Minutes - 2002 - Planning & Zoning - 01/28/2002 - Regular ORIGINAL EAGLE PLANNING AND ZONING COMMISSION January 28, 2002 6:30 PM The Planning and Zoning Commission met in regular session on January 28, 2002 Chairman Franden presiding. 1. CALL TO ORDER: 2. ROLL CALL: The following members were present FRANDEN, BLOOM, NORDSTROM, CADWELL, CROOK. A quorum is present. 3. CONSENT AGENDA: A. Minutes of January 14,2002 B. Findin2s of Fact and Conclusions of Law for FPUD- 7 -01 & FP-20-01 - Final Development Plan and Final Plat for Countrvside Estates PUD Subdivision No.2 - Countryside Estates LLC: Countryside Estates LLC, represented by Richard Cook with Briggs Engineering, is requesting final development plan and final plat approval for Countryside Estates Subdivision No.2, a 38-lot (30-buildable, 8 common) residential subdivision. This 20.20- acre phase of Countryside Estates POD Subdivision is located near the northwest comer of Ballantyne Road and State Highway 44 (State Street). Nordstrom moves to approve the Consent Agenda as presented. Seconded by Bloom. ALL A YE...MOTION CARRIES. 4. UNFINISHED BUSINESS: A. RZ-13-01 - Rezone from A to R-l - RADA Properties. LLC: RADA Properties, represented by Land Consultants, Inc., is requesting a rezone from A (Agricultural) to R-l (Residential One - one dwelling unit per acre maximum). The 23.46-acre site is generally located on the southeast comer of Ballantyne Road and Floating Feather Road at 1156 Ballantyne Road. (This item was continuedfrom the January 14, 2002 Planning & Zoning Commission Meeting). Franden introduces the item. The public hearing is closed. Mark Butler, 52 N. 2nd St with Land Consultants, clarifies the irrigation and ACHD issues. Scott Stanfield, 314 Gladiola, Cadwell ID. Mr. Stanfield addresses the issues of the irrigation able land. There are 10 gallons of water available per minute per lot, and states there should be plenty of water available for this development. Butler stands to address the issues with ACHD as noted in their staff report which was submitted earlier to the Commissioners. Discussion between Commission and Jeff Lowe on the requirement for a ten foot wide pathway. Also, discussion on the existing house in lot No. 13, and the private street. Seconded by Cadwell. ALL A YE...MOTION CARRIES. B. PP-12-01 - Lockwood Subdivision - RADA Properties. LLC: RADA Properties, LLC., represented by Land Consultants, Inc., is requesting preliminary plat approval for Lockwood Subdivision. The 23.46-acre, 28-lot (22-buildable, 6-common) residential subdivision is generally located on the southeast comer of Ballantyne Road and Floating Feather Road at 1156 Ballantyne Road. (This item was continued from the January 14, 2002 Planning & Zoning Commission Meeting). Bloom moves to approve PP-12-01- Lockwood Subdivision - RADA Properties, LLC with staff recommendations and the following changes to the site specific conditions; Ssc #4, remove Horseshoe Bend Road and change to Ballantyne Road. Ssc #6 & #7, remove paragraph 8, the last sentence that says "no parking signs" and change to "all conditions for Eagle Fire Department will be met" in regards to parking on one side of road. Ssc #9, provide plan stating the pressurized irrigation will serve all lots within the subdivision prior to City Council seeing the application. Ssc #10, change to a 6-foot wide asphalt pathway. Ssc #17, an alternate method for the landscape buffer shall be presented to the Design Review Board. Seconded by Nordstrom. Discussion. Clarify that the Planning & Zoning Commission is recommending the parking be only on one side. ALL A YE...MOTION CARRIES. C. A-7-01 & RZ-12-01- Annexation and Rezone from RUT to R-l & Rezone from A-R to R-l - Capital Development: Capital Development, represented by Steve Arnold with Briggs Engineering Inc., is requesting an annexation and rezone from RUT (Rural Urban Transitional) to R-l (Residential - one dwelling unit per acre maximum) and rezone from A-R (Agricultural-Residential) to R-l (Residential - one dwelling unit per acre maximum). The 18.68-acre, site is generally located north of State Highway 44, approximately Yz-mile west of Ballanytne Road at 2800 West State Street. (This item was continued from the January 14, 2002 Planning & Zoning Commission Meeting). Franden introduces the item. There will be two separate motions made. Steve Arnold with Briggs Engineering, 1800, Boise, representing the applicant submitted additional information that the commission asks them to provide at the last meeting. Bloom questions the applicant on providing irrigation between the two subdivisions as they do not connect. Bloom discusses the letter received earlier in the day from an adjoining homeowner, Mr. Terry, asking that the ditch be tiled. Nordstrom moves to approve A-7-01 & RZ-12-01- Annexation and Rezone from RUT to R-l & Rezone from A-R to R-l- Capital Development with staff recommendations. Seconded by Bloom. 4 AYE (Franden abstained)...MOTION CARRIES. Arnold stands to answer Commissioner Nordstrom's question on the right in turn lane. D. PP-13-01 - Countryside West Subdivision - Capital Development: Capital Development, represented by Steve Arnold with Briggs Engineering Inc., is requesting preliminary plat approval for Countryside West Subdivision. The 18.68-acre, 21-lot (I8-buildable, 3-common) residential subdivision is generally located north of State Highway 44, approximately Yz mile west of Ballanytne Road. (This item was continued from the January 14, 2002 Planning & Zoning Commission Meeting). Nordstrom would like to see a more defined irrigation system. Cadwell thinks that the irrigation should be left up to staff and the City Engineer. Crook does not see anything that states that any of the three options will work. Nordstrom move to continue PP-13-01 - Countryside West Subdivision - Capital Development until the applicant can provide additional information on the water issue so it is clarified and better defined. PP-14-01- Lexineton Rid2e Subdivision- Lexineton Heiehts LLC: Lexington Heights LLC, represented by Roylance & Associates P A, is requesting preliminary plat approval for Lexington Ridge Subdivision. The 95.18-acre,48-lot (43-residential, 5 -common,) subdivision is located north of Floating Feather Road, approximately 1,4 mile east of Ballantyne Road at 1400 W. Floating Feather Road. (This item will be continued to the February 4, 2002, Planning & Zoning Commission Meeting). Bloom moves to continue PP-14-01- Lexington Ridge Subdivision- Lexington Heights LLC to the February 19, 2002 Planning & Zoning meeting. Seconded by Cadwell. ALL A YE...MOTION CARRIES. B. CU-11-01- Buildin2 heieht exception for a 45-foot hieh hotel & 48-foot hi2h chimnev- Ea2le River Hospitality. LLC: Eagle River Hospitality LLC, represented by Bill Clark with Clark Development, is requesting conditional use approval for a 45-foot high hotel building and a 48-foot high chimney. The height exception (the portion of the building above 35-feet) is for the purpose of screening mechanical units and the installation of a chimney. The site is generally located on the southeast comer of Eagle Road and State Highway 44. Franden introduces the item. Bill Clark, the developer of the Eagle River development provides an overview of the project Phil Hull with The Land Group, 128 S. Eagle Road. Discusses the design aspects of the hotel with the use of view foils to aid in his presentation. Clark provides additional information on the key reasons for the height exception, one being the sloped roof and the other being to provide conference rooms for several hundred people. Jeff Lowe, city staff provides the staff report. Geneva Trent, Ms. Trent states that the design for this looks great but the reason for the height restriction was to aid the fire department and is unclear if they are equipped to handle this height increase. Franden states that on 12/12/01 a letter was provided from the Eagle Fire Department stating that they recommended approval of this application. Nordstrom asks Mr. Clark to provide information on the increase in the number of rooms anticipated. Franden closes the public hearing. Bloom states that she sees a precedent being set with this application. Nordstrom moves to approve CU-11-01 - Building height exception for a 45-foot high hotel & 48-foot high chimney- Eagle River Hospitality, LLC, with staff recommendations and site specific conditions of approval. Seconded by Cadwell. ALL A YE...MOTION CARRIES. C. ZOA-8-01 - Zonim! Ordinance Amendment -The City of Eaele: The City of Eagle is proposing to amend Eagle City Code Section 9-4-1 to provide for the regulation (including but not limited to design, location, and maintenance) of pathways within the City. Jeff Lowe, City staff presents the staff report. Discussion on using the wording of curves and comers, and perhaps to instead use the term meandering. Franden opens the public hearing. Franden closes the public hearing. Bloom moves to approve ZOA-8-01 - Zoning Ordinance Amendment -The City of Eagle with the item change to 5d and also Bloom will provide additional information. Seconded by Crook. ALL A YE...MOTION CARRIES. 6. NEW BUSINESS: A. FPUD-8-01 & FP-22-01 - Final Development Plan and Final Plat for Brookwood Subdivision No.5 Aries Development. This 7.78-acre (approx.) phase of Brookwood PUD is located on the north side of Floating Feather Road and west of Feather Nest Estates Subdivision. The site is within the Eagle City Limits. Mike Hormaechea with Aries Development presents the application. Mr. Hormaechea states that he has no concerns with the staff report. Jeff Lowe city staff presents the staff report. Bloom states that she likes the density decrease. Cadwell moves to approve FPUD-8-01 & FP-22-01 - Final Development Plan and Final Plat for Brookwood Subdivision No.5 Aries Development, LLC, with the conditions of approval recommended by staff. Seconded by Bloom. ALL A YE...MOTION CARRIES. 7. REPORTS: The Commission would like the City Engineer to come and address irrigation for them. 8.
