EAGLE PLANNING AND ZONING COMMISSION
March 03, 2003

The Planning and Zoning Commission met in regular session on March 3, 2003, Vice-
Chairman Bloom presiding.
1.
CALL TO ORDER: At 6:42 p.m.
2.
ROLL CALL: The following members were present BANDY, BLOOM,
CADWELL, CROOK. Absent: DECKERS. A quorum is present.

CONSENT AGENDA:
A. Minutes of February 18, 2003
B. Findines of Fact and Conclusions of Law for CU-ll-02 - Dale R.
Chesnut: Dale R. Chesnut is requesting conditional use approval to allow a
mobile home occupied by a family member to continue to be located upon a
lot in which a single-family dwelling already exists.
Cadwell moves to approve the Consent Agenda of February 18, 2003, as
presented. Seconded by Bandy. ALL A YE...MOTION CARRIES.

PUBLIC HEARINGS:
A. CU-1-03 - Conditional Use Permit for a Restaurant with drive thru
service - Eaele River LLC: Eagle River LLC, represented by Billy Ray
Strite with BRS Architects, is requesting conditional use approval to
construct a restaurant with drive thru service. The .95-acre site is generally
located on the southeast comer of Eagle Road and Eagle River Street.
Bloom introduces the item.
Clinton Yacca, with BRS architects presents the application and states that they concur
with the staff recommendations and will comply with any requirements.
Jeff Lowe, City Staff presents the staff report. Discussion on the landscaping and
screening around the drive thru and the noise level created by the intercom system.
Discussion between the Commission and Staff on the light mitigation along Eagle
Road.
Mr. Yacca stands for a rebuttal and clarifies the amount of feet between the berm and
road.

Crook, Cadwell and Bandy all support this application.
Bloom would like the applicant to work with the Design Review on the shrub selection
and have other alternatives besides using predominately Arborvitae. Also verify the
hours of operation for the drive-thru before this application goes to City Council.
Cadwell moves to approve CU-1-03 - Conditional Use Permit for a Restaurant
with drive thru service - Eagle River LLC with staff recommendations and
standard conditions of approval. Seconded by Crook. ALL A YE...MOTION
CARRIES.
6. NEW BUSINESS: None
7. REPORTS: City Staff Jeff Lowe reports on the conditional use permit for
Idaho Power and the request to hire outside consultants of which three have responded.
Discussion on items for the Joint Meeting on March 31.
Bloom reports that she has been working with Bill Vaughan on code enforcement issues
and will be sending home owner associations a letter regarding common area
landscaping and maintenance.
8. ADJOURNMENT: Crook moved to adjourn at 7:18 p.m. Seconded by
