The Planning and Zoning Commission met in regular session on March 5, 2004
Chairman Bandy presiding.

DECKERS, GLA V ACH. Absent: CROOK. A quorum is present.
CONSENT AGENDA:
A. Minutes of March 15, 2004.
Deckers moves to approve the Consent Agenda as presented. Seconded by
Glavach. ALL AYE...MOTION CARRIES

PUBLIC HEARINGS:
A. CPA-I-OJ/RZ-7-0J - Comurehensive Plan Amendment from Residential
Four to Central Business District and Rezone from R-4 to CBD-DA - G.
Gre2orv HaD: G. Gregory Hall, represented by Land Consultants, Inc., is
requesting a Comprehensive Plan Amendment to change the land use
designation on the Comprehensive Plan Land Use Map from Residential
Four (up to four dwelling units per acre) to Central Business District, and a
rezone from R-4 (Residential - up to four dwelling units per acre) to CBD-
DA (Central Business District with Development Agreement). The site is
located on the west side of North Eagle Road, approximately 8oo-feet north
of West State Street, at 223 North Eagle Road.
Bandy introduces the item.
Mark Butler, 52 N. 2nd St, Eagle, with the Land Consultants presents the application.
Jeff Lowe, City Staff presents the staff report.
Bandy opens the public hearing
Jan Shurte, lives in Meridian but is speaking for her mother and brother who live across
the street at 240 N Eagle Road and 262 N Eagle Road. They are concerned about what
the use of the church will be and the additional traffic that will increase on Eagle Road.
Also, if this were to become the CBD if this will make their residential property become
part of the Central Business District. Ms. Shurte also states that the only time there is
no traffic on Eagle Road is in the early morning hours
Mark Butler stands for rebuttal. Mr. Butler states that he would like Ms. Shurte and her
family to come in and speak with him further.

Dave Buich, 33497 Holl Drive, Eagle. Mr. Buich is the owner of the property and states
that he concurs with Mr. Butler. Would like the cross access but not knowing the use
makes it hard to know what will fit in with his use.
Discussion between Jeff Lowe and the Commissioners.
Deckers states that he would like the staff discussion changed that says one of the
reasons for the comp plan change would be because of the noise on Eagle Road not
being conducive to a residential area. If this were the case than the entire homes along
Eagle Road would not be appropriate as residential.
The public hearing will remain open.
Dave Buich stands again to address Mr. Deckers comment about the cross access and
the neighbor to the south. Mr. Buich would like to discuss monetary concerns with this
neighbor.
Deckers moves to continue CPA-I-0J/RZ-7-0J to the May 17, 2004, Planning &
Zoning Meeting. Seconded by Lien. ALL A YE...MOTION CARRIES.
B. CPA-2-0J - Comprehensive Plan Amendment from Residential One to
Commercial- Rick & Nita Musick: Rick & Nita Musick, represented by
Land Consultants, Inc., is requesting a Comprehensive Plan Amendment to
change the land use designation on the Comprehensive Plan Land Use Map
from Residential One (up to one dwelling unit per acre) to Commercial.
The site is located on the south side of West State Street approximately
400-feet east of Linder Road, at 4526 West Old Valley Road.
Bandy introduces the item.
Mark Butler 52 N. 2nd St. Eagle. Mr. Butler representing the applicant presents the
application.
Jeff Lowe, City Staff present the staff report.
Karen Johnson, 3468 Flint Drive, Eagle. Ms. Johnson actually came to testify for the
CPA that was continued but heard this item and choose to testify for this item. Ms.
Johnson does not want to contribute to urban sprawl. Farm land has been lost and
sprawl does not want to be encouraged. Ms. Johnson states that she is appalled by this
application.
John Wood, 3300 West State Street. Mr. Wood lives across from this application. He
has attended all the meetings in Eagle and Star that have been held recently. States that
this is a state highway with no amenities. Everyone has to travel by his front door in
order to get to or from the Star area.
Elaine Hill, 44648 W Old Valley Road. Ms. Hill lives next to this property. States this
is a high traffic area. Ms. Hill states that the use of this land as commercial is an
appropriate use.
Mark Butler stands to provide rebuttal.

Karen Johnson stands again. Ms. Johnson lives in Flint Estates at the end of the cul-de-
sac. States that there is still farming taking place in this area and would never have
bought in this area if she knew this area would go commercial.
Jeff Lowe, stands to address Deckers question on the City doing more studies in this
area.
Deckers states he is cautious as far as comp plan changes go and this proposal is against
what the comp plan says. This area needs a more in depth study done and not just a
comp plan amendment. The public as a whole needs to be involved in how this area
will be developed.
Bandy would like more time to study this area before making a decision.
Deckers would like staff to look further at this area and perhaps put this study in with
the area of impact study that is now in the process. Asks what the timeline would be
like for other options.
The public hearing is still open.
Deckers moves to continue CPA-2-0J - Comprehensive Plan Amendment from
Residential One to Commercial - Rick & Nita Musick until the May 17, 2004,'
Planning & Zoning Meeting. Seconded by Lien. ALL A YE...MOTION
CARRIES.
C.
CPA-J-OJ/RZ-8-0J - Comorehensive Plan Amendment from
Residential One to Commercial and Rezone from A-R to C-2-DA -
Park Hamoton. LLC.: Park Hampton, ILC, represented by Land
Consultants, Inc., is requesting a Comprehensive Plan Amendment to
change the land use designation on the Comprehensive Plan Land Use Map
from Residential One (up to one dwelling unit per acre) to Commercial, and
a rezone from A-R (Agricultural-Residential) to C-2-DA (General Business
District with Development Agreement). The site (Lots 1,4,5,8, & 9,
Block 2, of Flint Estates Subdivision) is located on the northeast corner of
Park Lane and West State Street, at 3950, 3450 & 3300 West State Street.
Bandy introduces this item and requests that it be heard first on the agenda.
Deckers moves to continue CPA-J-OJ/RZ-8-0J - Comprehensive Plan Amendment
from Residential One to Commercial and Rezone from A-R to C-2-DA - Park
Hampton, LLC. until the May 17, 2004 Planning & Zoning Meeting. Seconded by
Lien. ALL A YE...MOTION CARRIES.
