EAGLE PLANNING AND ZONING COMMISSION
December 15, 2003

The Planning and Zoning Commission met in regular session on December 15,2003
Vice-Chairman Crook presiding.

CALL TO ORDER:

ROLL CALL: The following members were present, BANDY,
CROOK, GLA V ACH. Absent: DECKERS, LIEN. A quorum is present.

CONSENT AGENDA:

B. Findines of Fact and Conclusions of Law for CU-12-03/PPUD-5-03-
~ne Cree~ East flanne4 Unit Development - Southers Properties:
Southers Properties is requesting a conditional use permit and preliminary
development plan approval for Winding Creek East, a 47-lot (46-
residential, I-common) residential planned unit development. The 3.9-acre
site is located approximately 500-feet north of State Street and
approximately 1O00-feet east of Palmetto A venue.
C. Findines of Fact and Conclusions of Law for CU-13-03 -
~nancial Institution with drive-up service - Home Federal:
Home Federal, represented by Russ Phillips with Insight Architects, is
requesting conditional use approval to construct a bank facility with three
drive up service lanes. The .63-acre site is generally located on the
northeast comer of Eagle Road and East Riverside Drive in the Eagle River
Commercial Development at 100 East Riverside Drive.
D. V AC-6-03 - Vacation to the final plat of Two Rivers Subdivision No.5-
L...R. Company. LLC. represented bv Dan Torfin: T.R. Company, LLC,
represented by Dan Torfin, is requesting City approval of a vacation to the
final plat of Two Rivers Subdivision No.5 to remove the utility, drainage
and irrigation easement along the common side lot line of Lots 30 and 31,
Block 19, to satisfy a lot line adjustment. The utility, drainage and
irrigation easement required for the side lot line will be satisfied with the
creation of a new easement along the new common side lot line. The site is
located on the south side of West Water Grove Drive at 577 and 591 West
Water Grove Drive.
Bandy removes items 3A, 3B & 3C from the consent agenda. Seconded by
Glavach. ALL A YE...MOTION CARRIES.

PUBLIC HEARINGS:
A. CU-l4.:M.::.Pank/Financial Institution with drive-up service - Bank of
America: Bank of America, represented by Gensler Architects, is requesting
conditional use approval to construct a bank facility with three drive up
service lanes. The 1. ll-acre site is generally located on the north side of
State Highway 44 in the Eagle Towne & Country Centre Commercial
Development at 3144 West State Street.
Crook introduces the item.
Donna Williamson, 1524 5th Ave, Suite 800, Seattle W A, with Gensler Architects
representing the applicant presents the application.
Kim Sigenthaler, 495 Main Street Boise stands to address the concerns for screening the
drive-up lane
Lien arrives at 6:55 p.m.
Don Baker, 1001 4th Ave Seattle, with Bank of America. Mr. Baker states that they
designed the building to fit Eagle Code from the beginning. Addresses the traffic
pattern and the use of landscaping to mitigate headlight problems.
Jeff Lowe, City Staff presents the application. Mr. Lowe states that parking should not
be a problem. Mr. Lowe, states that perhaps signage could be uses to provide caution to
drivers and alert them about the different traffic pattern.
Crook opens the public hearing.
Donna Williamson stands to provide rebuttal. Ms. Williamson states that she is not
convinced that there is a traffic problem.
Mr. Baker stands to address the use of signage.
Ms. Williamson stands to address Commissioner Crooks question on the use of curbing
to direct traffic
Mr. Baker stands to address the curbing, stating they can give this to the Design Review
Board and bring back a revised site plan.
Crook closes the public hearing.
Glavach would like to see the use of signage, other then that he has no issues with the
application.
Bandy would like to see the use of a stripe between lanes on the eastern edge and
curbing but is not convinced the use of signage will be effective.

Lien feels that the concerns have been met by the applicant and if there are issues in the
future that the applicant can address them at that time.
Crook agrees with the previous statements, but there could be a change to site specific
condition #3.
Crook moves to approve CU-14-03 - BanklFinancial Institution with drive-up
service - Bank of America with staff recommendations and the following change
to site specific condition of approval #3. Provide a sign and striping plan as
necessary that delineates a left-turn pocket and a traffic circulation pattern to
mitigate potential vehicle conflicts between east bound vehicles and the vehicles
entering the drive up lane from the two-way access on the northern side of the
bank facility, insert "including a solid line and arrows delineating traffic lanes
directly north of the trash enclosure" Details shall be ... Seconded by Bandy.
Discussion. ALL A YE...MOTION CARRIES.
Crook makes a motion to amend his motion to delete the verbiage that includes a
left turn pocket from the first sentence of site specific condition #3. The sentence
will read; ...that delineates a traffic circulation pattern... Seconded by Bandy.
ALL A YE...MOTION CARRIES.

7. REPORTS: Lowe reports on Oakhaven Subdivision
8. ADJOURNMENT: Lien moved to adjourn at 7:35 p.m. Seconded by
Glavach. ALL A YE...MOTION CARRIES...
