter lives north and east of the property. The gate and the weir are located on her property that serves this area. Would like to separate the water that will be used south of Beacon Light with the use North of Beacon Light. Would like the point of delivery to be gate no. 65, does not want conflicting use. Likes the plat layout, states the applicant has done a good job with it. Dick Langerstrom 1262 N. Beacon Light. Owns the pond that the water flows in to. Would like to be able to manage the water flow as they have been at war for 14 years. Has had to replace their pump twice. Would like the irrigation flow controlled. Cheryl Bloom, 2163 N. Hollybrook, Ms. Bloom states that this is a boring plat ,there is no creativity, this is an infill type subdivision. We need to look at connectivity. There is traffic issues already is this area. We need to look at different plats in 2 acre subdivisions. Jack VanWylk stands again to discuss the fact that that there are too many piecemeal parcels in this area. We need to approach this in a different way. Deckers responds to Mr. VanWyIks statement that we have a comprehensive plan for the city. The City looks at the potential for interconnectivity and annexation. Mr. Tealey provides a rebuttal. Jeff Lowe address the question about cross connections with irrigation systems. Bandy closes the public hearing. Deckers states that he feels the same about this application as he the felt about the previous application. Jeff Lowe stands to address the question regarding stub streets and interconnectivity. Bandy reopens the public hearing for both written and verbal testimony. Bandy moves to continue A-2-04/RZ-2-04/PP-2-04 - Pony Subdivision No. 2E. - Thomas & Connie Jones until the June 14, 2004. Seconded by Deckers. Bandy amends the motion to reopen the public hearing. This site is located in the Eagle Area of Impact. Bandy introduces the item. The applicant is not present. Jeff Lowe, City Staff stands to discuss the process for an Ada County transmittal. Bandy calls a brief break at 9:05 p.m. Commissioner Crook states that this application is in the flood plain and would like to make a recommendation to the county. Deckers moves to continued 04-02-S/04-02-PR - Fease & Ellensohn - Amended Viejo Estates Subdivision to the June 14,2004, Planning & Zoning Meeting. If Ada County hears this before Eagle Planning & Zoning has the opportunity to hear it, then a letter needs to be sent to Ada Co Development Services, stating the reason this item was not heard by Eagle was because the applicant was not present at the regular scheduled Planning & Zoning Meeting. State Street Eagle, ID 83616 April 19, 2004 Dear Planning and Zoning Members: As a rural resident north of proposed changes in subdivision rules, I appreciate opportunity to hear of plans for additional residences on lots that may be less than five acres in size. Annexation to Eagle city appears part of proposals for land across Beacon Light from my residence. It is my hope that such plans address issues of urban sprawl noted in The Idaho Statesman last month. As I depend upon well water for domestic use and a septic tank for waste disposal, annexation would be welcome if municipal water and sewer services are extended to annexation sites before building permits may be activated. An orderly provision of city infrastructure systems would be welcome to alleviate urban sprawl, providing higher density housing close to the Eagle town site and reserving building permits on the larger parcels until such time as the infrastructure reaches annexation sites. I would suggest residential development plans include an equitable delivery of irrigation water among the new homeowners from the system responsible for water delivery prior to property subdivision. This would reduce the demand for well water for landscape use, saving more of the underground sources for domestic use. I feel the property developer should bear responsibility for an irrigation water plan and responsibility to lay sewer and water lines to property boundaries where they would connect to a public utility system. We do no favors to prospective homeowners when we allow land development without responsible consideration to health and safety issues. Septic tanks have no place in subdivisions that depend on well water. As part of the Eagle land use plan, it would be appreciated to have discussion and public input as to possible commercial development sites within the Eagle impact area. It will not be appreciated for land use changes to be pursued at the whim of landowners without neighbors having assurance that a change has been part of an established comprehensive plan. Such plan would involve Ada County Highway District and other community support services to ensure growth is managed in a reasonable manner. Thoughtful attention to these and other growth issues should help Eagle avoid contribution to urban sprawl and retain Eagle's position as a nice place to live. Sincerely, f� t: R.A.
