Minutes - 2003 - Planning & Zoning - 12/01/2003 - Regular ORIGINAL EAGLE PLANNING AND ZONING COMMISSION December 1, 2003 6:30 PM The Planning and Zoning Commission met in regular session on December 1, 2003 Chairman Deckers presiding. 1. CALL TO ORDER: 2. ROLL CALL: The following members were present LIEN, BANDY, DECKERS, CROOK, GLA V ACH. A quorum is present. 3. CONSENT AGENDA: A. Minutes of November 24, 2003 B. Findines of Fact and Conclusions of Law for CU-ll-03/PPUD-4-03/PP- 7-03- Savbrook ViI~lanned_Unit Development - N.JN. LLC: NJN, LLC, represented by Land Consultants Inc., is requesting a conditional use permit, preliminary development plan and preliminary plat approvals for Saybrook Village Subdivision, a residential/commercial planned unit development. The 19.58-acre development consists of a l6-lot (8-residential, 5-commercial, 2-common I-church) subdivision. The site is located on the south side of West State Street approximately 3/4 mile west of Eagle Road at 1161 West State Street. Deckers requests to remove both of these items from the consent agenda. The minutes will be moved to the end of the agenda. Regarding the application for Saybrook Village, Staff has requested a clarification on the motion regarding the pathway through the church property. Discussion on the pathway development. Site specific condition #17 add the following; construct a pathway between State Street and up to and crossing the Ballantyne ditch only with a 20' wide easement to be located through the undeveloped portion of Lot 15, Block 1. #32 buildings on lots 5 & 6 may be constructed with one comer of the buildings located no closer than 5 feet to the property line the remainder of the building shall be lO-feet. The buildings shall be situated on the lots generally as shown on the plan date stamped September 4, 2003. #45 strike building and add "new construction" On the last page 34, the last sentence shall read strike a good concept, add acceptable, insert, "nor provides the diverse character" Deckers moves to approve Findings of Fact and Conclusions of Law for CU-11- 03/PPUD-4-03/PP-7-03- Saybrook Village Planned Unit Development - NJN, LLC as amended. CU-12-03/PPUD-5-03 - Windine Creek East Planned Unit ~opment - Southers Properties: Southers Properties is requesting a conditional use permit and preliminary development plan approval for Winding Creek East, a 47-lot (46-residential, I-common) residential planned unit development. The 3.9-acre site is located approximately 500- feet north of State Street and approximately lOOO-feet east of Palmetto A venue. ( This item was continued from the November 24, 2003 Planning & Zoning Meeting. The public hearing is open for written testimony only) Deckers introduces the item. No written testimony was received. David Southers, 1401 Shoreline Drive Suite D., stands to address the previous concerns regarding the garage elevations. Mr. Southers distributes colored photographs to the Commissioners. Phil Hull, 128 S. Eagle Road, with the Land Group discusses the concerns about several of the site specific conditions of approval. Jeff Lowe, City Staff stands to address questions from the Commissioners. Discussion on the site specific conditions of approval Phil stands to address site specific condition #6, referring to the letter which is in the ACHD staff report, and the concerns from the fire department Deckers closes the public hearing. Bandy feels this is a well planned subdivision and is a good transition for the downtown. The upscale design will be an attraction. Deckers thinks this will fit the space, however he has concerns about the residential development instead of commercial for this location. Does not want to see this concept continued into the mixed use area to the north. Would rather transition into more single family dwellings. Crook agrees with Bandy, this is unique to Eagle and is happy with this type of development in Eagle. Would rather see residential in this area to support the commercial Glavach likes the fact that this is affordable housing and is centrally located and easily accessible. More commercial should be able to still come into this area. Great concept plan! Lien also agrees that we need more residential in this area to support the commercial developments located in the downtown area. Deckers discusses the changes (provides written notes) he would like to make for several of the site specific conditions. Page 4 of 4 K:\P&ZIMlNUTES\Temporary MulUtes Work Area\PZ-12-0l-03 min.doc Lowe stands to address site specific condition #17 regarding the responsibilities of staff and the ditch company Deckers moves to approve CU-12-03/PPUD-5-03 - Winding Creek East Planned Unit Development - Southers Properties with the staff recommended site specific conditions of approval and with the following additions and corrections to #1 and the Nov, 21 2003 letter; #2.. Add- Hill Road shall be constructed with a landscaped center island as required in PP-6-03. This center island may be broken in places, and shall be constructed to the maximum length that will allow adequate center turn lane spacing to accommodate turning movements. #4 strike instruct staff to choose applicable requirements from Winding Creek and add to Winding Creek East. #5 Replace State Street with "Winding Creek Road" #6 Add- The ditch shall remain open except for where it crosses under Hill Road. Strike Idaho Dept. of Lands and replace with Drainage Ditch #2. #17 after regarding insert "ditch maintenance access and landscape improvements within" After final plat insert "The applicant shall obtain a copy of the recorded license agreement stating their approval of the Design Review Board..." #19 after access the easement, continue with "according to the terms of agreement with the Drainage.. eo" Seconded by Crook Discussion. B. ,Ç!l:!3-03 - Ban~inancial Institution with drive-up service - Home Federal: Home Federal, represented by Russ Phillips with Insight Architects, is requesting conditional use approval to construct a bank facility with three drive up service lanes. The .63-acre site is generally located on the northeast comer of Eagle Road and East Riverside Drive in the Eagle River Commercial Development at 100 East Riverside Drive. Deckers introduces the item. Russ Phillips with Insight Architects representing the applicant presents the applicant. The applicant agrees with staffs recommendations. Discussion from Mr. Phillips on Home Federal and the adjacent parcel owned by Wendy's parking spaces. Jeff Lowe, City Staff presents the staff report. Discussion on a Park & Ride Decker opens the public hearing. Dale Nagy, 4977 N. Hollow Lane, Mr. Nagy owns the Wendy's and is concerned about the lack of parking for the Home Federal customers. Mr. Nagy gives the Commissioners a handout that shows the original pad site. During the busy time at Wendy's he is concerned that that Home Federal customers will be using his parking sites as most of the Home Federal parking is to the east. Russ Phillips stands for rebuttal. States that they have no issue with providing road bumps. Further discussion on the location of the parking spaces. Deckers calls a brief break at 9: 10 p.m. Mr. Nagy stands to address Deckers question of if the parking is critical to the success of his business. Mr. Nagy states that if additional parking ( approximately 3-4 extra spots on the southwest side) was provided it would be no problem at all. Crook moves to approve CU-13-03 - Bank/Financial Institution with drive-up service - Home Federal with an alteration to site specific condition #4 provide measures to mitigate traffic with speed bumps. #7 require employee parking be instructed to park in the eastern portion of the parking lot. Discussion. Crook amends the motion to add to council to strongly look at adding additional spaces to the south side of building. Second concurs. ALL A YE...MOTION CARRIES. 6. NEW BUSINESS: Election of new Vice-Chairman Deckers moves to nominate Crook as Vice-Chairman. Seconded by Bandy. ALL A YE...MOTION CARRIES.
