Minutes - 2001 - Planning & Zoning - 08/06/2001 - Regular (2) ORIGINAL EAGLE PLANNING AND ZONING COMMISSION August 6, 2001 6:30 PM The Planning and Zoning Commission met in regular session on March 19,2001 Chairman Franden presiding. 1. CALL TO ORDER: 2. ROLL CALL: The following members were present FRANDEN, BLOOM, NORDSTROM, CADWELL. Absent: DECKERS. A quorum is present. 3. CONSENT AGENDA: A. Minutes of July 16, 2001. Bloom moves to approve the minutes of July 16,2001 as presented. Seconded by Nordstrom. ALL AYE.. .MOTION CARRIES. 4. OLD BUSINESS: None 5. PUBLIC HEARINGS: At the request of the applicant's items #5D, E, F, G, & H will be continued. Bloom moves to continue items #5D, 5E, 5F, 5G, 5H until the September 4, 2001 Planning & Zoning Meeting. Ordinance Amendment - ZOA-5-01 - City of Eaf!le: The City of Eagle is proposing to amend Eagle City Code Title 8, Chapter 2, Section 1, to add to the language under the definition of "R Residential District" to require centralized water and sewer facilities in all residential zoning districts exceeding one dwelling unit per two acres (R-E) and to amend Chapter 3, Section 5(A)(2) to require a minimum 20-foot side and rear yard setback for accessory building(s) located in any R-l, R-E, A-R, and A zoning districts. (Continued from July 16,2001, Planning & Zoning Meeting) Franden introduces the item. Bill Vaughan presents the staff report. This item was continued from the July 16, 2001 Planning & Zoning Meeting. Vaughan addresses the changes made since the last meeting. Under residential district it now says subdivision where it originally said district. For the accessory structures Vaughan checked with other jurisdictions and used their code for changes to the Eagle City Code. Franden closes the public hearing. B. RZ-95 Mod - Development Aereement Modification - Ea2:le Country Plaza. LLC.: Eagle Country Plaza LLc., represented by William Hodges, is requesting a modification to the development agreement approved by the City in 1995 (developed as Eagle Country Plaza Shopping Center/Eagle Market Place) for an increase in the maximum height allowed for monument signs from 8-feet high to 15-feet high. The 7.09-acre site is located on the northeast comer of Chinden Boulevard and Eagle Road at 3210 E. Chinden Blvd. (Continued from July 16,2001, Planning & Zoning meeting) Franden introduces the item. Bill Hodges, 832 Spring Meadow Lane, Boise. Mr. Hodges who is the developer of the Eagle City Marketplace presents the application. He is proposing the sign change to help his tenants. Jeff Lowe presents the staff report. Discussion between staff and the Commissioners. Franden opens the public hearing. Jerry Nasman, 3290 S. Eagle Road, Eagle. Mr. Nasman already has the existing lights from the shopping center shining into his residence and is not in favor of any more lighted signage. James Liley, 3410 E. Chinden Blvd. Mr. Liley states that Mr. Hodges at a previous meeting testified that the sign age was adequate. The neighbors agreed with it at that time and would hope this application will be denied. Franden states that the record will show that two letters have been submitted against this application. Franden reads these letters. Bill Hodges provides a rebuttal. Mr. Hodges states that the 15 feet they are requesting is what the other shopping centers already have. These signs will start at the base of the berms not the surface. Franden asks Lowe what his opinion is on the visual impact of these signs with the neighbors. Franden closes the public hearing. Seconded by Cadwell. Discussion. AYE (Nordstrom & Cadwell), NAY (Franden & Bloom)...MOTION FAILS. C. RZ-4-01- Rezone from A-R to R-E -.T. L. Ghent. Inc.: J. L. Ghent, Inc., represented by Jaret Ghent, is requesting a rezone from A-R (Agricultural- Residential) to R-E (Residential-Estates). The 3.9-acre site is located on the southwest comer of East Beacon Light Road and Edgewood Road at 1343 East Beacon Light Road. (Continued from July 16,2001, Planning & Zoning Meeting) Franden introduces the item. Jaret Ghent, 1717 S. Willow lake Way, Eagle. Mr. Ghent presents the application. Mr. Ghent states that if this rezone is approved that he will then apply for a lot split. Bloom asks the applicant for a copy of the CC & R's for Rocky Bar Subdivision which the applicant provides for her review. Jeff Lowe presents the staff report Franden opens the public hearing. Olani Beal 2242 Edgewood, Eagle. Mr. Beal previously remodeled his home and had a problem with being in the floodplain, he is now concerned because of more homes that could exist in the floodway. He is opposed because it could change the complexity of the area. Debbie Wald 2641 Edgewood Road. Ms. Wald is adjacent to the property and is concerned about adequate water and if this is allowed, how it will impact other wells in the area. Would like to keep the area 5-acre parcels. Tom Sorge, 2532 N. Edgewood. Mr. Sorge is opposed for a variety of reasons, one being the water this could have a direct impact on his water source. He also purchased his property for the rural setting and does not want to see this change. He feels that this would not be compatible with the other sites. Mark Wald 2641 Edgewood Road. Mr. Wald is concerned about the sanitation capabilities in the area. Mr. Wald thinks this area should stay with 5-acre parcels. Jessie Ramirez, 2391 N. Edgewood. Ms. Ramirez uses the overhead to point out the neighbor's parcels, states that several homeowners in this area have recently had to put in new wells. Bought in this area because of the 5 acres lots. Ms. Ramirez asks staff if the petitions were ever submitted. Mr. Ghent provides a rebuttal and addresses the neighbors concerns. Mr. Ghent provides the Commission with the original plat for Rocket Bar Subdivision. Mr. Ghent also addresses the neighbors water concerns. Olani Beal asks Jeff Lowe about the term non-conforming lot. Mr. Beal asks the Commission how a rezone makes this a conforming use. Franden closes the public hearing. Discussion amongst the Commission. Bloom moves to deny RZ-4-01- Rezone from A-R to R-E - J. L. Ghent, Inc. for the specific reason that it is a parcel in a long established subdivision and does not fit with the existing area. Seconded by Nordstrom. ALL A YE...MOTION CARRIES. D. Zonine Ordinance Amendment - ZOA-4-01 - Joe Glavsier/Capitol Securities: Joe Glaysier/Capitol Securities, represented by David Bailey with Hubble Engineering Inc., is proposing to amend Eagle City Code Section 8-2-4 (Schedule of Building Height and Lot Area Regulations, Note H), to exempt lots with street side frontage located within zoning districts A, A-R, R-E and R-l from the required minimum to-percent increase in lot area as referenced in Note H. E. A-2-01/RZ-5-01 - Annexation and Rezone from RUT to R-E - Pacific Ridee: Pacific Ridge, represented by David Bailey with Hubble Engineering Inc., is requesting a rezone upon annexation from RUT (Rural Urban Transitional) to R-E (Residential Estates - 1 dwelling unit per two acres) for Autumncrest Subdivision. The 39.92-acre, 20-10t (l9-buildable) residential subdivision is generally located on the west side of Ballantyne Road, approximately lA mile south of Beacon Light Road. F. PP-5-01 - Autumncrest Subdivision - Pacific Rid2:e: Pacific Ridge, represented by David Bailey with Hubble Engineering Inc., is requesting preliminary plat approval for Autumncrest Subdivision. The 39.92-acre, 20-lot (l9-buildable) residential subdivision is generally located on the west side of Ballantyne Road, approximately lA mile south of Beacon Light Road. G. Ghent rezones Bloom would like to state that she likes the west entrance sign. She would also like someone to investigate the Bighorn Subdivisions dead/dying landscaping. 8.
