Minutes - 2001 - Planning & Zoning - 05/01/2001 - Regular ORIGINAL EAGLE PLANNING AND ZONING COMMISSION May 1,2001 6:30 PM The Planning and Zoning Commission met in regular session on May 1,2001 Chairman Franden presiding. 1. CALL TO ORDER: 2. ROLL CALL: The following members were present FRANDEN, BLOOM, DECKERS, NORDSTROM, CADWELL. A quorum is present. 3. CONSENT AGENDA: A. Minutes of April 16, 2001. B. ~in2:s and Conclusions for CU-2-01 - Ea2:~ursery - Peter .I: Cintorino: Eagle Nursery, represented by Peter J. Cintorino, is requesting conditional use approval to relocate the existing retail nursery and landscape business. The 6.3-acre site is located on the northeast comer of Park Lane and West State Street at 3950 W. State Street. Deckers removes item 3B from the Consent Agenda for discussion. Nordstrom moves to approve the minutes of April 16, 2001 as presented. Seconded by Bloom. ALL A YE...MOTION CARRIES. City Attorney McFadden reads corrections made to site specific condition #11, "Provide a letter from lTD authorizing the proposed driveways on State highway 44 for this site to be in alignment with or offset from those driveway locations approved on the south for the Camille Beckman development". Deckers moves to approve Findings and Conclusions for CU-2-01 - Eagle Nursery - Peter J. Cintorino with changes to site specific condition # 11 as read by the city attorney. (See above) Discussion. CU-OI-0l- ~arlv c~on Center - Alei & Cal Gothber2:: Alei & Cal Gothberg, are requesting conditional use approval to provide a specialized individual child care and education facility for pre-school age children. The 2,497 sq. ft. building is located on the south side of East State Street approximately 1,125-feet west of Edgewood Lane, at 1275 E. State Street. Franden introduces the item. Justin May 557 S McDonalds Place Boise, attorney and representative for Mrs. Duncan, neighbor to the proposed day care, answers the commissioners question in regards to the letter he submitted to the Planning & Zoning Department. Jeff Lowe discusses the Eagle City Code requirements for parking spaces, width, length and total number of parking spaces required by code. Discussion between staff and commissioners. Deckers moves to approve CU-OI-0l- Early Childhood Education Center - Alei & Cal Gothberg with staff site specific conditions and standard conditions of approval with the following additions; . Add site specific condition #7, the applicant shall submit a security and safety plan to the City Staff and Eagle Fire Dept for review and approval prior to issuance of a Certificate of Occupancy. . Add site specific condition #8, the back parking lot will be marked for employee parking only. . Add site specific condition #9, acquire a letter of approval from ACHD for this revised site plan dated April 27, 2001. This shall specify considering this usage as a day care facility. . Add site specific condition #10, provide a record of cross access with Pacific Heights Subdivision prior to issuance of a building permit . Add site specific condition #11, provide an arborist report with the number of trees removed and replace any removed trees per Eagle City Code. Discussion. Seconded by Nordstrom. Discussion. FPUD-4-01- Final Development Plan for Camille Beckman PUD - Foad & Susan Ro2:hani: Camille Beckman, represented by Chris Korte with Land Dynamics, is requesting final development plan approval for phase one of a three phase mixed use planned development. This phase will include a manufacturing, production, packaging, and office facility and related site improvements. The 33-acre site is located on the south side of State Highway 44 and east of the intersection with Park Lane. Bloom moves to approve FPUD-4-01- Final Development Plan for Camille Beckman PUD - Foad & Susan Roghani as stated in the staff report. Seconded by Deckers. ALL A YE... MOTION CARRIES. B. ~UD-5-01 & FP-11-Ol- Final Development Plan and Final Plat for Countryside Estates PUD Subdivision No.1 - Countryside Estates LLC.: Capital Development and Tom Ricks, represented by Richard Cook with Briggs Engineering, are requesting final development plan and final plat approval for Countryside Estates Subdivision No.1, a 42-lot (31- buildable) residential subdivision. This 21.74-acre phase of Countryside Estates Subdivision is located near the northwest comer of Ballantyne Road and State Highway 44 (State Street). Franden introduces the item. Cadwell recuses himself from this item. Nordstrom recuses himself from this item. Dave Yorgeson with Capital Development representing the applicant has no further additions to the staff report and agrees with it as written. Deckers asks staff to comment on how this PUD complies with the Comprehensive Plan and how they have come into performance with a PUD. Bloom comments on this application and states she is adamantly opposed to this development based on density. Deckers moves to approve FPUD-5-01 & FP-11-Ol- Final Development Plan and Final Plat for Countryside Estates PUD Subdivision No.1 - Countryside Estates LLc. Deckers states the Commission is not happy with the overall density but feels it complies with the Preliminary Development Plan that was approved by City Council. Discussion. C. 01-05-S/OI-04-ZC Sedona Creek Su~on - John Evans: John Evans is requesting a rezone from RUT (Rural Urban Transition) to R2 (Low Density Residential) and preliminary plat approval for Sedona Creek Subdivision, a 35. ll-acre, 56-lot (52-buildable) residential subdivision located on the east side of Linder Road approximately 400-feet north of \\EAGLENTl\COMMON\P&Z\MINUTES\Temporary Minutes Work Area\PZ -OS-Olmin..doc Page 3 of 5 State Highway 44. This site is located in the Eagle Area of Impact. Franden introduces the item. John Evans, 5699 N. Ripple Way, Garden City, the applicant reads to the Commission a prepared statement. Deckers asks questions of applicant. Jeff Lowe presents the staff report. Franden asks the City Attorney to comment on staff using the 1993 Comprehensive plan instead of the 2000 Comprehensive Plan. Deckers asks staff to comment on adjacent land uses. Franden allows a member of the audience to present testimony. Tony Lousie, 39 N. Linder Road. Mr. Lousie comments that the land uses will be changing in this area soon, "we should get the best uses out of the land that we can". Discussion Deckers moves to deny 01-05-S/OI-04-ZC Sedona Creek Subdivision - John Evans in support of staff recommendations, means of approval of this application would be to comply with a zoning density of R-l based on our anticipation that surrounding property would development at a density no more than R-l.
