The Planning and Zoning Commission met in regular session on June 2,2003, Vice-
Chairman Bloom presiding.

CALL TO ORDER:
ROLL CALL: The following members were present BANDY, BLOOM,
CROOK. Absent; DECKERS, CADWELL. A quorum is present.

CONSENT AGENDA:
A. Minutes of May 19, 2003
B. Findines of Fact and Conclusions of Law for CU-3-03 - Conditional Use
Permit for two portable classrooms at Eaele Middle School - Meridian Joint
School District No.2: Meridian Joint School District No.2, represented by Joe
Presher with Hutchison-Smith Architects, is requesting conditional use approval
to install two additional portable classroom buildings at Eagle Middle School.
The site is located on the north side of West Floating Feather Road approximately
1/2-mile west of North Eagle Road at 1000 West Floating Feather Road.
C. Findines of Fact and Conclusions of Law for FPUD-3-03 & PP-4-03 -
Final Development Plan and Final Plat for Two Rivers Subdivision
No.7 - T. R. Company LLC.: T. R. Company LLC, represented by Dan
Torfin, is requesting final development plan and final plat approval for Two
Rivers Subdivision No.7, a l6-lot (4-buildable, 12-common) residential
subdivision. This 12.95-acre phase of Quarter Circle Ranch PUD is located
on the west side of Eagle Road approximately l600-feet south of State
Highway 44.
D. Findines of Fact and Conclusions of Law for FPUD-6-03 & FP-4-03 -
Final Development Plan and Final Plat for Brookwood Subdivision No.
S Aries Development. LLC.: represented by Mike Hormaechea, is
requesting final development plan and final plat approval for Brookwood
Subdivision Phase 8, a 33-lot (30-buildable, 3-common) residential
subdivision. This 7 .1 I-acre phase of Brookwood PUD is located on the
north side of Floating Feather Road and west of Feather Nest Estates
Subdivision. The site is within the Eagle City Limits.
Bandy moves to approve the Consent Agenda as presented. Seconded by Crook.

A. ZOA-5-03 - The City of Eagle is proposing to amend Eagle City Code Title
9 "Subdivisions", Chapter 3 "Design Standards", Section 2 "Streets and
Alleys", Subsection 5 "Private Streets", to remove the provision for private
streets except in limited circumstances where existing conditions preclude
the feasibility for the dedication of public right-of-way. (This item was
continued from the May 19, 2003, Planning & Zoning meeting).
Bloom introduces the item.
Jeff Lowe, City Staff presents the staff report.
Discussion between Lowe and the Commissioners.
John McFadden, City Attorney addresses the question of allowing a gated street for
seniors only.
Bloom opens the public hearing.
Daniel West, a volunteer fire fighter testifies that he has been to four fires in which the
patient has had to wait before they could treat them because of the locked gates and
states it is a safety issue.
Jane Suggs, 200 Louisa St., Boise. Would like this to be on a case by case basis.
Bloom closes the public hearing.
Bandy is concerned about allowing gates.
Discussion between the Commission on allowing gates.
McFadden answers the question on having a fee for a gated community for emergency
vehicle/equipment to gain access.
Bandy moves to approve ZOA-5-03 with the following changes under 9-3-2-5
PRIV A TE STREETS; A. #3 strike the language from "in conjunction" to the end
of the sentence, "add to satisfy purposes of safety or traffic control". In addition
"all gates must have automatic electronic opening devices for the purpose of safety
vehicles and must not prohibit pedestrian traffic". Seconded by Bloom. ALL
A YE...MOTION CARRIES.
B. A-I-02 & R-1-03 - Annexation and Rezone - Donna Weston: Donna
Weston, represented by Roylance & Associates, is requesting an annexation
and rezone from RUT (Rural Urban Transitional) to R-4 (Residential - up
to four dwelling units per acre). The 5.03-acre site is located on the west
side of Horseshoe Bend Road approximately 1,150-feet south of Floating
Feather Road, at 10895 Horseshoe Bend Road

Jason Densmer with Roylance and Associates, 391 W. State St. Eagle. Mr. Desmer
representing the applicant presents the application.

Bloom opens the public hearing.
Erica Kline, 10557 W. Bucktail. Ms, Kline lives across the street and is more
concerned about how this parcel will be platted. Has concerns about how this will fit
into the rest of Eagle and because of these concerns is opposed to this rezone.
Diane Molinar, is representing neighbors that are contiguous to the proposed
application. Not sure if one parcel in the midst of other parcels that are not annexed in
is a good idea at this time. Is opposed to this application.
Harold Ferguson, 10753 Horseshoe Bend Road. Mr. Ferguson has lived at this location
for 35 years. Is concerned that this will lower the value of his property and is opposed
to this application.
Mr. Densmer provides a rebuttal. Mr. Densmer would like the sewer annexation
required prior to the final plat approval and not the preliminary plat. Regarding Ms.
Klines comments on the proposed layout. States that at this time there this is only a
concept plan and interconnectivity is at the top of the list. Addressing the non-
complying uses, the trailer is scheduled to be removed soon and the riding arena can be
removed at anytime.
Bloom closes the public hearing.
Bloom reopens the public hearing.
Bloom reads into the record the names of the individuals that signed letters opposing
this rezone and annexation.
Bloom closes the public hearing.
Bandy is concerned that this parcel will bisect this area around the site.
Bloom agrees that this area should be developed all at once instead of one at a time.
This application is ahead of its time and rezoning this to an R-4 is not appropriate at
this time.
Crook asks the question on making the decision to rezone and approve this annexation.
A recommendation should be made to the city council on the rezoning regarding this
parcel alone.
Discussion amongst the Commission.
Crook moves to deny A-1-02 & R-1-03 - Annexation and Rezone - Donna Weston
with the following reasons;
1. Development of a thin narrow strip would be a leap frogging and not the best
use of planning for that block.
2. Concerns with non compliance uses with Ada County.
3. The development of a long narrow strip.
Seconded by Bandy. ALL A YE...MOTION CARRIES.

Alderwood..Yillaee Su~on - Steve ß!!!.h. represented bv Jane
Suees: Steve Roth, represented by Jane Suggs, is requesting final
development plan and final plat approval for Alderwood Village
Subdivision, a 37-lot (31-residential, 6-common) subdivision. This 7.6-acre
(approximate) development is located on the south side of West State Street
approximately 1/2 mile west of Eagle Road, at 825 West State Street.
Bloom introduces the item
Jane Suggs, 200 Louisa Street, Boise. Ms. Suggs representing the applicant presents
the application. Ms. Suggs agrees with the staff report and presents a colored plan of
the house styles. Site specific condition #15 states that they will have the court
approval for the sewer and would like to change the wording of this.
Bloom asks if the neighbors concerns have been met regarding the landscaping and
their screening concerns. Ms. Suggs states that all neighboring concerns have been met.
Ms. Suggs stands to assure the Commission that they will pleased with the quality of
work from the developer Mr. Roth.
Crook moves to approve FPUD-6-03 & FP-8-03 - Final Development Plan and
Final Plat for Alderwood Village Subdivision - Steve Roth, represented by Jane
Suggs with staff recommendations and the site specific conditions of approval.
Seconded by Bandy. ALL A YE...MOTION CARRIES.
7. REPORTS: Commission: Bloom reports on the Oakley Subdivision and the
recent activity
Staff: Lowe presents various days to hold the special meeting for the Idaho Power
application, the 15th of July is chosen.
8. ADJOURNMENT: Bloom moved to adjourn at 8:35p.m. Seconded by
