Minutes - 2001 - Planning & Zoning - 09/10/2001 - Special OR\G\NAL EAGLE PLANNING AND ZONING COMMISSION Special Meeting September 10, 2001 6:30 PM The Planning and Zoning Commission met in a special session on September 10, 2001 Chairman Franden presiding. 1. CALL TO ORDER: 2. ROLL CALL: The following members were present FRANDEN, BLOOM, NORDSTROM, CADWELL. Absent DECKERS. A quorum is present. 3. CONSENT AGENDA: None 4. 5. UNFINISHED BUSINESS: None PUBLIC HEARINGS: A. A-2-01/RZ-5-01 - Annexation and Rezone from RUT to R-E - Pacific Rid2:e: Pacific Ridge, represented by David Bailey with Hubble Engineering Inc., is requesting a rezone upon annexation from RUT (Rural Urban Transitional) to R-E (Residential Estates - one dwelling unit per two acres) for Auturnncrest Subdivision. The 39.92-acre, 20-lot (19-buildable) residential subdivision is generally located on the west side of Ballantyne Road, approximately lA mile south of Beacon Light Road. (This item was continuedfrom the September 4,2001, Planning & Zoning Meeting). Franden states that items 5A & 5B will be heard together for public testimony with separate motions. Franden introduces the item. The public hearing is still open. Jane Suggs, 701 S. Allen Street, Meridian with Hubble Engineering representing the applicant presents a PowerPoint presentation. Photos were used that show the parcel of land. Some issues addressed were traffic count, irrigation, driveways and landscaping. Randall Holtz, owns the five acre parcel directly north of the proposed development. States he is opposed to this development as he moved to this area for the rural feel. Does not want to loose the country atmosphere and is also concerned about the overcrowded schools. Howard Holmes, owns the farm that is being redeveloped. States two acres are much easier to care for than five-acre parcels. Nordstrom asks Mr. Holmes how they measure the water flow. Bloom asks if they share the water with the lateral company. Lisa Szenten, 2593 W. Brockton Court, Eagle. Ms. Szenten spoke at the last meeting but has additional concerns. She submits to the Commission a list of petition signatures that she collected. Does not know of other neighbors with 5 acre parcels that do not use it or take good care of it. Ms. Szenton also submits several aerial photos. Robert Hamlin lives in Kennsington Meadows, Mr. Hamlin is baffled about why he is here. Moved to five acres and does not want this area rezoned as it changes the entire neighborhood. Mr. Hamlin is also upset about the photos the applicant used in presenting their application. John McFadden, City Attorney states that staff has no additional comments at this time. Jane Suggs provides a rebuttal. Ms. Suggs states that 2-acre parcels are compatible with agricultural uses. Irrigation is not an issue as it will not effect homeowners to either the north or the south. David Bailey with Hubble Engineering addresses the irrigation issue and explains the three shares of water. Franden asks Mr. Holmes to address the water shares. Mr. Holmes states that in a normal water year he has had plenty of water to sufficiently water this parcel. Discussion on water rights between Bloom and Mr. Bailey. Bloom addresses the Meridian School District overcrowding issue. Spoke with the school district and was unable to get any clarification Franden closes the public hearing. Franden asks each Commission member to discuss the proposal separately. Cadwell has numerous concerns with the school issues and is concerned about the impact these developments have on the school. But does not have a reason to not approve this development. Nordstrom sees the same problems over and over. When a community is growing as fast as Eagle we can not keep up with the roads and schools and it is frustrating. Protecting the community is the goal of the Commission, and all issues need to be thoroughly addressed. Bloom lives in this vicinity and does not want this area rezoned. Can not vote in favor of this rezone. Franden has difficulty with this issue but feels the owner of the property has the right to development this land. Is concerned with the water issue and hopes these are addressed. Would like to continue the buffer with the deciduous trees. The only way you will get new schools is to have a larger tax base. Would like the applicant to try and address the road layout. Discussion amongst the Commission. Nordstrom moves to approve A-2-01/RZ-5-01 - Annexation and Rezone from RUT to R-E - Pacific Ridge with staff recommendations. Seconded by Cadwell. 3 AYE 1 NAY (Bloom)...MOTION CARRIES. B. PP-5-01 - Autumncrest Subdivision - Pacific Rid2:e: Pacific Ridge, represented by David Bailey with Hubble Engineering Inc., is requesting preliminary plat approval for Autumncrest Subdivision. The 39.92-acre, 20- lot (19-buildable) residential subdivision is generally located on the west side of Ballantyne Road, approximately '4 mile south of Beacon Light Road. (This item was continued/rom the August 13, 2001, Planning & Zoning Meeting). Jane Suggs clarifies for the Commission the issue of the driveway and submits the new report from ACHD. Cadwell moves to approve PP-5-01 - Autumncrest Subdivision - Pacific Ridge with staff recommendations with the following additions to the site specific conditions: . Approval of the final plat to include the irrigation plan which would meet all requirements. . Must include the approval of access to back property from the existing Ballantyne Road entrance by ACHD. . Strike site specific condition #8 depending on A CHD . The 61.94-acre, 33-lot (30-buildable) residential subdivision is generally located on the northwest comer of Floating Feather Road and Meridian Road. RZ-14-00 MOD - Development A2:reement Modification for - IFI Partners II: IFI Partners II, represented by John G. Evans is requesting a modification to the development agreement previously approved by the City on April 10, 2001 for the site proposed to be developed as Great Sky Estates No.7 Subdivision. The 2.98-acre site is generally located on the southwest comer of Hill Road and State Highway 55 approximately 575-feet west of State Highway 55. (This item was continued/rom the September 4, 2001 Planning & Zoning Meeting). Franden introduces the item and combines both item 5 F & 5G for the public hearing. John Evans, 5699 N. Ripple Way, Garden City the applicant presents the application. John McFadden, City Attorney presents the staff report. McFadden uses the City Code to back up staff's recommendations. Franden opens the public hearing. Mark Butler, 52 N. 2nd St Eagle. Mr. Butler is representing the Picadilly Subdivision applicant. Mr.Butler states that the property owner hopes that the developer will shift the road to the west for better access. Would hope that if this plan is approved could they get some type of streetscape to separate the roadway and the back yards of Picadilly. Mr. Butler also addresses the grading issues. Picadilly is about 4 to 5 feet higher than this development. McFadden asks the Commission if they all received the letter from Mr. Deckers. Franden closes the public hearing. Bloom moves to approve RZ-14-00 MOD - Development Agreement Modification for - IFI Partners II with staff recommendations with the following change; . Strike site specific condition #13 to leave minimum setbacks at 7.5 feet to be consistent with other properties in Eagle. Seconded by Cadwell. ALL AYE... MOTION CARRIES. G. PP-9-01- Great Skv Estates Subdivision No.7 - IFI Partners II: IFI Partners II, represented by John G. Evans is requesting preliminary plat approval for Great Sky Estates No.7 Subdivision. The 2.98-acre, II-lot (5- residential, 4-commercial, 2-common) subdivision is generally located on the southwest comer of Hill Road and State Highway 55 approximately 575- feet west of State Highway 55. (This item was continued from the September 4,2001, Planning & Zoning Meeting). Bloom moves to approve PP-9-01 - Great Sky Estates Subdivision No.7 - IFI Partners II with staff recommendations. The landscape design between this subdivision and Picadilly should be looked at closely to provide some type of screening or buffer between the commercial and residential portions of the subdivisions. Seconded by Cadwell. Discussion. Add a site specific condition that Mr. Evans perform his due diligence by working with the adjoining property owner to mitigate the elevation problem. Creek ~af!le LLC, Spring Creek Eagle LLC, represented by Dan Perry with Arrow Engineering & Surveying, is requesting City approval to vacate a remnant parcel of public right-of-way purchased by the Ada County Highway District in conjunction with the street right-of-way for the Ranch Drive extension west of Eagle Road. The remnant right-of-way parcel abuts Spring Creek III PUD (platted as Senior Creek Subdivision) adjacent to the future extension of Ranch Drive, located on the northwest comer of the intersection of Eagle Road and Ranch Drive. Commissioner Bloom states that she is not within 300 feet, has not been notified, nor has a financial gain in the proposed subdivision. Franden introduces the item. David Bailey, 701 S. Allen St. Meridian with Hubble Engineering, representing the applicant presents the application. Is in general agreement with the staff report with a couple revisions. Jeff Lowe presents the staff report. General discussion. Franden opens the public hearing. Lisa Szenten, 2593 W Brockton Court, Eagle. Ms. Szenten does not want this request granted for a number of reasons. Feels that information is missing, one being traffic flow. Called ACRD and was told no traffic study had been completed, only a traffic count. Also did not find a letter from the schools in the files and would like this addressed. Her biggest issue being; this development is surrounded on three side by 5 acres developments, it is encroaching on areas that should be maintained as lower density lots. Also concerned about water rights. Deckers states that they have received over 55 signatures on a petition and at least 6 letters all opposing this subdivision based on density and increase in traffic.
