EAGLE PLANNING AND ZONING COMMISSION
January 5, 2004

The Planning and Zoning Commission met in regular session on January 5, 2004 Chairman
Deckers presiding.

CALL TO ORDER:

ROLL CALL: The following members were present BANDY, DECKERS,
CROOK, GLA V ACH. Absent: LIEN. A quorum is present.

CONSENT AGENDA:
A. Minutes of December 15, 2003
B. Findines of Fact and Conclusions of Law for CU-14-03 - BanklFinancial
Institution with drive-up service - Bank of America: Bank of America,
represented by Gensler Architects, is requesting conditional use approval to
construct a bank facility with three drive up service lanes. The 1.1 I-acre site
is generally located on the north side of State Highway 44 in the Eagle Towne
& Country Centre Commercial Development at 3144 West State Street.
Deckers requests that two separate motions be made.
Deckers moves to approve item 3A as amended. Seconded by Crook. ALL
A YE...MOTION CARRIES.
Deckers moves to approve item 3B.

A. ZOA-6-03 - The City of Eagle is proposing to amend Eagle City Code Title 8
"Zoning", Chapter 8 "Area of City Impact", to establish additional criteria for
the development of subdivisions and to prohibit cluster developments within
the city area of impact.
Deckers introduces the item.
Jeff Lowe, City Staff presents the draft zoning ordinance amendment.
Discussion amongst the Commissioners on the appropriate language in the ordinance.
Discussion on E. #1 How does Ada Co defined RUT cluster developments?
Deckers opens the public hearing.
Crook moves to continue ZOA-5-04 to Tuesday, January 13,2004. Seconded by
Bandy. ALL A YE...MOTION CARRIES.
B. ZOA-7-03 - The City of Eagle is proposing to amend Eagle City Code Title 8
"Zoning", Chapter 2 "Zoning Districts and Maps", Section 3 "Schedule of

District Use Regulations" to allow Bank/financial institutions with drive up
service and Bank/financial institutions with no drive up service as permitted
uses within the C-3 (Highway Business District) zoning district. (Staff requests
this item be remanded to staff)
Bandy moves to remand ZOA-7-03 back to Staff. Seconded by Crook. ALL
A YE..MOTION CARRIES.
C. ZOA-8-03 - The City of Eagle is proposing to amend Eagle City Code Title 8
"Zoning", Chapter 3 "Performance Standards", Section 5 "Unique Land Uses"
to prohibit the use of motorized watercraft within the city limits. The
prohibition will not include the use of motorized watercraft on the Boise River
within the city limits.
Deckers introduces the item.
Jeff Lowe, City Staff, presents the draft zoning ordinance amendment.
John McFadden, City Attorney, addresses some language changes in the amendment.
Discussion amongst the Commissioners.
Deckers opens the public hearing.
Deckers moves to continue ZOA-8-03 to February 2, 2004. Seconded by Glavach.
ALL A YE...MOTION CARRIES.
6. NEW BUSINESS: Election of new Planning & Zoning Chairman
Deckers moves to nominate Commissioner Bandy as Chairman. Seconded by Crook.
Discussion. Deckers moves to nominate Commissioner Crook as Vice-Chairman.
Seconded by Glavach. ALL A YE...MOTION CARRIES.
7. REPORTS: Discussion on Oakhaven Subdivision
8. ADJOURNMENT: Crook moved to adjourn at 8:25p.m. Seconded by
