Minutes - 2001 - Planning & Zoning - 08/20/2001 - Regular ORIGINAL EAGLE PLANNING AND ZONING COMMISSION August 20, 2001 6:30 PM The Planning and Zoning Commission met in regular session on August 20, 2001 Chairman Franden presiding. 1. CALL TO ORDER: 2. ROLL CALL: The following members were present FRANDEN, BLOOM, DECKERS, NORDSTROM, Absent: CADWELL. A quorum is present. 3. CONSENT AGENDA: A. Minutes of August 13, 2001. B. Findin2:s and Conclusions for RZ-95 Mod - Development A2:reement Modification - Ea2:le Country Plaza. LLC.: Eagle Country Plaza LLc., represented by William Hodges, is requesting a modification to the development agreement approved by the City in 1995 (developed as Eagle Country Plaza Shopping CenterÆagle Market Place) for an increase in the maximum height allowed for monument signs from 8-feet high to 15-feet high. The 7.09-acre site is located on the northeast comer of Chinden Boulevard and Eagle Road at 3210 E. Chinden Blvd. C. Findin2:s am'- Conclusions for ~ - Rezone from A-ß..!!!...R-E - J. L. Ghent. Inc.: J. L. Ghent, Inc., represented by Jaret Ghent, is requesting a rezone from A-R (Agricultural-Residential) to R-E (Residential-Estates). The 3.9-acre site is located on the southwest comer of East Beacon Light Road and Edgewood Road at 1343 East Beacon Light Road. Bloom moves to approve the Consent Agenda as presented. PUBLIC HEARINGS: Franden states that item 5D will not be heard this evening at the request of the applicant. Item 5A (Trolley Square North) will be renoticed until a further date. RZ-12-00 MOD - Modification of the Trolley Square North Development A2:reement and Site Plan - Coulter Properties LLC: Coulter Properties LLC, represented by Tom Bauwens with the Dakota Company Inc., is requesting a change to the conditions within the Page 1 of 6 K:\P&Z\MINUTES\Temporary Minutes Work AreaIPZ-O8-20-0Imin.doc development agreement and a change to the Concept Site Plan previously approved by the City for rezone application RZ-12-00 (rezoned from A (Agricultural) to MU-DA (Mixed Use with a Development Agreement)). The 24.8-acre site is located on the west side of Edgewood Lane approximately 1/3-mile north of State Street at 200 Edgewood lane. (This item was continued from the July 2,2001 Planning & Zoning Meeting) B. A-4-01/RZ-7-01- Annexation and rezone from RUT to R-4 - Northwest Development LLC: Northwest Development, LLC, represented by Matt Munger with Hubble Engineering is requesting a rezone upon annexation from RUT (Rural Urban Transitional- Ada County Designation) to R-4 (Residential- up to four units per acre) the site is generally located on the southwest comer of Floating Feather Road and Horseshoe Bend Road at 3065 Floating Feather Road. Franden introduces the item. Matt Munger asks the Commission if this item can be heard after item 5E. Franden recommends that both item 5B and 5C are heard together, but with two separate motions. Kristen Van Engelen, 4720 Emerald St. Boise, with Northwest Development presents the application. Ms. Van Engelen agrees with most everything in the staff report with several comments. One being the issue of the culdesac and which school district they are in. The applicants believe they are in the Boise School District not the Meridian School District. Ms. Van Engelen also addresses Site Specific Conditions #15, #16 & #18 Jeff Lowe presents the staff report. Franden opens the public hearing. Cliff Fivecoat, 10981 Horseshoe Bend Road. Mr. Fivecoat is opposing the annexation, he also states that this is probably in the Boise School District. He is very concerned about the irrigation well. Would like the developer to relinquish their water rights to this well. There are seven property owners on this well. Mark Butler, 52 N. 2nd St. Mr. Butler answers questions on the annexation. Would like to point out higher density areas on the Comprehensive Plan. This application is well within the density range for this area. Virginia Weber, Ms. Weber owns the third lot from the proposed subdivision. Explains the well rights and can not understand how they will manage to irrigate the adjacent parcels. Franden closes the public hearing. Kristen Van Engelen rebuts this testimony. Recognizes the problems with pressurized irrigation and that the water will come from city services. Would be willing to gi ve up their water share for a landscape easement for the comer lot that the well is located on. Matt Munger, 701 S. Allen Street Meridian with Hubble Engineering addresses the water concerns. Mr. Munger also addresses the Right to Farm Act that will be on the final plat. States the Eagle Sewer District has received their plans and see no problems with the application. Discussion between Commission and staff on the issue of pressurized irrigation. Deckers asks Mark Butler to address the Commission on the water system for Arbor Ridge. Discussion amongst the Commission. Deckers asks the applicants to speak. Kristen Van Engelen speaks on the issue of Xeoiscape landscape, they would rather see it lush and green. Craig Van Engelen, 4720 Emerald St. Boise. Mr. Van Engelen addresses the Commissions questions on the collector roads and the number of trips per day anticipated onto Floating Feather Road. Ms. Van Engelen addresses Commissioner Blooms concerns on the common areas and the maintenance of these. Mr. Van Engelen states to the Commission that they want either an approval or a denial of this application tonight. Commission asks Mr. Munger to speak on the street names. Virginia Weber reiterates that each tract of land has its own potable well. Nordstrom moves to approve A-4-01/RZ-7-01- Annexation and Rezone from RUT to R-4 - Northwest Development LLC as presented with staff recommendations upon annexation by the City Council to rezone to an R-4. PP- 7-01- Addie's Corner Subdivision - Northwest Development LLC: Northwest Development, LLC, represented by Matt Munger with Hubble Engineering, is requesting preliminary plat approval for Addie's Comer Subdivision. The 4.31-acre, 20-lot (16-buildable, 4-common) residential subdivision is generally located on the southwest comer of Floating Feather Road and Horseshoe Bend Road at 3065 Floating Feather Road. Discussion on connectivity. Bloom moves to continue PP-7-01- Addie's Corner Subdivision - Northwest Development LLC, to the September 4th, 2001, Planning & Zoning Meeting, to redraw the preliminary plat and address the site specific conditions of approval such as the connectivity, the pedestrian walkway, the well, the school district letter regarding the turnarounds and site specific conditions #15 & #16, also, the sidewalk issue along one side instead of two. The Commission would like to see a redraw similar to what was proposed tonight. Seconded by Deckers. ALL A YEmMOTION CARRIES. Bloom would like the minutes to reflect that the applicants left the room during the motion. D. PP-8-01 - Once Upon a Subdivision - Northwest Development LLC: Northwest Development LLC, represented by Matt Munger with Hubble Engineering Inc., is requesting preliminary plat approval for Once Upon a Subdivision. The 11.11-acre, 35-lot (33-buildable, 2-common) residential subdivision is generally located north of West State Street, approximately 300-feet west of Eagle Glen Lane at 386 W. State Street. (Staff recommends this item be continued to the September 17,2001, Planning & Zoning Meeting). E. Zoninf! Ordinance Amendment - ZOA-6-01- Land Consultants Inc.: Land Consultants Inc., represented by Mark Butler is proposing to amend Eagle City Code Title 8, Chapter 2, Section 3, to allow Ambulance Services, Nursing/Convalescent Homes (including senior assisted living facilities) and Government Buildings (offices) to be permitted uses, or permitted with a conditional use permit, in additional zoning districts and to amend Section 4 to add Note J to allow Child Care Facilities, Churches, Nursing/Convalescent Homes (including senior assisted living facilities), Government Buildings (offices) and Schools (Public or Private) to increase the maximum lot coverage from 10% to 35% in any A, A-R, and R-E zoning districts Franden introduces the item Mark Butler, 52 N. 2nd St. Eagle. Mr. Butler states that this would also help churches by not requiring central sewer. Jeff Lowe presents the staff report. Staff would like to add item F under Eagle City Code 8-3-2. Franden opens the public hearing. No one wishes to speak on this item. Franden closes the public hearing. Discussion between the Commission and staff. Nordstrom would like the applicant to discuss in general where this could happen. Mark Butler answers the question in a general manner by using the example of the comer of State Highway 44 and Park Street, the area that Eagle Nursery was proposing to relocate to. Deckers moves to renotice Zoning Ordinance Amendment - ZOA-6-01- Land Consultants Inc., and have it come back with changes, . add to 8-2-3 item F the text that staff supplied. . From this application drop ambulance services and government buildings/offices. Change nursing/convalescent home land use to be a conditional use under Districts A, A-R, R-E and R. Change the maximum lot coverage to 20 %. That lot coverage would cover childcare facilities, churches, nursing/convalescent homes, schools, and drop government buildings from that increase in lot coverage. Make a new land use district named Public Emergency Service to include items such as fire department and police substation. This would be a CU under districts A, A-R, R-E, & R. They would be permitted under L-O, C- A, C-l, C-2, C-3, CBD, M-l M-la, PS and MU. Also add a new section to 8-2-3 that would state that Nursing Homes in Agricultural and Residential Districts must abut an arterial or collector road. Seconded by Bloom.
