Minutes - 2001 - Planning & Zoning - 01/30/2001 - Regular ORIGINAL EAGLE PLANNING AND ZONING COMMISSION January 30, 2001 6:30 PM The Planning and Zoning Commission met in regular session on January 30, 2001 Chairman Franden presiding. 1. CALL TO ORDER: 2. ROLL CALL: The following members were present FRANDEN, BLOOM, NORDSTROM. Absent: DECKERS, CADWELL. A quorum is present. 3. CONSENT AGENDA: A. Minutes of January 16,2001. Bloom moves to continue the minutes of January 16, 2001 to the February 5, 2001 Planning & Zoning Meeting. Seconded by Nordstrom. ALL A YE...MOTION CARRIES. 4. OLD BUSINESS: None 5. PUBLIC HEARINGS: A. RZ-18-00 - Rezone from R-4 to MU - Brenden Clements: Brenden Clements, represented by James Gipson, is requesting a rezone from R-4 (Residential up to four dwelling units per acre) to MU (Mixed Use). The 1.60-acre site is located on the southwest comer of North Eagle Road and Floating Feather Road at 1177 North Eagle Road. (This item was continued from January 16,2001 Planning & Zoning Commission meeting) Franden introduces the item. Franden opens the public hearing. James Gipson, P.O. Box 219, Eagle, representing the applicant presents the application. Mr. Gipson feels that the proposed use meets the criteria under the comprehensive plan for a health care facility. Mr. Gipson presents an overhead of the proposed office facility. Bill Vaughan presents the staff report. Betty Miller 959 Preakness, Eagle. Ms. Miller states if this commercial development is allowed it opens the way for other commercial development Would rather it remained residential. Charles Sharp 1009 Utahana Road, Eagle, This facility would provide a service to the community, a dental clinic would be an asset to the city. Karen Prescott, Ms. Prescott is the owner of residence. Ms. Prescott states the upgrade would improve the use of this property. Will increase surrounding property values. The dental office will look better than 6 residential properties. Eagle could use another dental office. Marci Higginson 10507 Shady Brook Dr. Boise, wife of the applicant. Collected over 500 signatures from the neighbors, received support from over 80%, less than 10% opposed the project. Mike Terry 1215 N. Fruitwood Way, Eagle, Mr. Terry is opposed to the development because of the way it was presented by the applicant during the petition process. Mr. Terry would like it to stay zoned residential. Dr. Mike Higginson 10507 Shady Brook Dr., Boise, Mr. Higginson is the applicant. States that this dental office would be an improvement to the neighborhood. This is a unique piece of property that deserves something special. Franden asks questions of Dr. Higginson. How many patients will the doctor see per day? There is no rebuttal by the representative. Franden closes the public hearing. Bloom asks question of staff regarding how many times the comprehensive plan can be amended. Discussion. Brenden Clements 10439 W. Silverwing Dr. Boise, Mr. Clements is the doctor's assistant and business partner. Franden moves to deny RZ-18-00 - Rezone from R-4 to MU - Brenden Clements. Seconded by Bloom. ALL AYE... MOTION CARRIES. B. PPUD-8-00/CU-21-00 - Camille Beckman Mixed Use Planned Unit Development- Susan & Foad Ro2:hani: Camille Beckman, represented by Chris Korte with Land Dynamics, is requesting planned unit development, preliminary development plan and conditional use approval for a multi- phased mixed use planned unit development with uses such as manufacturing and office facilities, gardens, shops, an Art Gallery, Bed & Breakfast and associated facilities. The 33-acre site is located on the south side of State Highway 44 and east of the intersection with Park Lane. (This item was continued from January 16,2001 Planning & Zoning Commission meeting) Franden introduces the item. Chris Korte, 499 Main St. Boise, representing the applicant presents the application. Mr. Korte distributes samples of the product to the Commission. Bill Vaughan presents the staff report. Mr. Vaughan reads into the record the time frame for the project on page 6 in the staff report. Mr. Vaughan highlights other pertinent site specific conditions of approval. Commission asks questions of Mr. Vaughan regarding a sidewalk along this property. Franden opens the public hearing. Korte answers questions of the Commission regarding hours of operation and the traffic congestion anticipated from the high school. Nordstrom asks what type of heavy equipment will be on site. Discussion amongst Commission and Korte on site specific condition # 10. Franden closes the public hearing. Commission asks question of attorney regarding the easement along the river. Mr. Vaughan clarifies the staff report regarding the site lighting. Nordstrom moves to approve PPUD-8-00/CU-21-00 - Camille Beckman Mixed Use Planned Unit Development- Susan & Foad Roghani with staff recommendations and, changes to site specific condition # 9 & #10. Strike #9. In #10 strike, "will cooperate in" and insert "will establish a mutually agreeable" Also strike "north edge" and insert "property line parallel to the Boise River". As another condition recognize Mr. Vaughan's substitution of a standard condition of approval and substitute the standard conditions of approval that apply to this ruling. Seconded by Bloom.
