EAGLE PLANNING AND ZONING COMMISSION

The Planning and Zoning Commission met in regular session on August 5, 2002 Chairman
Franden presiding.

CALL TO ORDER:
ROLL CALL: The following members were present FRANDEN, BLOOM,
NORDSTROM, CROOK. Absent: BLOOM, CADWELL. A quorum is present.

CONSENT AGENDA:
A. Minutes of July 15, 2002
B. Findines of Fact and Conclusions of Law for CU-S-02/PPUD-I-02/PP-2-02 -
Cottonwood Creek Planned Unit Development - Cottonwood Creek Joint
Venture LLC.: Cottonwood Creek Joint Venture LLC, represented by Land
Consultants Inc., is requesting a conditional use, preliminary development plan,
and preliminary plat approvals for Cottonwood Creek Subdivision, a planned
residential/office development. The 13.66-acre, 26-lot (I5-residential, 6-
commercial, 5-common) subdivision is located on the west side of Eagle Road
approximately 3/4 mile north of Chinden Boulevard, at 2421 North Eagle Road.
Nordstrom moves to approve the Consent Agenda as presented. Seconded by Crook.
ALL A YE...MOTION CARRIES.

PUBLIC HEARINGS:
A. CU-6-02 - Heie:ht Exception for Eaele City Hall - City of Eae:le: The City of
Eagle is requesting conditional use approval for a portion of the Eagle City Hall
building to be 40-feet high. The height exception (the portion of the building
above 35-feet) is for the purpose of installing a light monitor and is comprised of
one-percent (1 %) of the total floor area of the building. The site is generally
located on the northeast comer of State Street and Stierman Way (Lots 6 and 7,
Block 1 of Aquila Subdivision).
Franden introduces the item.
Jeff Lowe, City Staff presents the staff report.
Tom Zabala, with ZGA Architects, 565 W. Myrtle Street, Boise, agrees with the staff report.
States that he has worked closely with the mayor and city council on this design.
Franden open the public hearing.
Franden closes the public hearing.
Crook moves to approve CU-6-02 - Height Exception for Eagle City Hall- City of Eagle
as proposed. Seconded by Nordstrom. ALL AYE... MOTION CARRIES.
B. ZOA-3-02 - Zonine Ordinance Amendment - Land Consultants Inc.: Mark
Butler, representing Land Consultants Inc., is requesting to amend Eagle City Code
Title 8 "Subdivisions", Chapter 2 "Zoning Districts and Map", Article A "DR

Design Review Overlay District'. Section 6 "Design Guidelines, Objectives and
Considerations", Subsection B "Downtown Development Area", Item 2C "Other
Floor Options"; Subsection C "Transitional Development Area", Item 2C "Other
Floor Options".
Franden introduces the item.
Shawn Nickels with Land Consultants representing the applicant presents the application. The
idea is to incorporate an apartment into an office building.
Jeff Lowe, City Staff presents the staff report. Staff feels this would be most appropriate as
long as it does not exceed two units.

Nordstrom moves to approve ZOA-3-02 - Zoning Ordinance Amendment - Land
Consultants Inc., as proposed in the staff version. Include underlined statement; except
that apartments (not exceedine: two-units) on floors other than e:round floors apartment
shall be a permitted use. Seconded by Crook. ALL AYE... MOTION CARRIES.

NEW BUSINESS: None
7. REPORTS: Staff: Lowe reports on discussion with Nordstrom and City Engineer
regarding pressurized irrigation. Discussion.
8. ADJOURNMENT: Crook moved to adjourn at 7:06 p.m. Seconded by
Nordstrom. ALL A YE...MOTION CARRIES...
