Heindel, is requesting conditional use approval to provide a supervised group home to serve as a community-based transitional home for local youth. The site is located approximately 1,4 mile south of East State Street and % mile west of the intersection of East State Street and Horseshoe Bend Road. D. The 1.60-acre site is located on the southwest comer of North Eagle Road and Floating Feather Road at 1177 North Eagle Road. H. Findinf!s and Conclusions for PPUD-8-00/CU-21-00 - Camille Beckman Mixed Use Planned Unit Development - Susan & Foad Rof!hani: Camille Beckman, represented by Chris Korte with Land Dynamics, is requesting planned unit development, preliminary development plan and conditional use approval for a multi-phased mixed use planned unit development with uses such as manufacturing and office facilities, gardens, shops, an Art Gallery, Bed & Breakfast and associated facilities. The 33-acre site is located on the south side of State Highway 44 and east of the intersection with Park Lane. Staff asks to remand item 5A back to staff. Deckers removes Item 3A and 3D for discussion. Bloom moves to approve the Consent Agenda as presented. Seconded by Nordstrom. ALL A YE...MOTION CARRIES. Deckers discusses the motion for item 3A for the Winco site and makes changes to the motion. Bloom moves to approve the minutes of January 16, 2001 as amended. Seconded by Deckers. OLD BUSINESS: None 5. PUBLIC HEARINGS: A. Zoninf! Ordinance Amendment - ZOA-5-00 - City of Eaf!le: The City of Eagle is proposing to amend Eagle City Code Title 9 "Land Subdivisions" to require completion of roadway asphalt prior to the issuance of building permits, to exempt street construction from the guarantee of improvement provisions, and to eliminate negotiable bonds therefrom. Zoning Meeting) Bloom moves to remand Zoning Ordinance Amendment - ZOA-5-00 - City of Eagle back to staff and be renoticed. Seconded by Nordstrom. ALL A YE...MOTION CARRIES. B. CU-22-00 - Bank Facility With Drive-up Service - Key Bank: Key Bank, represented by Roger Foster with BRS Architects, is requesting conditional use approval to construct a 5,300-square foot bank facility with drive-up service within the Eagle Country Plaza Shopping Center. The site is located on the north side of Chinden Boulevard approximately 300-feet east of Eagle Road at 3314 E. Chinden Boulevard. Deckers introduces the item. Roger Foster with BRS Architects representing the applicant presents the application. Mr. Foster distributes a handout to the Commission. Bill Hodges, 1832 Spring Meadow Lane Boise. Mr. Hodges the developer answers the Commissions questions on the road widening for Chinden Blvd. Mr. Hodges states that sidewalk construction will take place after the road widening. Jeff Lowe presents the staff report. Discussion between Commission and Mr. Lowe on the berm height. Deckers opens the public hearing. Mr. Foster provides a rebuttal and addresses the berrning in question. Mr. Hodges provides information to the Commission on the grading along Chinden Blvd. Deckers asks if some landscape screening would be appropriate. Deckers asks Mr. Foster is they would object to a drive up with a single ATM machine. Deckers asks staff what part of code would apply to alternate methods of screening. City Attorney addresses this question. Bloom asks if they should review the original development agreement for this development. Discussion amongst the commission. Nordstrom moves to approve CU-22-00 - Bank Facility With Drive-up.8ervice- Key Bank as presented with the following conditions. . Planning &Zoning reinforce the staff recommendation that City Council be the final determinate on another driveup at this shopping center location. . SSC #2, that the Planning &Zoning Commission recommend to Design Review that the berm height parallel to the drive-up driveway be a minimum of 48 " measured from the height of the drive thru lane grade. . That additional screening be used to screen headlights shining onto Chinden Rd. . SSC #4, that we waive the construction of a sidewalk prior to the issuance of a building permit for this site for a period of one year from the date of issuance of the building permit. There will be a surety to the extent that the city asks for currently to indemnify them for the sidewalk. At the end of the year if this sidewalk is not built because of lack of reconstruction to Highway 26 and part of the shopping center, that they can come and review and perhaps renew thier plan for the sidewalk. If there is going to be an extension to that plan one year from the building permit that they bring a letter from ITD with some kind of commitment as to when this project will be built. . Add an additional condition that limits the drive up banks opportunity to one A TM machine only. Seconded by Bloom. Discussion. ALL A YE...MOTION CARRIES. Deckers calls a 5 minute break C. CU-23-00 - Public Service Facility/Sub-Transmission Line Reconstruction and Hei2:ht Exception Request-Idaho Power: Idaho Power, represented by Layne Dodson, is requesting conditional use approval for a height exception request and for the reconstruction, upgrade, and re-routing of an existing 69kV power line to accommodate a 138kV sub-transmission line and placement of existing distribution lines underground. The new line will replace a portion of the existing facility which generally extends from the Eagle Substation (located on the south side of State Street approximately 350-feet east of 2nd Street) west to Ballantyne Road. Deckers introduces the item. Layne Dodson, 10790 Franklin Road Boise, representing Idaho Power presents the application. Mr. Dodson uses colorboards to aid in his presention. Frank Wright, 1396 Powder Court, Eagle. Mr. Wright is concerned that his berm will be disturbed. He is also concerned about the pole height and power shortages. Mr. Wright points out to the Commission the location of his home on the map. Dan Lloyd, 1520 W. Kenai, Eagle. Mr. Lloyd would like the subtransmission line below ground and would like the applicant to clarify the cost per mile. Boyd Wilson, 1423 W. Colville Court, in the Pine Ridge Subdivision, Eagle. Mr. Wilson is disappointed with this project. Bought in this subdivision for its looks and is concerned about the potential eyesore this will create. Deckers asks the City Attorney about health risk regulations and if they are restricted from considering these risks. Douglas W. Landwer, 2601 E. Floating Feather Road, Eagle. Mr. Landwer reads from a letter he prepared. Mr. Landwer would like this request denied. He is concerned that the corridor will increase in width. Mr. Landwer is also concerned that no compensation has been offered to the city of Eagle. He states, don't deny underground utilities to the city of Eagle. Steve Tubbs, 1532 West Power Court, Eagle. Would prefer not to have this power line constructed in his back yard. This will not enhance his property values. Ken Hillard, 1525 West Powder, Eagle. Mr. Hillard distributes a document that he downloaded from Idaho Powers web site. Would like to look at other options for an alternate route. Charles Ferguson, from Eagle Adventist Church. Mr. Ferguson is concerned about the homeowner's sprinkler systems and who is going to repair these. Steve Arbor, 1366 West Colville Court, Eagle. Mr. Arbor agrees with previous statements. Moved to Eagle for its looks and does not want to see it changed. Would like to keep the turn of the century look. Put it along the Bypass Mark Butler, 1640 East Washam Rd. Mr. Butler did not see enough information on this project.when he came into the city to review the application. Is concerned that this route will disturb the Central Business District. Mr. Butler relays the information he received from the PUC. David Erickson, 1406 Deadwood Court. Representing the homeowners association. Mr. Erickson states that the public notice signs installed were misleading. Was not able to read the map that he received from the city. Jack Conner with Idaho Power explains the powerline configuration to the Commission and why this route was chosen. City Attorney clarifies the Conditional Use application that is required. Deckers asks questions of staff regarding the comprehensive plan listing this route as a scenic corridor and if this route violates this scenic corridor. Bloom would like a specific definition for a scenic corridor. Deckers would like the applicant to provide additional documentation on guidelines for underground lines, and other alternate alternatives. Bloom would like other alternatives proposed. Bloom moves to continue CU-23-00 - Public Service Facility/Sub-Transmission Line Reconstruction and Height Exception Request-Idaho Power to the February 20, 2001 Planning & Zoning Meeting. V AC-8-00 - Vacation to the final plat of Crei2:hton Hei2:hts Subdivision -ALSAM Trust: ALSAM Trust, represented by Givens Pursley LLC, is requesting City approval to vacate a 1/2 street section of right-of-way together with all utility easements within the right-of-way and the adjoining lO-foot wide utility easement abutting said right-of-way from the final plat of Creighton Heights Subdivision. The 30-foot wide x 600- foot long (approximate) right-of-way is located on the western boundary line of Lot 1, Block 1 of Creighton Heights Subdivision, approximately 2,378-feet north of Meridian Road on Clearvue Road. Deckers introduces the item. Don Alloway with Givens Pursley LLC, representing the applicant presents the application. Mr. Alloway would like to present alternate conditions of approval.
