The Planning and Zoning Commission met in regular session on October 1,2001 Vice-
Chairman Deckers presiding.

CALL TO ORDER:

ROLL CALL: The following members were present BLOOM, DECKERS,
NORDSTROM, CADWELL. Absent: FRANDEN. A quorum is present.
Deckers opens the meeting by discussing the Cavello application, the Commissioners would
like to have Franden present for this item.
Deckers discusses item 5F and states that this item will possibly not be heard by 10:00 p.m.
and should be continued to a special meeting.
Bloom moves to continue RZ-12-00 MOD - Development Agreement Modification-
Coulter Properties LLC to a Special Planning & Zoning Meeting on October 4, 2001.
Seconded by Nordstrom. ALL A YE...MOTION CARRIES.

B. Findines of Fact and Conclusions of Law for A-2-01 & RZ-S-Ol - Annexation
and Rezone from RUT to R-E - Pacific Ridee: Pacific Ridge, represented by
David Bailey with Hubble Engineering Inc., is requesting a rezone upon
annexation from RUT (Rural Urban Transitional) to R-E (Residential Estates -

Aereement Modification - IFI Partners II: IFI Partners II, represented by John

approved by the City on April 10, 2001 for the site proposed to be developed as
Great Sky Estates No.7 Subdivision. The 2.98-acre site is generally located on the
southwest comer of Hill Road and State Highway 55, approximately 575-feet west

Bloom moves to approve the consent agenda as amended. Discussion. Deckers moves to

Discussion on item 3G, Henry's Subdivision.
Nordstrom moves to approve item 3C on the consent agenda, PP-5-0l - Autumncrest
Subdivision. Seconded by Bloom. 3 AYE (Deckers abstained)...MOTION CARRIES.
Nordstrom moves to approve item 3G on the consent agenda, PP-lO-Ol - Henry's
Subdivision. Seconded by Bloom. 2 AYE (Deckers and Cadwell abstained)...MOTION
CARRIES.
4. UNFINISHED BUSINESS:
A. PP-6-0l - Cavallo Estates Subdivision - Joe Glaisverl Capitol Securities: Joe
Glaisyer/Capitol Securities, represented by David Bailey with Hubble Engineering Inc., is
requesting preliminary plat approval for Cavallo Estates Subdivision. The 61.94-acre lot
(30-buildable) residential subdivision is generally located on the northwest comer of
Floating Feather Road and Meridian Road. (This item was continued from September 17,
2001, Planning & Zoning Meeting).
Deckers introduces the item.
Cadwell recuses himself from this item.
David Bailey, with Hubble Engineering, representing the applicant presents the application.
The applicant has met with the Chevron Pipeline Representatives and will be able to meet the
depth requirements as required. They would like to propose that the greenbelt path be within
the landscape buffer along Floating Feather and the west side of the subdivision, up to Park
Lane. Discusses the letters received from homeowners in Lorenzo Estates Subdivision and
addresses their concerns on the irrigation system and how they will meter the water share.

Discussion between Commissioner Bloom and the applicant regarding headlights shining on to
the neighbor, Mr. Schroeder who resides to the east across N. Meridian Road.
Discussion on changes in lot sizes.
Discussion on ground water issues. The applicant states that they have been monitoring the
ground water for Central District Health. The nutrient pathogen study has been submitted to
c.D.H.
Discussion on compatibility and density issue.
Deckers would like the recent letters received from the public to be included in the City
Council packet.
Bloom would like to see the landscape along Meridian become an easement and maintained by
the homeowners association.
Nordstrom disagrees with Bloom on this landscape buffer and does not think we should require
the applicant to provide the landscape buffer.
Discussion amongst the Commission.
Deckers discusses the pathway along the pipeline and states that any opportunity to install
pathways is a good idea. Would like City Council to look further at the density issue and take a
broader view on density transitioning.
Nordstrom moves to approve PP-6-01- Cavallo Estates Subdivision - Joe Glaisyerl
Capitol Securities with staff recommendations with the following additions to the site-
specific conditions;

Include new plat drawing proposed by the applicant.
Include a pathway along the Chevron Pipeline that would connect from the beginning
of the subdivision in block three following the southern boundary of lots 3,4 and the
northern boundary of lot 2, up to Selvago Way and then connecting to Selvago Way
and following the pathway through Sella Way out to the end of the subdivision on the
western boundary.
The entry design on the east side at Fieno Way drawn so that there are no light
conflicts with the property across the road owned by Mr. Jeffrey Schroeder of light
deterrents coming into his house or property that would be negative to the residence.

The subdivision recognizes the demands of water in this area and become good
neighbors when sharing and understand the water rights and work with other users
on the lateral.
A letter from ACHD regarding changes to the subdivision on curb and gutter based
on their requirements.

. The lighting meets the conditions for "dark sky lighting" requirements so we do not
have obtrusive lighting.
Seconded by Deckers.
Where the pathway stubs out at the end circle at Sella Way that it follows along the
south property line of lots 2 & 3 out to the end of the subdivision.

Deckers makes an alternate motion to keep the language identical to the previous motion
but with the addition "that there be a 25 foot landscape easement along eastern portion of
Meridian Road and it shall be maintained by the homeowners association".
Alternate motion seconded by Bloom. 2 A YES 1 NAY (Nordstrom) (Cadwell
Abstained).

B. Zonine: Ordinance Amendment - ZOA-6.01 - Land Consultants Inc.: Land
Consultants Inc., represented by Mark Butler is proposing to amend Eagle City Code Title
8, Chapter 2, Section 3, to allow Ambulance Services, Nursing/Convalescent Homes
(including senior assisted living facilities) and Government Buildings (offices) to be
permitted uses, or permitted with a conditional use permit, in additional zoning districts
and to amend Section 4 to add Note J to allow Child Care Facilities, Churches,
Nursing/Convalescent Homes (including senior assisted living facilities), Government
Buildings (offices) and Schools (Public or Private) to increase the maximum lot coverage
from 10% to 35% in any A, A-R, and R-E zoning districts) (This item was continuedfrom
the August 20, 2001, Planning & Zoning Meeting).
Deckers introduces the item.
Mark Butler 52 N. 2nd Street, Eagle. Mr. Butler with Land Consultants would like to change
the maximum lot coverage from 20 to 25%.
Jeff Lowe, city staff clarifies the language in the ordinance.
Deckers opens the public hearing.
Bloom moves to continue Zoning Ordinance Amendment - ZOA-6-01 - Land
Consultants Inc, to the Special Meeting on October 4, 2001. Seconded by Cadwell. ALL
A YE...MOTION CARRIES.

PUBLIC HEARINGS:
Deckers combines both item 5A & 5B for the public hearing with separate motions.
A. A-6-01 & RZ-09-01- Annexation and Rezone from RUT to R-l- Brie:hton
Corporation: Brighton Corporation, represented by Wardle & Associates, is requesting a
rezone upon annexation from RUT (Rural Urban Transitional) to R-l (Residential- up to
one unit per acre). The 124.3-acre site is generally located on the northwest corner of
Meridian Road and Chinden Boulevard.
B. PP-ll-Ol- McKay Subdivision - Brie:hton Corporation: Brighton Corporation,
represented by Wardle & Associates, is requesting preliminary plat approval for McKay
Subdivision. The 124.3-acre, 112-lot (98-buildable, 14 common) residential subdivision is
generally located on the northwest corner of Meridian Road and Chinden Boulevard.
Mike Wordell, Boise Ave, Boise, representing the Brighton Corporation presents the
application. Mr. Wordell stresses for the record that this application complies with the
comprehensive plan and the ordinances of the City of Eagle.

Jeff Lowe, city staff presents the staff report. Mr. Lowe states the reasons for denying this
application.
Mike Rino, from Central District Health answers Commissions questions on the nutrient
pathogen study. Mr. Rino explains what this study entails.
Deckers opens the public hearing.
Wayne Coleman, 232 River Heights Drive, Meridian. Mr. Coleman lives immediately north of
this parcel. This subdivision has the appearance of a checkerboard. He is not against
development but would like to see a variety of lot sizes and meandering roads and open space.
Terry Porter, 7352 Winward Drive, Meridian. Mr. Porter lives north of this proposed
subdivision. Taxes have increased and the standard of living has decreased. Mr. Porter feels
that the lot sizes are to small and the traffic flow will not be able to handle any more
development.
Dennis Hansen, 465 West Sly Fox Street, Meridian. Speaks in opposition to this development.
This subdivision plat is not comparable to the surrounding subdivision. He is also concerned
about the septic tank issue. He was not able to put a septic tank in the back of his house and
now will have four in his back yard. He is also concerned about transportation. This area can
not support increased traffic. Mr. Hansen also does not think there is enough water to support
this.
Mary Anne Hansen, 465 West Sly Fox. Was originally told this area would be five-acre lots.
Is also concerned about the increase in traffic onto Winward Road. Ms. Hansen suggests that
Brighton Development create their own entrance onto Chinden Road.
Deckers calls a brief break.
Tobe Thompson 505 River Heights. He is opposed to this development and would like to see
the lot sizes upgraded to 3 acres. "Do not make the same mistakes made in the past". Traffic
count has not been done in over a year and numerous developments have taken place in this
area.
Pat McGarran, 795 River Heights Drive, north of the subdivision. Addresses septic systems.
Ms. McGarran has a master's degree in Environmental Health and has a lot of knowledge in
this area. Lots less than five acres could be an environmental health concern
Mike McGraft 1011 River Heights Drive, is in opposition to this development mainly because
of the increase in traffic at an already busy intersection. This will create a large safety concern.
Would like to see responsible development.
Harriet Calverley, 913 River Heights Drive, states she will touch a comer of this subdivision.
Will there be minimum CC&R's? and what will be located on the vacant lot? Would like to see
larger lot sizes. Also, would like to have a traffic signal paid for by the developer.
Paul Calverley, 913 River Heights Drive. Mr. Calverley would like the Commission to listen
to the factual information provided by Ms. McGarran

Reed Bowen, 6677 Fox Tail Subdivision. Concerned about the increased traffic. There are
numerous children in this area that need to catch school buses. People will use his
neighborhood for a quicker route onto Chinden. Two deaths have already occurred at Meridian
and Chinden Road.
Dale Lindley, 1635 Dunsmire is representing the Lindley Family that is asking for the rezone.
His family has owned this property since 1958. Would like to receive the same treatment as
they did when they sold the Castlebury property.
Brian ScWader 6620 Fox Tail Run. The nearest I-acre subdivision close to this subdivision is
over 1 mile away. Mr. Schlader states that he does not think that the Lindleys have been
treated unfairly. Thinks that a traffic signal is a small investment by the developer for the
safety of families.
Bob Stow 6722 N. Winward. Mr. Stow property backs up to the Lindley farm, agrees with
most other statements heard tonight regarding the septic issue, lets apply the new standards.
Asks "why does transportation have to follow development? it can come before". States that
this project should only be approved for 5 acre lots.
Karen Thornberry 6980 N. Meridian Road. Ms. Thornberry states that you can not compare
this development to Castleberry as they have a different outlet to Chinden Blvd. Meridian
Road is not as wide as Locust Grove.
Donna Knittel, 7280 Winward Drive. Also shares the same concerns about traffic. There are
many small children in the adjoining subdivisions. Is also concerned about well
contamination. The developer has not given consideration to the existing homeowners.
David Vail 1748 Winward Drive. Mr. Vail would like to clarify several items. The closest
area that the developer has used for comparison is over 1/2 mile away. Would also like the
City of Eagle to work with the City of Meridian. Mr. Vail has spoken with 86 people who
signed the petition and not one person refused to sign this petition.
Diane Anderson, 500 River Heights Drive. Member of the Meridian School Board but is not
representing them but rather herself. She has information on how this will affect the children
to share. This growth area will require more schools to be built. Would rather see the
Lindleys stay in this area and farm.
Kevin Sommer is currently building a home in the Castlebury Subdivision. Mr. Sommer states
that this is a money making deal for the developer. Is concerned about the increase traffic, the
higher density and the appearance of this subdivision.
Larry Sandusky lives in the Clearview Estates Subdivision. Is concerned about safety at the
busy roads. States that this is one of the highest traffic areas in the county.
Mike Wordel provides a rebuttal. Mr. Wordel states that the Brighton Corp will pay their
share for a traffic signal if the homeowners in the other subdivisions that need this traffic
signal pay for the other half.
Commission asks question of staff regarding the non-conforming use.

Commissioner asks City Attorney, John McFadden to also respond to the rezone and if it is in
conformance of the Comprehensive plan.
Discussion amongst the Commission.
Deckers would like to note in the record that three letters were submitted in opposition to this
development.
Nordstrom moves to deny A-6-01 & RZ-O9-01- Annexation and Rezone from RUT to R-
1 - Brighton Corporation based on staff recommendation of the non-conforming use and
the ground water and traffic congestion issues. A development agreement would not be
appropriate for this application. Seconded by Bloom. ALL A YE...MOTION CARRIES.
Planning & Zoning Commissioners conditions for City Council:
. Meandering roadway design
. Detached sidewalk with street trees.
. Condition the preliminary plat on the nutrient pathogen guidelines and the Nutrient
Pathogen Study results should be available for public review and time to make comments.
. Common areas and amenities.
. Varied lot sizes and shapes.
. A traffic Study done to look at the access to Chinden Road and to suggest improvements at
Chinden and Meridian. These could include turn lanes, traffic signal on Chinden, and look
at the alignment with the connection to the Foxtail Subdivision should be redesigned to
discourage cut through traffic.
. Would like to see pedestrian connection.
. Council should consider compatibility with adjacent lot sizes.
. If the applicant should make sewer available then this would be a completely different
application.
. Condition from ITD accepting the appropriate improvements.
Deckers closes the public hearing.
Deckers moves to deny PP-ll-O1- McKay Subdivision - Brighton Corporation based on
the rezone being denied. If council approves the annexation and rezone and proceeds
with the preliminary plat to consider the following items discussed above. Seconded by
Bloom. ALL A YE...MOTION CARRIES.
Bloom moves to continue items 5C & 5E to the October 4, 2001, Special Planning &
Zoning Meeting. Seconded by Nordstrom. ALL A YE...MOTION CARRIES.
C. RZ-10-01- Rezone from A to R-E - Mike Malterre: Mike Malterre, represented by Phil
Hull with Land Group, Inc., is requesting a rezone from A (Agricultural) to R-E
(Residential Estates - up to one unit per two-acres). The 9.87-acre site is generally located
south of Floating Feather Road approximately 600-feet east of Ballantyne Road, at 1795
W. Floating Feather Road.
D. CU-O8-01 - 67-foot hieh Personal Wireless Facility - Qwest Wireless LLC: Qwest
Wireless LLc., represented by Kevin Galik with Tetragenics, is requesting conditional use

approval to replace an existing 37-foot high Idaho Power wood utility pole with a 67-foot

Use Subdivision #2 (formally know as Eagle River Subdivision). The 46.4-acre, lO-lot (9
commercial, I residential) subdivision is located on the southeast comer of Eagle Road and
State Highway 44 (State Street).
F. RZ-12-00 MOD - Development Al!:reement Modification - Coulter Properties LLC:
Coulter Properties LLC, represented by Mark Butler with Land Consultants Inc., is
requesting a change to the conditions within the development agreement and a change to
the concept site plan previously approved by the City for rezone application RZ-12-00

responsibility to plan and implement growth. However, the school district must be
aware of and respond to growth in order for schools to keep up with the community
need.
Broad Overview:
8 Square Mile growth area between Ustick Rd. and Chindon Ave. is now in the planning
stages. $12 million for land (abt. 300 acres) $140 million for schools. Anticipate 8

condensed living space that range from 1/4 to 3/4 acres, which must be on the city sewer
system.
Chindon's future is to be widened to a 5 lane highway.
