The Planning and Zoning Commission met in regular session on January 14,2002
Acting Vice Chairman Bloom presiding.

CALL TO ORDER:
ROLL CALL: The following members were present BLOOM,
NORDSTROM, CADWELL, CROOK. Absent: FRANDEN. A quorum is
present.
CONSENT AGENDA:
A. Minutes of December 17, 2001
B. Findin2s of Fact and Conclusions of Law for FPUD-3-01 & FP-6-01 -
Final Development Plan and Final Plat for Picadilly Villaee PUD
Subdivision - PO Ventures: PO Ventures, represented by Robert C. Unger
with Hubble Engineering, is requesting final development plan and final plat
approval for Picadilly Village PUD, a 19-1ot (16-residential, 2-commercial,
and I-common) subdivision. The 6.87-acre site is located on the southwest
comer of State Highway 55 and Hill Road.
Nordstrom moves to approve the consent agenda as presented. Seconded by
Bloom. TWO AYE (Cadwell and Crook abstained)...MOTION CARRIES.
4. OLD BUSINESS:
A. CU-IO-Ol - 115-foot hieh Personal Wireless Facility - Cricket
Communications: Cricket Communications, represented by Neil
Hattenburg with Crown Castle International, is requesting conditional use
approval to install a 115-foot high monopole to accommodate a personal
wireless facility. The site is generally located on the southeast comer of
Floating Feather Road and North Ballantyne Road within the ACHD right-
of-way (drainage pond) at 1156 North Ballantyne Road. (This item was
continued from the December 3, 2001, Planning & Zoning Commission
Meeting).

Kevin Malonney, 277 N. 6th Street, Boise. Mr. Malonney representing
Cricket Communication states that they will withdraw their application at
this time. They may eventually come back before the Commission with a
new application.
PUBLIC HEARINGS:

A. RZ-13-01- Rezone from A to R-l- RADA Properties. LLC: RADA
Properties, represented by Land Consultants, Inc., is requesting a rezone
from A (Agricultural) to R-l (Residential One - one dwelling unit per acre
maximum). The 23.46-acre site is generally located on the southeast comer
of Ballantyne Road and Floating Feather Road at 1156 Ballantyne Road.

Bloom combines item 5A & 5B for the public hearing.
Mark Butler, 52 N. 2nd Street Eagle, with Land Consultants is representing the
applicant and presents the application.
Jeff Lowe, city staff presents the staff report. Staff does not feel that justification has
been shown that would warrant a private road over a public road.
Bloom opens the public hearing.
Kurt Smith with Earl & Associates Engineers representing the applicant stands to
answer any questions regarding any irrigation issues. States that they will provide
pressurized irrigation.
Mike Plunkett, 843 Ballantyne, asks is any parks are planned for this development. Is
also concerned about the comer parcel and what will happen with this. One more
concern is the width of the street and if there is enough room for drainage.
Mike Malterre, 1795 W. Floating Feather, lives directly adjacent to this parcel to the
east. He is most concerned about the access into this subdivision. States that the trees
are the best feature of this subdivision and would like to see them saved.
Jason Gibson, 2217 W Bums Street. Mr. Gibson is in favor of this development and
states it will add value to his property. He is in favor of the pathway and his concern
would be the requirement for the road connection and states that private roads would be
the best.
Mark Butler provides a rebuttal. Mr. Butler states some changes to staff site specific
conditions that they would like to see made.
Bloom closes the public hearing.
Nordstrom has a few comments regarding the private streets.
Cadwell does not see the need for a 10 foot asphalt pathway.
Crook asks if there is a standard in the comprehensive plan for pathways. Also would
like to know what happens if the issue of the lot in the northwest comer is not resolved.
Bloom likes the idea of preserving the trees. Is concerned about the length of the
private road and maintenance costs for a private road. Is also concerned about the
alternatives for lot # 13 if ACHD does not grant access. Would like to see some
drawings on the irrigation system and have the city engineer review this plan.
Butler stands to answer Cadwell's question on the access through the lot with the
existing home.
Nordstrom moves to continue both RZ-13-01- Rezone from A to R-l- RADA
Properties, LLC and PP-12-01 - Lockwood Subdivision - RADA Properties, LLC
to the January 28, 2002, Planning and Zoning Meeting to allow the developer time
to get a letter from ACHD regarding the access and to see the pressurized
irrigation plan. THREE A YES (Crook abstained)...MOTION CARRIES.

B. A- 7-01 & RZ-12-01 - Annexation and Rezone from RUT to R-l &
Rezone from A-R to R-l - Capital Development: Capital Development,
represented by Steve Arnold with Briggs Engineering Inc., is requesting an
annexation and rezone from RUT (Rural Urban Transitional) to R-l
(Residential- one dwelling unit per acre maximum) and rezone from A-R
(Agricultural-Residential) to R-l (Residential - one dwelling unit per acre
maximum). The 18.68-acre, site is generally located north of State
Highway 44, approximately l/2-mile west of Ballanytne Road at 2800 West
State Street.
Bloom combines both items 5C & 5D for the public hearing.
Steve Arnold with Briggs Engineering 1800 W. Road, representing the applicant
presents the application.
Jeff Lowe city staff presents the staff report.
Bloom opens the public hearing.
Richard Terry, 2755 W. State, Eagle. Mr. Terry is speaking for himself and two other
neighbors who will be affected by the subdivision. Mr. Terry states that the ditch
should be tiled and unencumbered. Is also concerned about the traffic and the turn
lanes into this subdivision. Would also like to see the speed limit reduced at the
entrance.
Otto Yurkee, 2750 W. State Street, Eagle. Mr. Yurkee concurs with Mr. Terry on the
traffic concerns. Would like to see State Highway 44 widened. Mr. Yurkee is also
concerned about his water shares and being able to irrigate his property and where this
subdivision will get their water from.
Steve Arnold provides a rebuttal.
Discussion between Mr. Arnold and the Commissioners on the water rights and the
irrigation system.
Bloom closes the public hearing.
Discussion amongst the Commission on continuing agenda items to get irrigation issues
resolved.
Nordstrom moves to continue A-7-01 & RZ-12-01- Annexation and Rezone from
RUT to R-l & Rezone from A-R to R-l- Capital Development and PP-13-01-
Countryside West Subdivision - Capital Development to the January 28, 2002,
Planning & Zoning Meeting so the developer can provide an engineers statement
on how they will provide irrigation water and or an understanding of the water
rights that do exist and whether they are sufficient to meet the water needs of this
subdivision. Also a statement on whether they are going to draw any capacity for
serving this system out of something other than this piece of property. Secondly,
to provide a letter from ITD stating that they are all in agreement with the decel
and center turn lanes and access from lot #6 to State Highway 44. Seconded by
Bloom. Discussion. Three AYE (Crook Abstained)...MOTION CARRIES.

D. PP-13-01- Countryside West Subdivision - Capital Development:
Capital Development, represented by Steve Arnold with Briggs
Engineering Inc., is requesting preliminary plat approval for Countryside
West Subdivision. The 18.68-acre, 21-lot (I8-buildable, 3-common)
residential subdivision is generally located north of State Highway 44,
approximately l/2 mile west of Ballanytne Road.

NEW BUSINESS:
A. FPUD-7-01 & FP-20-01- Final Development Plan and Final Plat for
Countryside Estates PUD Subdivision No.2 - Countryside Estates
LLC: Countryside Estates LLC, represented by Richard Cook with Briggs
Engineering, is requesting final development plan and final plat approval
for Countryside Estates Subdivision No.2, a 38-lot (30-buildable, 8
common) residential subdivision. This 20.20-acre phase of Countryside
Estates PUD Subdivision is located near the northwest comer of Ballantyne
Road and State Highway 44 (State Street).
Bloom introduces the item.
Cadwell states that he will recuse himself from this item.
Dave Yorgeson with Capitol Development, 6200 N. Meeker Place, Boise, the applicant
presents the application. Mr. Yorgeson states that he does not have any problems with
staff's site specific conditions.
Jeff Lowe, city staff presents the staff report.
Nordstrom moves to approve FPUD- 7-01 & FP-20-01 - Final Development Plan
and Final Plat for Countryside Estates PUD Subdivision No.2 - Countryside
Estates LLC. Seconded by Crook. 2 A YE (Nordstrom & Crook) 1 NAY (Bloom)
Cadwell (Abstained)...MOTION CARRIES.
Election of Planning & Zoning Commission Chairman & Vice-Chairman
Nordstrom moves to appoint Cheryl Bloom as Vice Chairman. Seconded by
Cadwell. ALL A YE...MOTION CARRIES.
Nordstrom moves to appoint John Franden as Chairman. Seconded by Bloom.
ALL A YE...MOTION CARRIES.
7. REPORTS: Discussion between City Attorney, John McFadden and the
Commission on irrigation issues at the preliminary plat stage being required and traffic
Issues.
Nordstrom would like to see some further studies on cell tower data and potential site
locations.
8. ADJOURNMENT: Bloom moved to adjourn at 9:15 p.m. Seconded by
