CALL TO ORDER: 2. ROLL CALL: The following members were present FRANDEN, BLOOM, NORDSTROM, CADWELL, Absent: CROOK. A quorum is present. CONSENT AGENDA: A. Minutes of October 28, 2002 B. Findine:s of Fact and Conclusions of Law for PPIFP-4-02 - Mixed Use Subdivision No.4 - Eae:le River LLC: Eagle River LLC, represented by Bill Clark with Clark Development, is requesting combined preliminary plat and final plat approval for Mixed Use Subdivision No.4 (a.k.a. Eagle River Development). The 1O.62-acre, 10-lot commercial subdivision is generally located on the southeast comer of Eagle Road and State Highway 44. Nordstrom moves to approve the Consent Agenda as presented. Seconded by Cadwell (Bloom abstained). ALL A YE...MOTION CARRIES. 4. OLD BUSINESS: 3. 5. PUBLIC HEARINGS: A. CU-I0-02/PPUD-3-02/PP-6-02 - Alderwood VilIa2e Planned Unit Development: JU Enterprises, Inc., represented by Jane B. Suggs, is requesting conditional use, preliminary planned unit development, and preliminary plat approvals for Alderwood Village Subdivision, a planned residential development. The 7.6-acre, 37 -lot (3 I-residential, 6-common) subdivision is located on the south side of West State Street approximately 1/2 mile west of Eagle Road, at 825 West State Street. (This item was continued from the October 28, 2002, Planning & Zoning Meeting) Franden introduces the item. Jane Suggs, 200 Louisa Street, Boise, representing the applicant presents the application. Jeff Lowe, City Staff presents the staff report. Franden opens the public hearing Lynn Mathy, 701 W. Cowman Court, Eagle. Has no problem with this development but is concerned about the cedar fence stopping short and not going all the way to the highway, her livestock and children could be at danger. Would like to see metal poles used in the construction of the fence. Katie Murphy, 774 W. Aikens Court, Eagle. Ms. Murphy is also concerned about the amount of traffic coming that close to the property line. Would like the house removed and the road relocated so it does not run as close to her property line. Bob Batista, 775 W. Aikens Court, Eagle. Has concerns about the trees being removed and would also like to see the house removed and the road relocated to protect the adjoining homeowners privacy. Doug Newbrand, 655 Cowman Court, Eagle. Would like to know if a second access will be required on to State Street. Franden closes the public hearing. Jane Suggs provides a rebuttal. Ms. Suggs agrees that the fence line should be extended. Would like to work with the neighbor to provide some sort of buffer to screen the neighbors privacy without removing the existing house or changing the road location. Commission asks questions of the applicant. Nordstrom would like to consider this application carefully Cadwell likes this project and thinks it is important to extend the fence. Franden is also pleased with the application and the higher density this will create in the downtown area. Bloom is concerned with the irrigation levels. Bloom is also concerned about the density and does not want to approve the extra lot. Suggs stands to address Frandens question regarding the irrigation system. Nordstrom would like to go over each site specific condition. Bloom asks Ransom Bailey, City Attorney to address the access easements. Discussion amongst the Commissioners and Lowe on each site specific condition. Nordstrom moves to approve CU-I0-02/PPUD-3-02/PP-6-02 - Alderwood Village Planned Unit Development with staff recommendations and site specific conditions and standard conditions of approval with the following additions or changes: Bloom leaves at 8:00 p.m. Ssc #2 Change 31' to 29' Ssc #8 Add language from Eagle City Code. Ssc #11 Strike "from unless the Council approves" to the end of the sentence. Ssc #18 Insert lots 4-7 Block 1, a 20' front set back. Ssc #19 Strike #2 & #3 Ssc #28 Jeff Lowe will change the wording. Ssc #30 The fencing on both the east and the west side will run entirely to the south of the parcel. #31 This subdivision must conform with the new irrigation rules and procedures. ZOA-7-02 - Mark Butler with Land Consultants Inc. is proposing to amend Eagle City Code Title 8, Chapter 2, Article A, Section 7 (K) (d), to provide a waiver clause to allow the Design Review Board discretion to approve a landscaping alternative to permit extensive landscaping to be installed in lieu of constructing a wall to shield views of parked cars within a parking lot from passing motorists and pedestrians, Franden introduces the item. Mark Butler, 52 N. 2nd Street, Eagle. Presents the proposed zoning ordinance amendment. Jeff Lowe, City Staff addresses Commissioners questions. Franden opens the public hearing Franden closes the public hearing Cadwell moves to approve ZOA-7-02. Seconded by Nordstrom. ALL A YE...MOTION CARRIES. 6. NEW BUSINESS: None 7. REPORTS: Lowe reminds the Commission of the special meeting for Idaho Power on November 13, 2002. 8. ADJOURNMENT: Nordstrom moved to adjourn at 8:15 p.m. Seconded by Cadwell.
