EAGLE PLANNING AND ZONING COMMISSION
July 15, 2002

The Planning and Zoning Commission met in regular session on July 15,2002
Chairman Franden presiding.

CALL TO ORDER:

ROLL CALL: The following members were present FRANDEN, BLOOM,
NORDSTROM, CADWELL, CROOK. A quorum is present.

CONSENT AGENDA:
A. Minutes of July 1,2002
B. Findin2s of Fact and Conclusions of Law for CU-04-02 - One Portable
Classroom for Ea Ie Hills Elementar School - Meridian oint School
District No.2: Meridian Joint School District No.2, represented by
Leatham -Krohn - Van Ocker Architects, is requesting conditiona~ use
approval to install one divided portable classroom building at Eagle Hills
Elementary School. The site is located on Ranch Drive approximately 1/2-
mile east of North Eagle Road at 650 Ranch Drive.
C. Findin2s of Fact and Conclusions of Law for FPUD-3-02 & FP-9-02 -
Final Development Plan and Final Plat for Brookwood Subdivision
No.6: Aries Development, LLC, represented by Mike Hormaechea, is
requesting final development plan and final plat approval for Brookwood
Subdivision No.6, a 48-lot (40-buildable, 8-common) residential
subdivision. This 16.74-acre (approx.) phase of Brookwood PUD is located
on the north side of Floating Feather Road and west of Feather Nest Estates
Subdivision. The site is within the Eagle City Limits.
Nordstrom moves to approve the Consent Agenda of July 15, 2002 as presented.
Seconded by Cadwell (Bloom, Crook abstained). ALL A YE...MOTION
CARRIES

PUBLIC HEARINGS:
A. CU-5-02/PPUD-I-02/PP-2-02 - Cottonwood Creek Planned Unit
Development: Cottonwood Creek Joint Venture LLC., represented by Land
Consultants Inc., is requesting a conditional use, preliminary development
plan, and preliminary plat approvals for Cottonwood Creek Subdivision, a
planned residential/office development. The 13.66-acre, 26-lot (15-
residential, 6-commercial, 5-common) subdivision is located on the west

side of Eagle Road approximately 3/4 mile north of Chinden Boulevard, at
2421 North Eagle Road.
Franden introduces the item and opens the public hearing.
Don Knickrehm, 1403 Mace Road, Eagle, one of the applicants presents the
application. This item came before the P & Z Commission as a Comp Plan
amendment. It was heard by the Design Review Board last week and was approved
Jeff Lowe, city staff presents the staff report. Mr. Lowe reviews the site specific
conditions that Mr. Knickrehm had some concerns with.
Discussion between the Commission and Mr. Lowe regarding the proposed pathway
and interconnectivity between this subdivision and Streamside subdivision.
Mr. Knickrehm provides a rebuttal.
Franden closes the public hearing.
Nordstrom is supportive of this application.
Bloom states she also likes the plan. Not sure how to solve the pathway issue.
Franden would like to add that the pathway option stays open, keep the easement and
grass it is at this time.
Cadwell is concerned about the pathway being in a sewer easement. John McFadden,
City Attorney answers this question by stating there is not a problem with locating a
pathway in a sewer easement.
Crook is concerned that putting a bridge over the slough would but a financial burden
on the city, but also agrees with the interconnectivity.
Bloom moves to approve CU-5-02/PPUD-I-02/PP-2-02 - Cottonwood Creek
Planned Unit Development with staff recommendations and site specific conditions
with the following additions to the site specific conditions:
. #3 the applicant shall comply with the fire department letter dated, July 15,
2002.
. #4 place a period before the word UNLESS and strike the rest of the condition.
. #7 The Design Review Board approved the pathway on the south side of
Cottonwood Drive, so comply with the Design Review Boards
recommendations
. #9 Include on the final plat a pedestrian easement ( as written) and note it on
the plat. Strike the rest of the condition starting with the word Construct.
. #14 Usable amenities as approved by Design Review.
. Add #19, common lot #7, designate on the plat is a cross access for ingress and
egress to the public street.
. Add #20, The applicant is required to call Dig Line prior to digging.

. Add #21 and any other items agreed to here tonight.
. Cadwell adds to #17, identify to the city who the maintenance contractor will
be.
. Add to #20, Prior to issuing a building permit Dig Line shall be notified and
proof of this call shall be submitted to the city.
Seconded by Nordstrom. ALL A YE...MOTION CARRIES.

NEW BUSINESS: Bloom moves to go into an executive session to discuss
Oakley Subdivision. Seconded by Nordstrom. ALL A YE...MOTION
CARRIES.
