The Planning and Zoning Commission met in regular session on November 18, 2002 Chairman Franden presiding. 1. CALL TO ORDER: 2. ROLL CALL: The following members were present FRANDEN, NORDSTROM, CROOK. Absent: BLOOM, CADWELL. A quorum is present. 3. CONSENT AGENDA: A. Minutes of November 13, 2002. Nordstrom moves to approve the Consent Agenda of November 18, 2002, as presented. Seconded by Crook. ALL AYE.. .MOTION CARRIES 4. OLD BUSINESS: None Bloom arrived at 6:33. 5. PUBLIC HEARINGS: A. CPA-~-02 - Impact Area Boundarv chaDi!:e and Comprehensive Plan Amendment - The Citv of Ea2le: The City of Eagle is proposing to amend the Area of Impact Boundary and is proposing to amend the Comprehensive Plan to include new land use designations on the Land Use Map and to make changes to the text within the plan. Franden introduces the item. Bill Vaughan, City Staff presents the staff report. Mr. Vaughan describes the Impact Area Boundary change and the Comprehensive Plan Amendment and also discusses the need to define Public/Semi-Public with definitions for Golf Courses, Parks, State Park, Greenway, Schools, Fire Stations, and Cemetery. Franden opens the public hearing. Vaughan asks the Commission to continue this item so he can provide definitions of the above to another hearing. Nordstrom moves to continue CPA-I-02 - Impact Area Boundary change and Comprehensive Plan Amendment - The City of Eagle to December 2, 2002. Seconded by Bloom. ALL A YE...MOTION CARRIES. B. CPA-2-02 - Jmpact Area Boundarv Adiustment and Comprehensive Plan Amendment - Bob and Laree Van Treeck: Bob and Laree Van Treeck, represented by Land Consultants, Inc., are requesting a westerly Page 1 of 5 K:\P&ZIMINUTES\Temporary Minutes Work Area\PZ-11-18-02 miI1.doc expansion to the City's Impact Area Boundary to include the 2.03-acre site located on the southwest corner of State Highway 44 and Linder Road at 201 Linder Road. The applicant is also requesting a Comprehensive Plan Amendment to include the site into the City's Land Use Map as Commercial. Franden introduces the item. Mark Butler, 52 N. 2nd Street, Eagle. Mr. Butler representing the applicant presents the application. Mr. Butler states that the Van Treeck's would like to be annexed into the City of Eagle. Jeff Lowe, City Staff, presents the staff report. Franden opens the public hearing. Gale Schenk, 410 N. Linder Road Eagle, lives diagonally across from the parcel and is in favor of this proposal. Traffic is the major reason for the commercial zoning, does not believe it is suitable for residential. Elaine Hull, 4648 West Old Valley Road. The character of this area has changed in the last few years. This is now a dangerous area due to the high amount of traffic. Is in favor of changing this area to a commercial zoning designation. Crook would like to change the verbiage of site specific condition #2. Thinks that this area would be suitable for some types of commercial development. Bloom and Nordstrom are both concerned about the stacking of traffic in this area. Bloom moves to continue CPA-2-02 - Impact Area Boundary Adjustment and Comprehensive Plan Amendment - Bob and Laree Van Treeck to December 2, 2002. Seconded by Nordstrom. ALL A YE...MOTION CARRIES. C. CPA-3-02/RZ-4-02 Comprehensive Plan Amendment from Residential Four to Mixed Use and Rezone from R-4 to MU-DA: Jayo Construction Inc., represented by Doug Jayo, is proposing a Comprehensive Plan Amendment to change the land use designation on the Comprehensi ve Plan Land Use Map from Residential Four (up to four dwelling units per acre) to Mixed Use, and a rezone from R-4 (Residential - up to four dwelling units per acre) to MU-DA (Mixed Use with Development Agreement). The site is located on the south side of Floating Feather Road approximately 250-feet west of Eagle Road, at 135 Floating Feather Road. Franden introduces the item. Doug Jayo, 1323 S. Five Mile Road, Boise, the applicant presents the application. Jeff Lowe, City Staff presents the application. Pranden opens the public hearing. Russ Butcher, 235 W. Floating Feather Road. Mr. Butcher is not opposed to changing this to an office site but is concerned it is a more extensive project than anticipated. Is also concerned about this being in the flood way and the owner needs to be aware of the possibility of flooding. Would like a strict development agreement, and only down shielded lighting. Mr. Butcher would also like to increase the time that the public hearing signs are required to be posted. Doug Jayo does not provide a rebuttal. Vaughan would like the Commission to consider changing the zoning designation along the northwest section of Eagle Road, because of all the interest from the public inquiring about this area. Nordstrom states that it was never the intention to place a commercial property on the corners of residential areas. Bloom states that this area will need a strict development agreement placed upon this parcel. Crook asks a question of Mr. Jayo. Was this parcel included in the plat for Clear Creek Crossing? Mr. Jayo stands to address this question, states there was economic reasons for this decision. Also states that some of the berm will be used for fill in the existing hole. City Attorney John McFadden discusses what would happen with this application if it was denied tonight. Nordstrom moves to continue CPA-3-02/RZ-4-02 - Comprehensive Plan Amendment from Residential Four to Mixed Use and Rezone from R-4 to MU-DA to December 2, 2002. CPA-4-02/A-3-02/RZ-5-02 - Comprehensive Plan Amendment from Residential Two to Mixed Use/Annexation and Rezone from RUT to MU-DA (Mixed Use with Development Aereement and Rezone from R- 2 to MU-DA (~ Use with ~opment A2reement): B.W. Eagle, Inc., represented by Dan Torfin, is requesting a Comprehensive Plan Amendment to change the land use designation on the Comprehensive Plan Land Use Map from Residential Two (up to two dwelling units per acre) to Mixed Use, an annexation and rezone from RUT (Rural Urban Transitional) to MU-DA (Mixed Use with Development Agreement) and a rezone from R-2 (Residential-up to two dwelling units per acre) to MU-DA (Mixed Use with Development Agreement). The site is located on the east side of Eagle Road approximately WOO-feet north of Chinden Boulevard. Franden introduces the item D. Dan Torfin, 250 S. Beechwood Boise, Idaho. Mr. Torfin representing the applicant presents the application. Mr. Torfin uses several colored overheads to show recent development in the area of Eagle Road which he believes is a justification for a change to the Comprehensive Plan. Mr. Lindley is opposed to the rezone and would like to keep this parcel zoned R-2. Is concerned about future development and the location of the traffic signals. Bob Van Art, 3049 S. Lightpost Way, Eagle. Is opposed to any development that increases the density and traffic in this area. Instead of looking at this as an isolated development we need to look at all the development as a whole. Before any more development takes place the traffic issues need to be addressed Ken Olmberg 230 S. Whitepost Way Banbury, Eagle. Moved to this area because of the residential community. Does not feel we need anymore commercial development in this area. Mr. Olmberg feels there is a safety concern at this time. Jim Lide, 3410 E. Chinden Boulevard. Before moving to this area he looked at several different areas and this proposal changes the reason he moved to Eagle and is opposed to this development Wayne Field 3970 E. Chinden. Mr. Fields lives next to the proposed road that would exit onto Chinden and thinks this will provide more traffic challenges. Is also concerned about the loss of his view. Michelle Hitch, S. Lake Moor Way, Island Woods, Eagle. Ms. Hitch is mainly concerned about another development next to her residential neighbor and thinks the City should wait to see what impact the other commercial developments will have on this area. A historical city should not have more roads and commercial development. Jason Carter 259 West Oak Hampton, Eagle. Lives across from the development and is worried about the access onto Eagle Road. Is concerned about a new entrance across from him. Would like to see a single access with a light. Dan Torfin provides a rebuttal. Mr. Torfin would like to address the traffic issues. Pat Dobey, 777 Hotstone Drive, Boise. Mr. Dobey provided the traffic report for this proposal, and explains the traffic issues to the Commission. Mr. Torfin clarifies several issues of the commercial aspect. States that this project will not compete with the retail stores already in place. Discussion amongst the Commission. Bloom would like to keep this application a PUD. Bloom moves to continue CPA-4-02/A-3-02/RZ-5-02 - Comprehensive Plan Amendment from Residential Two to Mixed Use/Annexation and Rezone from RUT to MU-DA (Mixed Use with Development Agreement and Rezone from R-2 to MU-DA (Mixed Use with Development Agreement) to December 16, 2002. LLC.: Briar Creek LLC, represented by Land Consultants, Inc., are requesting a westerly expansion to the City's Impact Area Boundary to include the 14-acre site is located approximately 1200-feet north of State Highway 44 at 767 N. Linder Road. The applicant is also requesting a Comprehensive Plan Amendment to include the site into the City's Land Use Map as Residential Two (up to two dwelling units per acre ).
