EAGLE PLANNING AND ZONING COMMISSION

The Planning and Zoning Commission met in regular session on May 20, 2002
Chairman Franden presiding.
1.
CALL TO ORDER: Meeting called to order 6:34 p.m.
2.
ROLL CALL: The following members were present FRANDEN, BLOOM,
NORDSTROM, CADWELL, CROOK. A quorum is present.
3.
CONSENT AGENDA:
A. Minutes of May 6, 2002.
B. Findines of Fact and Conclusions of Law for FPUD-2-02 & FP-7-02-
Final Development Plan and Final Plat for Two Rivers Subdivision No.
4- T. R. Company LLC, T. R. Company LLC, represented by Dan Torfin,
is requesting final development plan and final plat approval for Two Rivers
Subdivision No.4, a 34-lot (32-buildable, 2-common) residential
subdivision. This 12.93-acre phase of Quarter Circle Ranch PUD is located
on the west side of Eagle Road approximately 1600-feet south of State
Highway 44.
C. Findines of Fact and Conclusions of Law forTrollev Square
Subdivision No.1 - PPFP-2-02 - Ronald Coulter: Ronald Coulter is
requesting combined preliminary plat and final plat approval for Trolley
Square Subdivision No. 1. The 5.44-acre, lO-lot commercial subdivision is
generally located on the north side of State Street approximately 1O0-feet
east of Palmetto A venue at 902 East State Street
Cadwell moves to approve the consent agenda as presented. Seconded by Bloom. ALL

4. UNFINISHED BUSINESS: None

PUBLIC HEARINGS:
A. CU-03-02 -Conditional Use Permit for drive-up service lanes and A TM
- Pioneer Federal Credit Union: Pioneer Federal Credit Union,
represented by Land Consultants Inc., is requesting conditional use approval
for a bank facility with drive-up service and an automatic teller machine
with associated drive-up lane. The site is located on the northeast comer of
State Street and Stierman Way at 560 E. State Street.
Franden introduces the item.
Mark Butler 52 N. Second St. with Land Consultants Inc. reviews the application.

Franden opens the public hearing.
Butler addresses questions posed by the Commission regarding road alignment.
Franden closes the public hearing.
Discussion amongst the Commission.
Bloom moves to approve CU-03-02 Conditional Use Permit for drive-up service
lanes and A TM Pioneer Federal Credit Union with the site specific conditions of
approval as listed in the staff report which incorporates the site specific conditions
of approval in the ACHD report. Seconded by Cadwell. ALL A YE...MOTION
CARRIES.
B. PPIFP-l-02 - Combined Preliminarv Plat and Final Plat Approval for
Mercv Housine: Mercy Housing Idaho, Inc., represented by Glancey-
Rockwell & Associates, is requesting a combined preliminary plat and final
plat approval for Mercy Senior Village Subdivision. The 5.44-acre site is
located on the east side of Eagle Road approximately 1, 760-feet north of
State Street at 544 North Eagle Road.
Franden introduces the item.
Richard Cook with Briggs Engineering1800 W. Overland Boise, Idaho. Mr. Cook
reviews the application.
Lowe reviews the staff report. Discussion between Lowe and Commissioners.
Franden opens the public hearing.
Mr. Cook briefly reviews the site plan. Rich Kenney 1512 12th Ave. Rd. Nampa, Idaho
reviews the funding for this site.
Franden closes the public hearing.
Discussion of the proposed pathway location. Bloom feels that pathways need to be a
discussion item on the next joint meeting agenda item.
Nordstrom moves to accept the PPIFP-l-02 Combined Preliminary Plat and Final
Plat Approval for Mercy Housing with the site specific conditions as provided by
staff with the following exceptions: item #4 should be re-worded to say that to
construct a minimum 10' wide pathway or acceptable route as seen fit by the Eagle
City Council in order to maintain the integrity of the pathway network within the
City of Eagle. And strike the part about a pathway on Dry Creek canal easement

as the answer to solving the requirement of a pathway in creating the connectivity
that we have been trying to accomplish. Seconded by Bloom. Discussion. ALL
A YE...MOTION CARRIES.

NEW BUSINESS: None
7.
REPORTS:
Lowe reports on the history of a Stan Ray development, called Oakley Estates. Bloom
is concerned that the code has not been adhered to. Lowe explains City procedure in
regards to cash sureties. Bloom feels that the procedure is not good enough. She plans
on attending the Council meeting to be held on May 21, 2002 to see this issue through
to resolution. Discussion.
McFadden reviews the Covino case and illustrates the importance of revealing ex-parte
contact regarding applications.
8.
ADJOURNMENT:
Bloom moved to adjourn at 7:50 p.m. Seconded by Cadwell. ALL
