EAGLE PLANNING AND ZONING COMMISSION

The Planning and Zoning Commission met in regular session on October 20, 2003
Vice-Chairman Bloom presiding.

CALL TO ORDER:

ROLL CALL: The following members were present BANDY, BLOOM,
GLA V ACH. Absent; DECKERS, CROOK. A quorum is present.

CONSENT AGENDA:
A. Minutes of October 6, 2003
B. Findines of Fact and Conclusions of Law for A -3-03/RZ-4-03 - Douelas
Carnahan: Douglas Carnahan, represented by David Bailey, P.E. with
Bailey Engineering, is requesting a rezone upon annexation from RUT
(Rural Urban Transitional- Ada County Designation) to R-E (Residential
Estates - up to one dwelling unit per two acres). The 30.72-acre
development is located approximately 1,.1, mile east of Eagle Road and south
of Beacon Light Road, at 657 E. Beacon Light Road.
C. Findines of Fact and Conclusions of Law for PP-5-03 - Oakhaven
Subdivision - Douelas Carnahan: Douglas Carnahan, represented by
David Bailey, P.E. with Bailey Engineering Inc., is requesting preliminary
plat approval for Oakhaven Subdivision, an l8-lot (14-buildable, 4-
common) residential subdivision. The 30.72-acre development is located
approximately 1,.1, mile east of Eagle Road and south of Beacon Light Road,
at 657 E. Beacon Light Road.
D. Findines of Fact and Conclusions of Law for RZ-5-03 - Rezone from
A-R to R-E - ames Wood: James Wood, represented by Land
Consultants, Inc., is requesting a rezone from A-R (Agricultural-
Residential, up to one dwelling unit per five-acres) to R-E (Residential-
Estates, up to one dwelling unit per two-acres). The 5.4 I-acre site is
located on the north side of State Highway 44 approximately '12 mile east of
North Park Lane at 3300 W. State Street.
Glavach moves to remove all items from the consent agenda
Glavach moves to approve the minutes of October 6, 2003, as amended. Seconded by
Bloom. 2 AYE (Bandy Abstained)...MOTION CARRIES
Item 3B. Bloom moves to approve the amended findings. Seconded by Glavach. 2 AYE

Item 3C. Glavach moves to approve the amended findings. Seconded by Bloom. 2 AYE

PUBLIC HEARINGS:
A. PP/FP-2-03 - Kolander Subdivision - Buddy D. Kolander: Buddy D.
Kolander is requesting combined preliminary plat and final plat approval for
Kolander Subdivision. The 9.64-acre, 4-lot residential subdivision is
located at 1260 Rush Road. (This item was continued from the September
15, 2003 Planning & Zoning meeting).
Bloom introduces the item.
Pat Tealey, 2521 Bogus Basin Road, Boise, Idaho. Mr. Tealey is representing
the applicant briefly presents the applicant. Mr. Tealey states that they have no
problems with staffs site specific conditions of approval
Jeff Lowe, City Staff presents the staff report. Discussion between staff and the
Commissioners regarding fire safety and the use of house sprinklers. Also,
discussion on the letter from Central District Health.
Bloom opens the public hearing.
Mr. Tealey provides a rebuttal. The representative is aware of the requirements
put on by Central District Health and the Fire District. Mr. Tealey states that the
existing barn will also be removed.
Bloom closes the public hearing.
Bandy moves to approve PP/FP-2-03 - Kolander Subdivision - Buddy D.
Kolander with staff recommendations and one change to site specific
condition # 10, change record of survey to final plat. Seconded by Bloom
ALL A YE...MOTION CARRIES.
B. RZ-6-03/CU-IO-03/PPUD-3-03/PP-6-03 - Windine Creek Planned Unit
Development - Salmon Point Development LLC: Salmon Point
Development LLC, represented by Ron Bath, is requesting a rezone from C-
2 (General Business District) to MU-DA-P (Mixed Use with development
agreement and PUD) for conditional use permit, preliminary development
plan, and preliminary plat approvals for Winding Creek Subdivision, a
residential/commercial planned unit development. A 17.43-acre portion of
the development consists of an 89-lot (59-residential, l7-commercial, 13-
common) subdivision, with the remaining 3.93-acres (Lot 1, Block 3) to be
subdivided at a later date. The site is located on the north side of State

Street approximately 1O0-feet east of Palmetto A venue at 988 State Street.
(This item will be continued until the November 3, 2003, Planning & Zoning
Meeting).
