The Planning and Zoning Commission met in regular session on March 18,2002
Chairman Franden presiding.

CROOK. Absent: NORDSTROM, CADWELL. A quorum is present.

CONSENT AGENDA:

B. Findines of Fact and Conclusions of Law for A-OI-02/RZ-OI-O2-
Rezone & Annexation for Eaele Familv Worship Church - Eaele
Familv Worship; Eagle Family Worship, represented by Land Consultants
Inc., is requesting an annexation and rezone from RUT (Rural Urban
Transitional) to R-E (Residential Estates - 1 dwelling unit per two acres).
The site is located on the northeast comer of Floating Feather Road and
Park Lane at 3838 Floating Feather Road.
C. Findines of Fact and Conclusions of Law for CU-I-02 - Conditional
Use Permit for Eaele Familv Worship Church - Eaele Familv Worship:
Eagle Family Worship, represented by Land Consultants Inc., is requesting
conditional use approval for a church and a height exception to allow a 50-
foot high cross. The site is located on the northeast corner of Floating
Feather Road and Park Lane at 3838 Floating Feather Road.
D. Findines of Fact and Conclusions of Law for RZ-8-00 MOD - Rezone
and Development Aereement Modification - Mercv Housine Idaho:
Mercy Housing Idaho, represented by Glancey-Rockwell & Associates, is
requesting a change to the rezone and development agreement previously
approved by the City from MU-DA-P (Mixed Use - with development
agreement-PUD) to MU-DA (removal of the PUD) and a change to the
concept site plan within the development agreement. The 70-unit (69-
multi-family, I-single-family), 5.44-acre site is located on the east side of
Eagle Road approximately 1,700-feet north of State Street at 544 North
Eagle Road.
E. V AC-2-01 - Vacation to the final plat of Merrill Subdivision No.1 and
No.2 - G. L. Development Co.: G. L. Development Co., represented by
Peter Lounsbury with Quadrant Consulting, is requesting City approval of a
vacation to the final plat of Merrill Subdivision No.1 and No.2 to remove
the utility, drainage and irrigation easements along the side lot lines of Lots

5, Block 3 (Merrill Subdivision No.1) and Lots 6 and 7, Block 3, (Merrill
Subdivision No.2) to satisfy multiple lot line adjustments. The utility,
drainage and irrigation easement required for all side lot lines will be
satisfied with the creation of new easements along the side lot lines of each
new lot. The site is located on the south side of East Iron Eagle Drive
approximately 800-feet west of State Street.
Crook moves to approve the Consent Agenda of March 18, 2002, as presented.
Seconded by Franden. TWO AYE (Bloom abstained)...MOTION CARRIES.

PUBLIC HEARINGS:
A. ZOA-I-02 - The City of Eaele: The City of Eagle is proposing to amend
Eagle City Code Title 8, Chapter 1, Section 2, amending the "Open Space"
definition and adding definitions for "Restaurant" and "Roof-Mounted
Mechanicals"; amending Title 8, Chapter 2, Section 3; amending Title 8,
Chapter 2a, Section 3; Amending Title 8, Chapter 2a, Section 5, amending
the Design Review Overlay Districts and Map and creating the East End
Dunyon District; amending Title 8, Chapter 2a, Section 6, Subsection A (5),
adding screening requirements for Roof-Mounted Mechanicals; amending
Title 8, Chapter 2a, Section 7, Subsection H, providing for a surety;
amending Title 8, Chapter 2a, Section 10, Subsection B, requiring plans for
screening Roof-Mounted Mechanicals; amending Title 8, Chapter 2a,
Section 18, providing for sureties; amending Title 8, Chapter 3, Section 5,
Subsection Q, changing "Bond" To "Surety"; amending Title 8, Chapter 3,
Section 6, Subsection E;. (This item will be continued until the Aprill,
2002, Planning & Zoning meeting)
Bloom moves to continue ZOA-I-02 - The City of Eagle to the April 1, 2002,
Planning & Zoning meeting. Seconded by Crook. ALL A YE...MOTION
CARRIES.
B. RZ-17-00 - Rezone from A-R to MU-DA - Lloyd Campbell: Lloyd
Campbell is requesting a rezone from A-R (Agricultural-Residential) to
MU-DA (Mixed Use with Development Agreement). The L09-acre site is
located west of State Highway 55 approximately 1 50-feet south of Beacon
Light Road at 12700 Horseshoe Bend Road.
(This item was last heard on November 19,2001)
Bloom moves to continue RZ-17-00 - Rezone from A-R to MU-DA - Lloyd
Campbell to the April 15, 2002, Planning & Zoning meeting due to the applicant
not posting the sign. Seconded by Crook. ALL A YE...MOTION CARRIES.

REPORTS:
Bloom asks the City Attorney if we have an obligation to find out if there is a lease on
farm land that is in the process of being subdivided. Discussion between the
Commission and McFadden.
Nordstrom arrived at 6:36 p.m.
8. ADJOURNMENT: Nordstrom moved to adjourn at 6:40 p.m. Seconded by
Crook. ALL AYE...MOTION CARRIES...
