CALL TO ORDER: 2. ROLL CALL: The following members were present FRANDEN, BLOOM, NORDSTROM, DECKERS, absent CADWELL. A quorum is present. 3. CONSENT AGENDA: A. Minutes of May 1, 2001. B. :E!!!!!jn2:s am' Conclusions for CU-OI-01- Early Childhood Education Center - Alei & Cal Gothber2:: Alei & Cal Gothberg, are requesting conditional use approval to provide a specialized individual child care and education facility for pre-school age children. The 2,497 sq. ft. building is located on the south side of East State Street approximately 1, 125-feet west of Edgewood Lane, at 1275 E. State Street. c. :E!!!!!jn2:s and Conc~ons for FPUD-4-01- Final Development Plan for Camil~man PQ!!..Phase One - Foad & Susan Ro2:hani: Camille Beckman, represented by Chris Korte with Land Dynamics, is requesting final development plan approval for phase one of a three phase mixed use planned development. This phase will include a manufacturing, production, packaging, and office facility and related site improvements. The 33-acre site is located on the south side of State Highway 44 and east of the intersection with Park Lane. D. Findin2s and Conclusions for FPUD-5-01 & FP-11-Ol- Final ~opment Plan and Final Plat for Countryside Estates PUD Subdivision No.1 - Countryside Estates LLC.: Countryside Estates LLc., represented by Richard Cook with Briggs Engineering, are requesting final development plan and final plat approval for Countryside Estates Subdivision No.1, a 42-lot (31-buildable) residential subdivision. This 21.74-acre phase of Countryside Estates Subdivision is located near the northwest comer of Ballantyne Road and State Highway 44 (State Street) Bloom moves to approve the consent agenda as presented. Seconded by Deckers. ALL A YE...MOTION CARRIES. Item 6A will be heard before the public hearing item 5A at the applicant's request. 4. OLD BUSINESS: None 5. PUBLIC HEARINGS: A. A-I-0l/RZ-I-01/CU-3-01IPPUD-I-0IIPP-2-01- RiversEnd Planned Unit ~opment - Howard-Kiser Development Corporation: Howard-Kiser Development Corporation, represented by Mark Butler with Land Consultants Inc., is requesting an annexation and rezone from RT (Rural Transition) to R-2-P (Residential up to two units per acre PUD) and R-2- DA-P (Residential up to two units per acre with development agreement and PUD), conditional use, preliminary planned unit development, and preliminary plat approvals for RiversEnd planned residential development. The 1O6.83-acre development consists of a 173-lot (147-buildable) residential subdivision. The site is located approximately Y2-mile east of Eagle Road on East Island Woods Drive. Franden introduces the item. Mark Butler 222 E. State Street, Eagle, representing the applicant presents the application. Mr. Butler states that the lot size will be larger than the adjacent Island Woods Subdivision. Mr. Butler submitted to staff and Commissioners on this date a letter regarding the site specific conditions of approval recommended by City Staff and modifications to these that the developer would like to propose. Jeff Lowe, City Staff presents the staff report. John McFadden, City Attorney answers Commissioner Blooms question on what happens if a homeowners association is not formed. Bloom states that she wants a response from the Meridian School District. Franden opens the public hearing. Hal Turner, 554 East River Chase Way, Eagle, president of the Homeowners association for Island Woods Subdivision. Mr. Turner reads from a list of concerns the homeowners have regarding the proposed subdivision. (Letter to be attached to these minutes). Jean Turner, 554 East River Chase Way is asking the board to consider this application carefully. Would like the traffic load lightened by another entrance. Also, to consider the construction trucks that will be using the Island Woods Drive Road. Tom Nagle, 402 East Trailside, Eagle. Mr. Nagle would just like to reiterate what Mr. Turner said, but also to consider the construction traffic. Would like another access during the construction phase. Bob Beede, 1772 South River Chase Way, Eagle. Mr. Beede has concerns about the waterway between the two subdivision and would hope that this waterway is maintained and not diverted. Larry Durkin, 713 East River Quarry Drive. Mr. Durkin is a developer but also lives in this area. He would like to see the recommendations to ACHD and ITD strengthened. Would like the developers to work with these agencies. Lou Alomelaga, 325 East Island Wood Court also on the board of the Island Wood Homeowners Association. Discusses the contributions between the three subdivisions for funding the proposed traffic signal. Would like staff to address the water pressure situation. David Deckers 1700 South River Chase would like to address the traffic situation. Franden calls a five-minute recess at 8: 13. Mark Butler provides a rebuttal. Thanks the staff for putting this application on the agenda without having a completed traffic study. Answers the concerns and questions posed by the audience. Mr. Butler states that they will agree with site specific condition #8 to extend the lot lines if that is what is required. States that they will have the same set backs as Island Woods Subdivision. Franden states he would like to see this application continued to a later date when ACHD and ITD can be present to answer questions. Deckers would like to ask some specific questions. 1. Do any materials need to be removed from the ponds? 2. Traffic circle? Would like staff to make arrangements to have other agencies present at a meeting. 3. Commercial signs? 4. Water pressure? Matt Munger, with Hubble Engineering, 700 Adams Street, Meridian. Mr. Munger addresses the questions on the water amenities that Mr. Beede spoke on earlier and the traffic calming devices at the entrance. 5. Open space amenities? 6. 100 year floodplain? Matt Munger addresses Deckers question on the flood plain and the flood line. Deckers would like the applicant to look into an alternate route for construction traffic. Bloom would like United Water to address the water pressure problem. Franden moves to continue A-I-01/RZ-I-01/CU-3-01IPPUD-I-0l/PP-2-01- RiversEnd Planned Unit Development - Howard-Kiser Development Corporation to the June 18th 2001 Planning & Zoning Meeting. Some items they would like to address are; . Traffic study reports, would like to invite ACHD and ITD to attend the meeting so they can address the issues. . Would like to have a detailed presentation on the different phases of the development. . Provide all of the appropriate reports that should be in an application such as the school district report. . Staff and applicant get together and resolve issues and re note other issues that have not been resolved. . Provide a report from the water provider. . Have the applicant look at issues posed by audience. . Address the parcel to the south that does not have any access. Seconded by Bloom. ALL AYE... MOTION CARRIES. The public hearing will remain open. 6. NEW BUSINESS: A. ~-6-01 & FP-14-01 - Final Development Plan and Final Plat for ~ Subdivision No.4. - Aries Development. LLC.: Aries Development, LLC, represented by Mike Hormaechea, is requesting final development plan and final plat approval for Brookwood Subdivision Phase 4, a 66-lot (52-buildable) residential subdivision. This 45.5-acre (approx.) phase of Brookwood PUD is located on the north side of Floating Feather Road and west of Feather Nest Estates Subdivision. The site is within the Eagle City Limits. Mike Hormaechia, 1101 West River St. Boise, representing the Aries Development Co. presents the application. This phase will bring them to a 50% build out. Bill Vaughan, City Staff presents the staff report. Mr. Vaughan refers to a view foil to explain the minor changes to this phase. Mr. Vaughan also explains the procedure for the final plat process to the Commissioners. Nordstrom moves to approve FPUD-6-01 & FP-14-01- Final Development Plan and Final Plat for Brookwood Subdivision No.4. - Aries Development, LLC with staff recommendations, site specific conditions and standard conditions of approval. Seconded by Bloom. Discussion. Deckers makes an alternate motion to approve with staff recommendations and site specific and standard conditions of approval with one additional condition. The decrease in density from the preliminary plat shall not be permitted to be shifted into the 100-year flood plain. Motion dies for lack of a second. ALL A YE...MOTION CARRIES. 7. REPORTS: Staff: Reports on speed limit ordinance. Commission: Discussion on the dental office rezone. 8. ADJOURNMENT: Bloom moved to adjourn at 9:45. Seconded by Nordstrom.
