EAGLE PLANNING AND ZONING COMMISSION
December 4, 2000

The Planning and Zoning Commission met in regular session on December 4, 2000. Acting
Vice-chairman Nordstrom presiding.

CALL TO ORDER:

ROLL CALL: The following members were present BLOOM, NORDSTROM,
CADWELL. Absent FRANDEN & DECKERS. A quorum is present.
3.
CONSENT AGENDA:
. Consent Agenda items are considered to be routine and are acted on with one
motion. There will be no separate discussion on these items unless the Chairman,
a Commissioner, member of City Staff, or a citizen requests an item to be
removed from the Consent Agenda for discussion. Items removed from the
Consent Agenda will be placed on the Regular Agenda in a sequence determined
by the Rules of Order.
. Any item on the Consent Agenda that contains written recommendations from the
City of Eagle shall be adopted as part of the Planning & Zoning Commission's
Consent Agenda approval motion unless specifically stated otherwise.
A. Minutes of November 20,2000.
B. .E!lliJine:s an4 Conclusions for - PP-I0-00 - Arbor Ride:e Subdivision: Stacia
Patterson, represented by Mark Butler with Land Consultants Inc., is requesting
preliminary plat approval for Arbor Ridge Subdivision. The 52.3-acre, 149-lot
(143-buildable) residential subdivision is located west of State Highway 55
generally north of Hill Road.
Bloom moves to remove item 3A & 3B from the Consent Agenda. Seconded by
Cadwell. ALL A YE...MOTION CARRIES.
Bloom moves to continue item 3A to the December 18, 2000 Planning & Zoning meeting
to amend the minutes. Seconded by Cadwell. ALL A YE...MOTION CARRIES.
Vaughan amends the findings of fact for Arbor Ridge Subdivision as requested by the
Commission.
Bloom moves to approve item 3B, Arbor Ridge Subdivision as amended. Seconded by
Cadwell. All AYE... MOTION CARRIES.

Inc., is proposing to amend Eagle City Code Title 8 "Zoning", Chapter 6 "Planned
Unit Developments", Section 5 "Site and Structure Regulations and
Requirements", Subsection 4 "Increased Residential Density"; Providing a
Severability Clause; And Providing an Effective Date. The amendment is to
provide additional incentive for communities for "older persons" (55 and over) to
be included within residential Planned Unit Developments.
Discussion amongst the commission regarding PUD's.
Mark Butler 222 E. State St. Eagle, Idaho addresses the issue. Mr. Butler would hope to
move this application forward. The applicant has made several changes and clarified the
language.
Nordstrom asks questions of Vaughan regarding the ordinance.
Discussion amongst the commission & City Attorney.
Nordstrom moves to deny ZOA-4-00 because we will be studying it in the overall
rewrite of the PUD process and this by itself does not have the time or effort to define
what we are looking for. Seconded by Bloom. Discussion. ALL A YE...MOTION
CARRIES.

. PUBLIC HEARINGS:
A. ~-OO - Rezone from R-4 to CBD-DA - Robert Runvan: Robert Runyan is
requesting a rezone from R-4 (Residential) to CBD-DA (Central Business District
with development agreement). The 0.18-acre site is located on the east side of
Park Road approximately 200-feet north of State Street at 74 Park Road.
Nordstrom introduces the item.
Mark Butler 222 E. State St. Eagle, Idaho representing the applicant. Mr. Butler reviews the
application. Discusses the letter received from ACHD regarding signs requested.
Discusses the Development Agreement.
Vaughan provides an overview of the staff report.
Nordstrom opens the public hearing.
Marcella Cruser 378 Park Rd. Eagle, Idaho. Ms. Cruser is concerned with the increase of
traffic on this street. She lives at the end of the street and has no cul-de-sac in front of her
house in which to turn around in.
Debra Rhinehart 280 Park Rd. Eagle, Idaho. Ms. Rhinehart states the street is too narrow for
a business on this road. Has had her fence knocked down five times. If this street is made a
business street there will be more issues on this road.

John Adams 208 Park Rd. Eagle, Idaho. Mr. Adams reiterates that this road is not a through
street. He has had his mailbox knocked over twice in the last year. States there are no streets
to vent traffic off of Park Street.
Andrea Little 444 East Knoll Drive Eagle, Idaho. Recently moved to Eagle for its small town
atmosphere. The old town feel will be lost with this development in this location.
Mary Coil, Park Road Eagle, Idaho. Has lived in Eagle for many years and wants to keep her
street residential.
Ken Ward, Park Road Eagle, Idaho. States he also does not want to see the street changed.
Marcella Cruser addresses the issue again. Does not want a business in her neighborhood.
Mark Butler rebutes the public testimony presented tonight.
Nordstrom asks Vaughan to present map of the CBD and Transitional Development Area.
Bloom asks questions of staff regarding limiting the use of the site to only one use.
Nordstrom closes the public hearing.
Cadwell discusses the development agreement.
Discussion amongst the Commission.
Cadwell moves to approve with conditions stated in the development agreement. Motion
dies die to lack of second.
Bloom wishes to limit the amount of employees to a maximum of four in this office.
Bloom moves to approve RZ-ll-00 - Rezone from R-4 to CBD-DA - Robert Runyan
with the development agreement as amended and the Design Review recommendations.
The site specific conditions of approval recommended by staff and amend the
development agreement to add the language in article 2.1. - Limit the number of
employees in the office to no more then four people. Seconded by Cadwell. ALL
A YE... MOTION CARRIES.
Nordstrom calls 5-minute recess.
B. Eaele River Subdivision - PP-14-00 - Eae:le River. LLC: Eagle River, LLC,
represented by Bill Clark with Clark Development, is requesting preliminary plat
approval for Eagle River Subdivision. The 90-acre, 7-lot (5 commercial, 1
residential and 1 city park) subdivision is located on the southeast comer of Eagle

Road and State Highway 44. (State Street)
Nordstrom introduces the item.
Bill Clark 479 Main St. Boise, Idaho. Mr. Clark representing Eagle River LLC. presents the
application. Comments on site specific conditions #6, 7 8 & #13.
Vaughan presents the staff report.
Vaughan responds to Cadwells question on the required 150% Surety.
Nordstrom opens the public hearing.
Tom Dater 827 E Riverside Eagle, Idaho. Mr. Dater resides near the proposed development
and has several issues on an easement. None of the plans show the easement in question..
The alignment down to Riverside could provide him with no easement into his property.
Also concerned about the New Union Ditch. His third concern regards the berming and
would like it in place before construction begins.
Bill Clark rebuts the public testimony.
Commission asks questions of Mr. Clark.
Discussion between Commission & Mr. Vaughan regarding land exchange & floodway.
City attorney comments on the bonding issues.
Nordstrom closes the public hearing.
Bloom moves to approve PP-14-00 - Eagle River Subdivision Preliminary Plat with the
site-specific conditions of approval as delineated in the staff report with changes
indicated ie; 6, 7 and 13 will be addressed in the final plat. Under the standard
conditions of approval paragraph 28 will be reworded in accordance with the current
resolution, 9-4 following conditions of approval added, the contingency language
regarding the acquisition that pathways from the park to the river be changed or be
added to accommodate the Wells property whether it is acquired or not so there are
easements in place. Staff will review the park size land exchange issue to make sure
that document is in place and that the plat is shown accordingly. The developer shall
work with Mr. Dater regarding the irrigation issues. That he be allowed an easement if
the realignment of Riverside Dr. does not match his property. Seconded by Cadwell.
Discussion. Bloom amends motion and strikes conditions related to 6, 7 and 13 if it
stays as written. Seconded by Cadwell. ALL AYE... MOTION CARRIES.
C. CU-16-00 - Transitional Home for Youth - The Family Table: The Family
Table represented by Christopher A. Heindel, is requesting conditional use

approval to provide a supervised group home to serve as a community-based
transitional home for local youth. The site is located approximately 1,4 mile south
of East State Street and % mile west of the intersection of East State Street and
Horseshoe Bend Road.
Nordstrom introduces the item.
Chris Heindel 12134 Phistan Rd. Middleton, Idaho. Mr. Heindel representing the applicant
presents the application. Mr. Heindel states there is no place available after treatment to
place youth back into the community after successfully completing a program.
Jeff Lowe presents the staff report.
Nordstrom opens the public hearing
Charles Wood 5720 N. Star Rd. Meridian. Mr. Woods owns adjacent property. Commends
the applicant for his efforts but does not want to see them as neighbors. Mr. Woods is
concerned about vandalism to his property and equipment.
Sharon Barnard 212 Ranch Drive, Eagle Idaho. Concerned about youth near the pond. Also
concerned about dangerous youth.
Mr. Heindel rebuts the public testimony.
Chad Young 956 E Wentworth answers questions of the commission regarding school
attendance for the youth in residence, most will attend the Eagle Academy.
Cadwell has concerns on this item and would like to ask more questions and research this
further.
Cadwell moves to continue CU-16-00 -Transitional Home for Youth to the December
18, 2000 Planning & Zoning Commission meeting. Discussion. Seconded by Bloom.

D. ~ Leaf Manor Subdivision - PP-16-00 - Hillview Development
Corporation: Hillview Development Corporation, represented by Mark Butler
with Land Consultants Inc., is requesting preliminary plat approval for Red Leaf
Manor Subdivision. The 4.29-acre, 14-lot residential subdivision is located south
of East Floating Feather Road, 220- feet west of Eagle Hills Way.
Nordstrom introduces the item.

Sharon Barnard 212 Ranch Drive, Eagle, Concerned about the lighting and traffic issues. Not
objecting to the subdivision but would like the lighting to stay the same as Eagle Knoll.
Crane Johnson 827 East Knoll Drive Eagle, Ms. Johnson is concerned about the retention of
the Locust trees along the boundary. Is also concerned about garbage, noise and traffic
during construction.
Don Reynolds 639 East Knoll Eagle, Mr. Reynolds would like to see streetlights installed
along Floating Feather and the entrance to N. Crest Ave before the subdivision is approved.
Mr. Butler rebutes the public testimony.
Nordstrom asks question of staff regarding the trash problem.
Jim Mercle 2150 N. Canary Eagle, with Hillview Development addresses the trash problem.
Andrea Little 444 E. Knoll Eagle, Ms. Little suggests posted weatherproof signs with a phone
number to call to contact person responsible for handling complaints.
Nordstrom closes the public hearing.
Discussion.
Cadwell moves to approve with site specific conditions approved by staff but also
include signs noticing the contractor to clean up daily. Lighting will be installed similar
to that along East Knoll Street. Tree removal will only take place after Design Review
approval. Seconded by Bloom. All AYE... MOTION CARRIES.
E. RZ-lS-00 - Rezone from A to R-3 & PS - Hillview Development
Corporation: Hillview Development corporation, represented by Mark Butler
with Land Consultants Inc., is requesting a rezone from A (Agricultural) to R-3 &
PS (Residential up to three units per acre and Public/Semi-Public). The 49.84-
acre site is located on the southeast corner of East Floating Feather Road and
North Eagle Road.
Blooms moves to combine 5E & 5F for the public hearing.
Mark Butler 222 East State Street. Representing the applicant presents the application.

Nordstrom asks Lowe to briefly highlight the Staff recommended Site Specific conditions of
approval.

Sharon Barnard 212 Ranch Drive Eagle, Primarily concerned about the high amount of traffic
using Floating Feather Road would like to see lights installed. Also concerned about the
amount of construction traffic.
Mark Erickson 1214 N. Fruitwood, Eagle. Mr. Erickson is representing the residences of
Eagle Knoll, distributes a handout for the commissioners and staff to review. Does not want a
connector street between Eagle Knoll and the proposed Subdivision.
Mike Horn 843 Fruitwood place, Eagle. Lives in the subdivision to the south and has the
same concerns as the residents in Eagle Knoll. Also concerned about the water and sewer
supply, and the increase in traffic.
Bruce Ripley 832 Fruitwood Place Main concern regarding this subdivision is that
Fruitwood was to stop in a cul-de-sac. Also has the same traffic concerns as previously
stated.
Varna Fowler 1063 N. Eagle Road. Ms. Fowler lives across the street from the proposed
subdivision. Concerned about headlights from additional traffic. Would like to see the
roadway rerouted.
Kim Terry 1215 N. Fruitwood Way, agrees with Mr. Erickson. Does not want to be
connected to two other subdivisions. Very concerned about the safety of children on N.
Fruitwood Way. Needs a three way stop sign at the corner offE. Knoll Dr. and N. Fruitwood
Way. Would also like to see a sign prohibiting the trash and foul language from construction
workers.
Brent Donohue 727, would also like to see a sign posted.
Andrea Little 444 E Knoll Dr. Concerned about safety of the children and traffic impacting
homes on a daily basis.
