Minutes - 2001 - Planning & Zoning - 09/04/2001 - Regular ORIGINAL EAGLE PLANNING AND ZONING COMMISSION September 4, 2001 6:30 PM The Planning and Zoning Commission met in regular session on September 4, 2001 Chairman Franden presiding. 1. CALL TO ORDER: 2. ROLL CALL: The following members were present FRANDEN, BLOOM, DECKERS, NORDSTROM, CADWELL. A quorum is present. 3. CONSENT AGENDA: A. Minutes of August 20, 2001. Bloom moves to approve the minutes of August 20, 2001 as presented. Seconded by Nordstrom. ALL A YE...MOTION CARRIES. 4. UNFINISHED BUSINESS: A. PP- 7-01 - Ad4ie's Corner Subdivision - Northwest Development LLC: Northwest Development, LLC, represented by Matt Munger with Hubble Engineering, is requesting preliminary plat approval for Addie's Comer Subdivision. The 4.31-acre, 20-lot (16-buildable, 4-common) residential subdivision is generally located on the southwest comer of Floating Feather Road and Horseshoe Bend Road at 3065 Floating Feather Road. (This item was continuedfrom the August 20,2001, Planning & Zoning Meeting) Franden introduces the item. Kristen Van Engelen, the applicant has four items to address tonight using a PowerPoint presentation. Ms. Van Engelen met with the neighbors to discuss their concerns. The developers goals are to make Eagle a safe and viable community. With the constraints on this property this is the best use of this land. Discussion between the applicant and Commissioners. Commission asks Mr. Fivecoat to comment on the understanding with the agreement they have reached with the developer. Cliff Fivecoat, 10981 Horseshoe Bend Road. Mr. Fivecoat states that the neighboring property owners have reached an agreement with the developers regarding the water rights. Would like to see a landscape plan before they sign off on this project. Nordstrom asks staff if they agree with the statement given by the developer about the property developing from the south. Discussion amongst the Commission. Cadwell states he will abstain from the motion, as he was not at the last meeting. Ssc #3, Substitute "common lots" in two places with "easement". . Strike site specific condition #10. . Ssc #15, rather on either side of private roadways have on "one side for the private roadways with the opposite side being striped for a bike and pedestrian pathway" . . Add new condition, "the applicant will landscape the well property on the NE corner and the homeowners association will maintain this property". . Ssc #16, strike first part of the sentence, the second part remains as written and add, "landscape plans showing open space amenities shall be reviewed and approved by the Design Review Board". . Add pathway from North Bippy Way to the south, generally as presented in option number 2 as presented tonight, this pathway shall be located in an easement. . Or4inance Amendment - Joe Glavsier/Capitol Securities: Joe Glaysier/Capitol Securities, represented by David Bailey with Hubble Engineering Inc., is proposing to amend Eagle City Code Section 8-2- 4 (Schedule of Building Height and Lot Area Regulations, Note H), to exempt lots with street side frontage located within zoning districts A, A-R, R-E and R-l from the required minimum lO-percent increase in lot area as referenced in Note H. (This item was continued from the August 13,2001, Planning & Zoning Meeting). Jane Suggs, 701 S Allen Street Meridian with Hubble Engineering representing the applicant presents the application Jeff Lowe presents the staff report states that staff recommends approval. Franden opens the public hearing Mark Butler, 52 N. 2nd St. Eagle, Mr. Butler points out that he originally figured out the method for calculating the lot coverage. Mr. Butler states that he is in favor of this amendment for 10 percent increase. Franden closes the public hearing. Franden calls a short recess. Nordstrom moves to approve ZOA-4-01 - Zoning Ordinance Amendment - Joe Glaisyer/Capitol Securities as written, except remove R-l. Seconded by Deckers. ALL AYE... MOTION CARRIES. B. A-2-01/RZ-5-01- Annexation and Rezone from RUT to R-E - Pacific Rid2:e: Pacific Ridge, represented by David Bailey with Hubble Engineering Inc., is requesting a rezone upon annexation from RUT (Rural Urban Transitional) to R-E (Residential Estates - one dwelling unit per two acres) for Autumncrest Subdivision. The 39.92-acre, 20-lot (19-buildable) residential subdivision is generally located on the west side of Ballantyne Road, approximately 1;4 mile south of Beacon Light Road. (This item was continued from the August 13,2001, Planning & Zoning Meeting). Franden states that items 5B & 5C will be heard together for public testimony with separate motions. Commissioner Bloom states that she is not within 300 feet, has not been notified, nor has a financial gain in the proposed subdivision. Franden introduces the item. David Bailey, 701 S. Allen St. Meridian with Hubble Engineering, representing the applicant presents the application. Is in general agreement with the staff report with a couple revisions. Jeff Lowe presents the staff report. General discussion. Franden opens the public hearing. Lisa Szenten, 2593 W Brockton Court, Eagle. Ms. Szenten does not want this request granted for a number of reasons. Feels that information is missing, one being traffic flow. Called ACHD and was told no traffic study had been completed, only a traffic count. Also did not find a letter from the schools in the files and would like this addressed. Her biggest issue being; this development is surrounded on three side by 5 acres developments, it is encroaching on areas that should be maintained as lower density lots. Also concerned about water rights. Deckers states that they have received over 55 signatures on a petition and at least 6 letters all opposing this subdivision based on density and increase in traffic. Also received no letter from the school district. Will provide a pressurized irrigation system. Bloom states to the representative additional items she would like to see in this application. General discussion. Franden keeps the public hearing open. Deckers moves to continue A-2-01/RZ-5-01- Annexation and Rezone from RUT to R-E & PP-5-01 - Autumncrest Subdivision - Pacific Ridge to a Planning & Zoning Special Meeting on September 10, 2001. Additional items to address include: . Would like to see on the preliminary plat is specific information on the irrigation and how it would accommodate the infrequency of the water schedule. . Would like to see a more meandering road design. . A preliminary plat that shows more of a transition in density from 1.8 acre minimum in the south, but more on the average of 3.5 acre lots. . More information on the easement of the two property owners. . A resolution from ACHD as to the issue of the driveway. Discussion. Seconded by Bloom. ALL A YE...MOTION CARRIES. PP-5-01 - Autumncrest Subdivision - Pacific Rid2:e: Pacific Ridge, represented by David Bailey with Hubble Engineering Inc., is requesting preliminary plat approval for Autumncrest Subdivision. The 39.92-acre, 20- lot (19-buildable) residential subdivision is generally located on the west side of Ballantyne Road, approximately 1.4 mile south of Beacon Light Road. Franden opens the public hearing. Larry Cadwell representing the Chevron Pipeline states that Chevron will want to respond to this application. Kurt Wilkens, 1164 West Chance, Eagle. Mr. Wilkens is a real-estate developer and would like to state that he has worked with numerous developers over the years and Mr. Glaisyer does quality work. He is also in favor in the 10 percent reduction in lot area. Public hearing is still open. The subdivision consists of five (5) acre parcels. The surrounding arca consists of either five (5) acre parcels or larger operating farms and ranches. It is my understanding that the planning and zoning department is currently connsiderimg whether to approve two (2) new subdivisions on Ballantyne Rd.,both of which will consist of two (2) acre lots or less. The purpose of this letter is to strenuously object to the approval of such subdivisions. The reasons for this position are that the subdivisions will dramatically increase the traffic on Ballantyne Rd. and onto the State St. bypass. They will also cause overcrowding in the schools and place an increased demand on the already Limited city resources and services. Also, the approval of high density subdivisions in Eagle will dramatically and rapidly change the character of Eagle and the surrounding areas. The residents of Eagle and the surrounding areas live where they do because of the rural environment and the lower density living conditions. If they wanted to live in a high density, overcrowded, subdivision environment, they would have located in certain neighboring communities. There is a much larger issue involved in these decisions than the profit of the developers. The issue is the recognition and protection of the character and integrity of the city of Eagle. However, I respectfully request that my comments below are reviewed by the members and considered at the time the vote is taken. I am opposed to the rezone request by Autumncrest Subdivision-A-2-01/RZ-5-01/PP-5-01-Pacific Ridge for a rezone change from RUT to RE. I do not agree that this request be granted for the following reasons: traffic flow: the current roads are not adequate to accommodate the increased traffic. full capacity at local schools: the schools at every level (elementary, middle and high) are at or over capacity. higher density that is not in keeping with the surrounding properties: this proposed subdivision abuts Tahoe Development on its south border (which is 2 acre parcels), but the other three borders are all 5 acre lots. The Eagle community is changing in a way not in keeping with how many residents envisioned it when they moved here, due not just to development, but to allowances for higher density subdivisions.
