CALL TO ORDER: 2. ROLL CALL: The following members were present BANDY, BLOOM, DECKERS, CROOK, GLA V ACH. A quorum is present CONSENT AGENDA: A. Minutes of July 28,2003. Crook moves to approve the Consent Agenda as presented. Seconded by Bloom. THREE AYE (DECKERS, BANDY ABSTAINED).. .MOTION CARRIES. 4. OLD BUSINESS: None 3. 5. PUBLIC HEARINGS: A. RZ-3-03 - Rezone from R-4 to MU-DA - Paramount Parks at Eaele LLC: Paramount Parks at Eagle LLC, represented by Gerald Teal with Teal Architects, is requesting a rezone from R-4 (up to four dwelling units per acre) to MU-DA (Mixed Use with development agreement). The 2.9-acre site is located on the west side of Eagle Road approximately 800-feet south of Floating Feather Road at 813 N. Eagle Road. Deckers introduces the item. Gerald Teal, 9179 W State Street, Boise. Mr. Teal, representing the applicant presents the application. This project will include assisted living and an Alzheimer's unit. Mr. Teal states that the easement into the Hinshaws property will be maintained and all existing buildings will be removed. Parking is strictly for the employees and visitors. Approximately 25 people will be employed by this facility. No parking will be utilized by the residents. Deckers asked the applicant question regarding the phasing of this project. Jeff Lowe, City staff presents the staff report. Deckers opens the public hearing. Michael McCrane, 1014 N Great Pebble Way, Eagle. Mr. McCrane would like to know the number of residence and what part is phase one and what part is phase 2. Are any of these facilities currently existing and where are they located? Mr. Hinshaw is concerned about the easement as he is the one that will be sharing the easement with the facility. He currently hauls wide loads in and is concerned about the road width, states it needs to be 30 feet. Is also concerned about the water for irrigating, and is also concerned about the drainage. Has a hillside and is concerned it will erode. Mr. Teal provides a rebuttal The number of residents is the first phase is approx. 50. Mr. Teal uses the overhead to explain the first and second phases of the project. A similar facility is at Paramount Parks in Boise off of Five Mile just north of Overland. The exterior design is close to this facility except this one will be two story. Mr. Teal explains where other similar facilities are located. Mr. Teal discusses the flood control and drainage issues. Mr. Teal states that all stormwater will be maintained on site. The easement road will not be a public road but will be private. There will be no parking on the road. The width of the roadway is 20 feet Discussion between the Commissioners and Staff on the flood plain and the road width for the easement. Larry Hinshaw stands to address the Commissioner Crooks questions; where and how does the irrigation for his site come from? And how does he use the easement? Deckers closes the public hearing. Bandy comments on the no parking signs and would like to increase the road width to 24 feet Bloom comments on staff condition 2.3, would like the language to say remove entire garage /shop. 2.10 add to the end of the sentence prior to any construction. 2.4 have access built to required width. Add language that requires the City Engineer to provide an on site inspection for drainage review. Have the flood plain official review this site. Crook feels this is an appropriate use for the site and would rather see this than single family residence. Is concerned about the easement and land locking the neighbors site. Need to take into consideration a future use for the property. and providing a road that allows for the use of heavy equipment and farm equipment. Deckers summarizes the previous statements. Deckers moves to approve RZ-3-03 - Rezone from R-4 to MU-DA - Paramount Parks at Eagle LLC with staff recommendations with the following changes and additions; 2.3 The applicant shall remove the entire garage/shop. Continue as written. 2.4 The access to parcel 110320 shall be built to 24 feet width and signs installed instructing no parking on the roadway along the access. The access shall be constructed to appropriate construction standards. 2.10 The applicant will submit for review an on site inspection to City Engineer and approval prior to any construction. Continue as written. Seconded by Bloom. All A YE...MOTION CARRIES. Deckers calls a brief break. B. CU-07-03 - pavcare Center œre-Sc~tv) - LaDawna C. Wilson: LaDawna C. Wilson is requesting conditional use approval to provide a Daycare Center (pre-school facility) within the existing dwelling unit located on the site which is a part of DR-44-02 (currently under review for a proposed church). The 2.94 acre site is located on the north side of East State Street approximately Y2 - mile east of Eagle Road at 350 East State Street. Deckers introduces the item. LaDawna Wilson, director and teacher for the First Baptist Church Pre-school discusses her application. Ms. Wilson states she is state licensed and had an inspection done by Central District Health approving the facility. Jeff Lowe, City Staff discusses the staff report and the conditions placed on this application. Deckers opens the public hearing. LaDawna Wilson stands to comment that since she is licensed, when she moves into the new building she will have to be inspected again. Ms. Wilson states that there will never be more than 20 children enrolled at the school at one time. City Attorney, John McFadden clarifies that the applicant will not need to resubmit a new application in two years if the new church is not built rather, the item will be revisited. Deckers closes the public hearing. Crook discusses requiring a conditional use at this time but not when the new church is built and the preschool continues is in a new location. Discussion amongst the Commissioners. Crook moves to approve CU-07-03 - Daycare Center (Pre-School Facility)- LaDawna C.
