CALL TO ORDER: 2. ROLL CALL: The following members were present FRANDEN, BLOOM, DECKERS, NORDSTROM, CADWELL. A quorum is present. 3. CONSENT AGENDA: A. Minutes of March 5, 2001. B. Findings and Conclusions for FPUD-1-01 & FP-1-01– Final Development Plan and Final Plat for Two Rivers No. 2 Subdivision– T. R. Company LLC, represented by Dan Torfin T. R. Company LLC, represented by Dan Torfin, is requesting final development plan and final plat approval for Two Rivers No. 2 Subdivision, a 51-lot (39-buildable) residential subdivision. This 31.20-acre phase of Quarter Circle Ranch PUD is located on the west side of Eagle Road approximately 1600-feet south of State Highway 44. C. Findings and Conclusions for FPUD-2-01 & FP-2-01– Final Development Plan and Final Plat for Two Rivers No. 3 Subdivision– T. R. Company LLC, represented by Dan Torfin T. R. Company LLC, represented by Dan Torfin, is requesting final development plan and final plat approval for Two Rivers No. 3 Subdivision, a 19-lot (15-buildable) residential subdivision. This 22.14-acre phase of Quarter Circle Ranch PUD is located on the west side of Eagle Road approximately 1600-feet south of State Highway 44. Nordstrom moves to approve the Consent Agenda as presented. Seconded by Bloom. ALL AYE…MOTION CARRIES. 4. OLD BUSINESS: None 5. PUBLIC HEARINGS: A. Yorkshire Acres Subdivision - PP-1-01 – Robert DeShazo Jr./Berkshire West: Robert DeShazo Jr./Berkshire West, represented by Douglas W. Landwer, is requesting preliminary plat approval for Yorkshire Acres Subdivision. The 4.76-acre, 15-lot (13 residential, 2 common) subdivision is located on the south side of East Floating Feather Road, approximately 900-feet west of Horseshoe Bend Road. Richard Pavelek with Tealey Land Surveying, 2501 Bogus Basin Road, Boise, Idaho presents the application. Mr. Pavelek explains the reason for using E. Trevino Court Road for the access into the proposed subdivision. The applicant would like to strike site-specific condition #13. Douglas W.Landwer, 2601 E. Floating Feather Road, Eagle. Mr. Landwer addresses the question from Deckers regarding using the private road west of the parcel for access. Jeff Lowe presents the staff report. Tyler Smith 2490 Alpomado Court, Eagle, Idaho. Mr. Smith would like to know if the lot lines abutt or if an easement exists. Ann Pardew Peck, 2425 E. Floating Feather Road, Eagle Idaho. Ms. Peck reads from a letter distributed to the Commission and attached to these minutes. William Pardew, 2385 E. Floating Feather Road. Eagle, Idaho. Mr. Pardew reads from a letter distributed to the Commission and attached to these minutes. Mr. Pardew answers Deckers regarding using the private lane as a public pathway. Chad Cooper 1201 N. Falling WaterWay, Eagle, Idaho. Mr. Cooper has several concerns; he was not aware of a neighborhood meeting nor was he invited to this meeting. He is also concerned about the access into this subdivision and the additional traffic this will create. Also concerned about the current easement behind his property and what will become of this. Would like to know more about the fencing and the landscape plan. Bus Smith, 1154 N. Purple Sage Way, Eagle, Idaho. Mr. Smith is concerned about losing his view to two story houses. Likes this proposal over the existing weed patch and supports this subdivision. Glen Garlic, 2386 N. Poppy Hills, is concerned about the common area and how the lighting issue will be addressed. Richard Pavelek rebuttes the testimony and answers the questions and concerns voiced by those who testified. Douglas Landwer addresses the Commission's concerns on the lack of communication between the developer and the neighbors. Commission asks questions of staff regarding road access into this parcel and what other option is available. Discussion amongst the Commission regarding Alpomado Court as the entrance into Yorkshire Subdivision. Bloom comments that Mr. Bingham with the Meridian School District wrote a great letter. Deckers moves to approve Yorkshire Acres Subdivision - PP-1-01 – Robert DeShazo Jr./Berkshire West, with staff site specific conditions and standard conditions of approval with the following changes.  Strike ssc #16 and replace it with, "this Commission envisions that the future route of the proposed pathway will be along the existing private drive and will be dedicated at the point when the property to the south develops. Therefore, a condition for this pathway shall not be a burden on this specific subdivision".  Add ssc #18, solid fencing shall be installed along the south property line and along the west property line, the line along the west shall extend a minimum of the full length of Berkshire including the cul-de- sac turn around. The remaining length of the west property line shall be fenced with an open style fence or step down fence.  Ssc #19, the plat shall show that the property to the south has an established right to farm according to Idaho Code.  Ssc #20, Design Review shall review the style of street lighting used to make sure it does not negatively impact adjacent homes.  Include we support staff recommendation that an alternate method of compliance is used for the buffer along Floating Feather Road similar to the properties to the east and west. Add to ssc # 5. Seconded by Cadwell. Discussion. 3 AYE 2 NAY (Bloom and Nordstrom)... MOTION CARRIES. 6. NEW BUSINESS: None 7. REPORTS: Staff reports on previous applications and City Council motions. Commission would like staff to find out why the City Attorney in the City Council Meeting stated that the City Council did not have the ability to reconsider as requested by the Planning & Zoning Commission the Winco application. 8. Box 130 Eagle, Idaho 83 616 March 19, 2001 City of Eagle, Idaho Planning and Zoning Commissioners Eagle, Idaho 83616 Dear Commissioners; We have concerns regarding the preliminary plat application of Yorkshire Acres Subdivision PP -1-01 in Eagle, Idaho. Our major issue with the Yorkshire Acres Subdivision PP -1-01 is the Northernmost culdesac. We are certain that residents of the subdivision will be inclined to remove a section of wire fence and drive over the curb that intersects our property line in order to gain direct access rather than to drive all the way back thru Yorkshire and Berkshire. We strongly request that an obstruction or solid fence be constructed down this property line in order to limit our liability from trespassers. We would like to request that the developers install a solid fence on the southern boundary due to the nature of the machinery and noise of farming operations. We would also like to see that the CC&R's for this development specifically advise potential homeowners that the lane is private land and trespassing will not be tolerated. C. Bryant Peck 2385 E. Box 699 Eagle, Idaho 83616 March 19, 2001 City of Eagle, Idaho Planning and Zoning Commissioners Eagle, Idaho 83616 Dear Commissioners; We request that Yorkshire Acres Subdivision PP -1-01 in Eagle, Idaho construct a fence along their west boundary and south boundary to prevent subdivision people and children from trespassing on our adjacent farm land and subsequently tromping down farm crops. We do not wish to be liable for their injury caused by ditches, gopher and badger holes and climbing on, starting and falling off our farm equipment. The west boundary fence would keep people from being hit by automobiles, trucks and farm equipment on our private gravel lane, which is used by three families. The owners of the southern property feed cattle at the end of the lane. These ranchers create many trips per day on a fifteen foot narrow gravel roadway. Yours tr ly, William W. Pardew Helen S.
