The Planning and Zoning Commission met in regular session on September 3,2002
Chairman Franden presiding.

CALL TO ORDER:

ROLL CALL: The following members were present FRANDEN, BLOOM,
NORDSTROM, CROOK. Absent, CADWELL A quorum is present.
CONSENT AGENDA:
A. Minutes of August 19,2002.
Nordstrom moves to approve the Consent Agenda of September 3, 2002, as
presented. Seconded by Bloom. ALL AYE.. .MOTION CARRIES.

PUBLIC HEARINGS:
A. RZ-I0-98/CU-9-98/PPUD-2-98/PP-8-98 MOD - Modification to uarter
Circle ß!m£.h Planne4 Unit Development (now calledJwo Rivers) -T.
R. Company: T. R. Company LLC, represented by Dan Torfin, is requesting
a rezone from A & A-R (Agricultural & Agricultural-Residential) to R-2-P
(Residential two units per acre maximum -PUD) and a modification to the
conditional use, preliminary development plan, and preliminary plat for
Quarter Circle Ranch (now called Two Rivers) planned unit development.
The modification consists of adding 6.97-acres and 24-lots (16-buildable; 8-
common) to the previously approved 237-acre PUD. The site is generally
located on the west side of Eagle Road approximately 1600-feet south of
Island Woods Drive. (This item will be continued until the September 16,
2002, Planning & Zoning Meeting).
Bloom moves to continue RZ-I0-98/CU-9-98/PPUD-2-98/PP-8-98 MOD-
Modification to Quarter Circle Ranch Planned Unit Development (now called Two
Rivers) -T. R. Company to the September 16,2002, Planning & Zoning
Commission meeting. Seconded by Crook. ALL A YE...MOTION CARRIES.
B. CU-8-02 - North Star Charter School- Cavallo. L.L.C.: North Star
Charter School, represented by Gale Pooley, is requesting conditional use
approval for a new school facility. The site is generally located on the east
side of Park Lane approximately 350 feet north of Floating Feather Road.
Franden introduces the item and opens the public hearing.

Gale Pooley, 5713 N Hillhaven Place, Star, representing the applicant introduces
himself and states that Mark Butler will present the application.
Mark Butler, 52 N. 2nd Street, Eagle, will present the application. Mr. Butler agrees
with the staff report except on site specific #4. Instead of one member of the Design
Review Board they will need to meet with all members.
Mr. Pooley stands to address the Commissioners questions regarding the school.
Jeff Lowe, city staff presents the staff report. Mr. Lowe states that he mistakenly called
the charter school a private school.
Barb Cerda, city staff stands to answer the Commissioners question on the landscape
and berm requirements for the church and the Cavallo Subdivision.
Both Mr. Butler and Mr. Pooley stand to address the questions on the school being
public or private. Mr. Pooley gives a brief history of a charter school.
John McFadden, city attorney answers additional Commission questions.
Franden closes the public hearing.
Discussion amongst the Commission.
Nordstrom moves to approve CU-8-02 - North Star Charter School - Cavallo,
L.L.C with staff recommendations with the following changes:
Ssc #1 Strike the word private, and put in charter.
Ssc #4 After first sentence; Landscaping to match what has been approved at the
church so it matches Park Lane.
Ssc #6 add 35 feet in height.
Add ssc #11 Applicant is responsible to provide a copy of approval from the
Meridian School District. Seconded by Bloom. Discussion. Nordstrom amends
his motion to change site specific condition #4 instead of #5 as previously stated.
Change the wording from substantial compliance to compatible with Cavallo
estates Subdivision.. ALL A YE...MOTION CARRIES.
C. ZOA-4-02 - John and Debbie Cammann: The applicant is proposing to
amend Eagle City Code 8-3-5-(A) to permit an accessory building to be built
upon a parcel wherein no principal structure is existent upon said parcel, and
owned in combination under single ownership with a parcel immediately
adjacent to the parcel upon which the accessory building is to be
constructed.
Franden introduces the item and opens the public hearing.
John Cammann, 2965 W, Timber Creek, Eagle, the applicant presents the application.
Jeff Lowe, city staff explains the reason why the applicant had to do a ZOA instead of a
variance or a lot line adjustment.

Discussion.
Mr. Cammann stands to address the question on whether he has sought legal council.
Franden moves to deny ZOA-4-02 - John and Debbie Cammann for the reason
that this is a bad precedence to set this should go to council and the applicant
shall seek legal council. Seconded by Bloom. Discussion. ALL A YE...MOTION
CARRIES.
NEW BUSINESS:
A. FPUD-4-02 & FP-12-02 - Final Development Plan and Final Plat for
Two Rivers No.5 Subdivision - T. R. Company LLC.: T. R. Company
LLC, represented by Dan Torfin, is requesting final development plan and
final plat approval for Two Rivers No.5 Subdivision, a 47-lot (38-buildable,
9-common) residential subdivision. This 20.82-acre phase of Quarter Circle
Ranch PUD is located on the west side of Eagle Road approximately 1600-
feet south of State Highway 44.
Franden in introduces the item.
Dan Torfin, representing the applicant presents the applicant.
Jeff Lowe, city staff presents the staff report.
Mr. Torfin stands to address the new light which has been proposed on Eagle Road.
Between Island Woods and Two rivers Subdivision.
Nordstrom moves to approve FPUD-4-02 & FP-12-02 - Final Development Plan
and Final Plat for Two Rivers No.5 Subdivision - T. R. Company LLC. with staff
recommendations. Seconded by Crook. ALL A YE...MOTION CARRIES..
7. REPORTS: Bloom discusses with Ms. Cerda the issue of dead trees.
