EAGLE PLANNING AND ZONING COMMISSION

The Planning and Zoning Commission met in regular session on May 5, 2003 Chairman
Deckers presiding.

CALL TO ORDER:

ROLL CALL: The following members were present BANDY, BLOOM,
DECKERS, CADWELL, CROOK. A quorum is present.

CONSENT AGENDA:

Crook moves to approve the Consent Agenda as presented.
FOUR AYE (BLOOM abstained)...MOTION CARRIES.
4. OLD BUSINESS:

PUBLIC HEARINGS:
A. RZ-95 MOD 2 - RezonelDevelopment A2reement Modification - Hawkins
Companies: Hawkins Companies is requesting a modification to the development
agreement approved by the City in 1995 (developed as Eagle Country Plaza
Shopping Center - Eagle Market Place) to erect a monument sign to be shared with
the City of Eagle, and to allow the placement of one directional sign at each of two
entrances into the shopping center. The 7.5-acre site is located on the northeast
comer of Chinden Boulevard and Eagle Road at 3210 E. Chinden Boulevard.
(This item was continued from the April 28, 2003, Planning & Zoning Meeting).
Deckers introduces the item.
Brian Huffacre, 8645 W Franklin, Boise. Representing the applicant presents some additional
information on the proposed directional sign and monument sign.
Jeff Lowe, City Staff provides the Commission with additional wording to be placed in the
development agreement.
The public hearing is still open.
Teri Bath, is with the Eagle Chamber of Commerce, 67 State Street, residing at 1729 Widby
Lane, Eagle. Ms. Bath spoke with the tenants of the Eagle Market Place today and all were in
agreement that the signage is not significant for the shopping center. They would like to see a
major tenant in the shopping center to bring more people into this center. Ms. Bath states the
entrance way signs were very expensive to place at the intersections into Eagle and this
proposal would be an inexpensive way to get another Eagle entrance sign. This is a difficult
area for signage with all the landscape requirements and this site could use additional signage.

Discussion between Ms. Bath and the Commissioners.
Kolby Hawker, is the development manager with Hawkins Company states that they have
worked with Walgreen's for the last two years. Walgreen's originally turned the location down
but are now willing to take another look at this site but they have two concerns. The visibility
and the speeds along this intersection are the two main concerns. Mr. Hawker states that he
signs will meet city code and that Walgreen's definitely needs the directional signs.
Mr. Huffacre stands again to speak once more about the sign designs.
Deckers closes the public hearing. ..
Crook is comfortable with the new verbiage that Jeff Lowe provided for the development
agreement. He has no concern with co branding and is comfortable with the two directional
signs. The tenant portion of the signs should be limited to City Code. Crook states that the
city part of the sign should have an exception to the code.
Cadwell does not feel that the additional signs will be the answer to the problem because the
center was poorly designs from the beginning. Does not think it is the Commission's job to
look decide the design but to leave that for the Design review Board.
Bloom feels the signs are O.K. and is in agreement with the new verbiage for the development
agreement. States that this shopping center was over landscaped.
Bandy is comfortable with what is proposed but is still uncomfortable with co branding.
Deckers is not comfortable with co branding. Deckers states that he likes figure 2 from the
photos that were presented by the applicant. Was concerned about sign overload but does not
see this as being a problem now.
Kolby stands to answer Crooks question on the location of the directional sign at the west
entrance.
Discussion amongst the Commission.
Deckers has several comments on the fabrication of the sign, P & Z prefers the sign style
depicted in figure 2 for the following reasons, the archway style in figure I too closely
resembles the style of the Eagle gateway sign. The sign style in figure 1 looks too much like a
billboard The sign style in figure 2 would be attractive and useful even without the Walgreen's
logo. The P & Z Commission recommends that the city does not attempt to share an entry way
sign with Walgreen's and co locating will appear to much like the city endorsing a specific
commercial building since there may be future tenants in which the city would be embarrassed
to be co locating a sign with.
Deckers moves to approve RZ-95 MOD 2 - RezonelDevelopment Agreement
Modification - Hawkins Companies with the change in language to 3.2.3.1 we accept the
staffs April 29, 2003, with the modifications discussed above. 3.2.3.2 shall also be
modified as specified previously, the details of the rock wall and fencing removal will be
deferred to Design Review details of the tree removal inside the berm the Planning
&Zoning Commission will defer to the Design Review Board. Seconded by Crook.

Discussion. Deckers adds to the motion; "the commission is concerned about
collocating". ALL AYE...MOTION CARRIES.
B. ZOA-4-03 - Shawn Nord: Shawn Nord is proposing to amend Eagle City Code
Title 8 "Zoning", Chapter 2 "Zoning Districts and Map", Section 3 "Official
Schedule of District Regulations"; Amending Eagle City Code Title 8 "Zoning",
Chapter 3 "Performance Standards", Section 5 "Unique Land Uses", Subsection L
"Home Occupation", to define an additional classification for home occupation
uses and to permit said class of home occupation uses to be located in certain
zoning districts through the approval of a conditional use permit.
Cadwell recuses himself from this application.
Deckers introduces the item.
Shawn Nord, 5337 State Street, Eagle, the applicant presents the application. Mr. Nord is a
chiropractor with a current practice located in Eagle and has been looking for a site to own
instead of leasing. Mr. Nord states that having a home based business would allow more
flexibility.
Jeff Lowe, City Staff presents the staff report.
Deckers opens the public hearing.
Mark Butler, 52 N. 2nd Street, Eagle. Mr. Butler, a friend of the applicant states that Eagle is
more inclined to accept home applications but these sites must still conform to Eagle City Code
in regards to noise, access, etc. Mr. Butler states that this will not be a simple process and the
conditional use permit will enable the city to have control over the proposed home occupation.
Discussion amongst the Commission.
Crook moves to approve ZOA-4-03 - Shawn Nord with the alterations that we have
discussed. (Under Home Occupation Class 1 #b. The use of the dwelling unit for the
home occupation shall be the lesser of 25% or 7500') Seconded by Bandy. Discussion.
FOUR AYE (CADWELL ABSENT)...MOTION CARRIES.
6.
NEW BUSINESS:
A. FPUD-2-03 & FP-3-03 - Final Development Plan and Final Plat for Two
Rivers Subdivision No.6 - T. R. Company LLC: represented by Dan Torfin T.
R. Company LLC, is requesting final development plan and final plat approval for
Two Rivers Subdivision No.6, a 50-lot (38-buildable, 12-common) residential
subdivision. This 12.50-acre phase of Quarter Circle Ranch PUD is located on the
west side of Eagle Road approximately 1600-feet south of State Highway 44.
Deckers introduces the item.
Dan Tornn, representing the applicant presents the application.
Jeff Lowe, City Staff presents the staff report.
Torfin stands to address Deckers question on what size homes will be built in this phase?
