EAGLE PLANNING AND ZONING COMMISSION
February 18, 2003

The Planning and Zoning Commission met in regular session on February 18,2003. Chairman
Deckers presiding.

CALL TO ORDER:

ROLL CALL: The following members were present BANDY, BLOOM, DECKERS,
CADWELL, CROOK. A quorum is present.

CONSENT AGENDA:
A. Minutes of February 3,2003
B. V AC-l-03 - Vacation to the final plat of Eatdecrest Subdivision No.2 - Asin
Homes LLC: Asin Homes LLC, represented by Kent Brown with Briggs
Engineering Inc., is requesting City approval to vacate a turnaround access
easement within Eaglecrest Subdivision No.2. The turnaround easement is located
on Lots 41 and 42, Block 1, approximately ISO-feet north ofthe intersection of East
Campsite Lane and East Eagle Creek Lane.
C. Findint!s of Fact and Conclusions of Law for A-2-02 & RZ-2-02 - Annexation
and Rezone from RUT to R-2 - Larry Flynn: Larry Flynn, represented by Brian
Flynn with Rocky Mountain Engineering and Surveying, is requesting an
annexation and rezone from RUT (Rural Urban Transitional) to R-2 (Residential -
up to two dwelling units per acre). The 36-acre site is generally located
approximately Y2 mile east of Eagle Road at 736 East Riverchase Way.
D. Findint!s of Fact and Conclusions of Law for PP-3-O2 - Hidden Island
Subdivision - Larry Flynn: Larry Flynn, represented by Brian Flynn with Rocky
Mountain Engineering & Surveying, is requesting preliminary plat approval for
Hidden Island Subdivision. The 36-acre, 12-lot (I I-buildable) residential
subdivision is generally located Y2 mile east of Eagle Road and east of Island
Woods Subdivision.
E. Findint!s of Fact and Conclusions of Law for FPUD-S-02 & FP-1S-02 - Final
Development Plan and Final Plat for Brookwood Subdivision No.7 - Aries
Development LLC: Aries Development, LLC., represented by Mike Hormaechea,
is requesting fmal development plan and fmal plat approval for Brookwood
Subdivision Phase 7, a 63-10t (48-buildable, IS-common) residential subdivision.
This 41.87-acre phase of Brookwood PUD is located on the north side of Floating
Feather Road and west of Feather Nest Estates Subdivision. The site is within the
Eagle City Limits.
Deckers requests all items be removed from the Consent Agenda.
A. Minutes of Februarv 3. 2003
Deckers would like additional discussion language added on page 4 adding "Move common area
to the east. Adjacent to Rivers End open space common area adjacent to greenbelt shall permit
public access." Also adding discussion language on page 5 "This is an off peak usage and thus
does not add to the weekday traffic problem on Chinden. Land on both side of Meridian Road

loading up to the proposed church site ITom Chinden is undeveloped. When that land develops
sidewalks will be installed. This will make for safe pedestrian travel, even with the added church
traffic." Deckers notes a spelling error on page 5, and on page 6, 1) should read "Concur with
staff with the removal adàitiOR. . . ".
Deckers moves to approve the minutes of February 3, 2003 as amended. Bandy seconds.

B. V AC-I-O3 - Vacation to the final plat of E8!!lecrest Subdivision No.2 - Asin Homes
LLC: Asin Homes LLC, represented by Kent Brown with Briggs Engineering Inc., is requesting
City approval to vacate a turnaround access easement within Eaglecrest Subdivision No.2. The
turnaround easement is located on Lots 41 and 42, Block 1, approximately ISO-feet north of the
intersection of East Campsite Lane and East Eagle Creek Lane.
Deckers expresses his concern would like an additional condition adding required signage stating
that parking in the turnaround is prohibited. Discussion.
Deckers moves to approve V AC-I-O3 Vacation to the final plat ofEaglecrest Subdivision
No.2 with staff recommendations and the additional language discussed tonight. Seconded
by Bloom. ALL A YE...MOTION CARRIES.
C. FindiD2s of Fact and Conclusions of Law for A-2-O2 & HZ-2-02 - Annexation and

Deckers moves to approve the Findings of Fact and Conclusions of Law for A-2-02 & HZ-
2-02 Annexation and Rezone from RUT to R-2 with stall's recommendations and striking
commercial from the last line of #3 conditions of law. Seconded by Bandy. FOUR
AYE...ONE ABSTAIN (BLOOM) MOTION CARRIES.

A. CU-ll-O2 - Dale R. Chesnut: Dale R. Chesnut is requesting conditional use approval to
allow a mobile home occupied by a family member to continue to be located upon a lot in which
a single-family dwelling already exists.

Deckers introduces the item.
Deckers opens the public hearing.
Dale R. Chestnut, 2054 Syringa Eagle, Idaho. Mr. Chestnut briefly reviews the application.
Mr. Chestnut concurs with the conditions in the staff report.
Jeff Lowe, City Staff, reviews the staff report.
Deckers closes the public hearing.
Discussion amongst the Commission.
Cadwell moves to approve CU-ll-02 Dale R. Chestnut with the conditions in the staff
report. Seconded by Bloom. ALL A YE...MOTION CARRIES.
7. NEW BUSINESS:
A. City Attorney, John McFadden will discuss the public hearing process and ethics in
government.
Mr. McFadden reviews Idaho State Code regarding ex parte contact, conflict of interest, code of
ethics and other items.
Discussion amongst the Commission regarding the February 3rd meeting and the Commissions
actions that evening.
