The Planning and Zoning Commission met in regular session on November 20,2000
Chairman Franden presiding.

CALL TO ORDER:

ROLL CALL: The following members were present FRANDEN, BLOOM,
NORDSTROM, CADWELL. Absent DECKERS. A quorum is present.

CONSENT AGENDA:
. Consent Agenda items are considered to be routine and are acted on with
one motion. There will be no separate discussion on these items unless the
Chairman, a Commissioner, member of City Staff, or a citizen requests an
item to be removed from the Consent Agenda for discussion. Items removed
from the Consent Agenda will be placed on the Regular Agenda in a
sequence determined by the Rules of Order.
. Any item on the Consent Agenda that contains written recommendations
from the City of Eagle shall be adopted as part of the Planning & Zoning
Commission's Consent Agenda approval motion unless specifically stated

B. Findine:s and Conclusions for FPUD-3-00 & FP-S-OO -Pacific Hei2hts
PUD Subdivision: Eagle Heights Development, Inc., represented by Ted
Martinez and Joe Harris, is requesting final development plan and final plat
approval for Pacific Heights Subdivision, a 5.6-acre, 47-lot (42-buildable)
senior housing residential planned unit development located on the south
side of E. State Street approximately l,4-mile west of Edgewood Lane.
C. Findine:s and Conclusions for PP-13-00 - Williamsbure: Subdivision:
Marty Camberlango is requesting preliminary plat approval for
Williamsburg Subdivision, a re-subdivision of Benchmark Subdivision,
(formally Morning Meadow Manufactured Home project). The 9.83-acre,
58-lot subdivision is located approximately Y2 mile north of Floating
Feather Road, abutting Hwy 55 on the west and Horseshoe Bend Road on
the East.
Nordstrom moves to approve the Consent Agenda as presented. Seconded by

PUBLIC HEARINGS:
A. ~ne: Ordinance Amendment - ZOA-3-00 - City of Eae:le: The City
of Eagle is proposing to amend Eagle City Code Title 9 "Land
Subdivisions", Chapter 1 "General Subdivision Procedures", Section 6
"Rules and Definitions", and Chapter 2 "Subdivision Plats and
Procedures", Section 8 "Lots Splits" to change the definition of a
subdivision and to narrow the applicability of the lot split procedure. (The
Public hearing for this item was continued from the November 6, 2000
Planning & Zoning Meeting. Staff is requesting this item be continued to
the December 18, 2000 Planning & Zoning Meeting).
B. Zonine: Ordinance Ameß(~ment - ZOA-S-OO - City of Eae:le: The City
of Eagle is proposing to amend Eagle City Code Title 9 "Land
Subdivisions" Section 9-4-1-2 & 9-4-2-2, to require completion of roadway
asphalt prior to the issuance of building permits, to exempt street
construction from the guarantee of improvement provisions, and to
eliminate negotiable bonds therefrom. (The Public hearing for this item
was continued from the November 6, 2000 Planning & Zoning Meeting.
Staff is requesting this item be continued to the December 18, 2000
Planning & Zoning Meeting).
Bloom moves to move items SA & SB to old business. Seconded by
Nordstrom. ALL AYE... MOTION CARRIES.

C. Castleburv Subdivision - A-S-OOIRZ-13-00 - Capital Development Inc.:
Capital Development Inc., represented by Jim Howard with JJ Howard
Engineering, is requesting an annexation and rezone from RT (Rural
Transition) to R-l (Residential one unit per acre maximum). The 78.87-
acre, 89-lot (77-buildable) residential subdivision is located north of
Chin den Boulevard approximately I-mile west of Locust Grove Road at
990 E. Chinden Boulevard.
Franden introduces the item.
Franden combines item 5C &5D for purposes of public testimony, separate
motions will be made for each item.
Jim Howard, With JJ Howard Engineering, 1675 Hill Road presents the
application. States that a one-acre parcel in the southwest corner is under
separate ownership.

Jeff Lowe presents the staff report.
Staff would like documentation showing the one-acre parcel is under other
ownership.
Julie Saunders 168 E. Sugarberry Eagle, Idaho, Has concerns about the density
in a rural area. Concerned about traffic on Chinden Lane. Also concerned
about the over crowding in the schools. Should not be adding subdivisions
until more schools are built to accommodate this overcrowding.
David Childers 2636 W. Sugar Crest Eagle, Idaho. Does not oppose the
subdivision but would rather it was zoned R-E instead of R-l because of the
impact on roads and schools.
Michael Hide, Mr. Hide owns property directly across the street from the
proposed subdivision. Would also like the Subdivision given an R-E
designation.
Bill Davison 1965 W. Crooked Stick Court. Not opposed to the subdivision
rather the zoning. Would like to see bigger lots and fewer homes. Would also
like the landscaping completed between Spyglass Subdivision and the proposed
subdivision. Also concerned about the traffic generated by the construction
crews.
Marlowe Lindley, Mr. Lindley would like the Commission to remember that
Zinger Lateral has a right a way.
Ramon Yorgeson 23 N. Cole Boise, Idaho, rebuttes the testimony. Mr.
Yorgeson is also concerned about traffic safety and would like a turn lane
installed. Sidewalks will be installed within the subdivision and connect with
adjoining subdivisions.
Commission asks question of Mr. Yorgeson. Mr. Lindley speaks from the
audience. Mr. Yorgeson states that any ditches on their property will be tiled.
Jim Howard addresses the issue of the Zinger Lateral. Explains the route of the
water path.
Bloom asks who has the easement for the Lateral?
Mr. Lindley owns the cement ditch in question.
Discussion on the Zinger Lateral.
Pranden asks the applicant if they would be willing to pay for a turn lane in

front of their subdivision. Mr. Yorgeson states they will do what ever is
required.by ITD or ACHD.
Deckers proposes having a pedestrian access through lot 4 block 2 in place of a
sidewalk.
Deckers asks questions of the applicant.
Discussion amongst the Commission.
Nancy Seer, Spyglass Subdivision. Ms. Seer is concerned about traffic into
Spyglass Subdivision because of a high berm around their park, which reduces
visibility.
Jeff Lowe answers questions from the Commission states he will look into
proposed traffic signals along Chinden.
Bloom questions the need for open space within this subdivision. Would like
to see someone from the school board attend the Planning & Zoning meetings
to answer questions regarding the overcrowding in the schools.
Franden closes the public hearing.
Discussion amongst the Commission.
Deckers asks question of Mr. Yorgeson regarding sidewalks. Mr. Yorgeson
states that there will be sidewalks along all streets at this time but not sure if
they will be attached or detached.
Nordstrom moves to approve Castlebury Subdivision - A-S-OO/RZ-13-00-
Capital Development Inc. Seconded by Bloom. ALL AYE... MOTION
CARRIES.
Deckers moves to approve Castlebury Subdivision - PP-1S-00 - Capital
Development Inc. with the following changes to site specific conditions.
Strike #1 and #3. Add to site specific condition #4 the words: or show legal
record that the lot has been legally split from the remainder of the
subdivision.
Add the following conditions: approval of this application is contingent
upon ITD accepting and improving the center turn lane acceleration and
deceleration lanes at the intersection of Chinden and Castlebury Street.
No building permits shall be issued until this center lane is constructed.
Extend Crooked Stick Court to stub out to the west. Meader Stansbury
Ashbury, Kingsbury and Westbury Roads. Construct traffic calming
landscape islands at all connections to adjacent subdivisions. Complete

transitional landscaping at road connections to Spyglass and Sugarbury
even if this requires a minimal amount of off site improvement. Include a
variety of lot sizes transitioning to the lot sizes in Creighton Heights and
Sugarbury Woods. Provide a mini neighborhood park on the order of a
half to one acre to serve as a communal gathering area. As per applicant
testimony construct sidewalks on both sides of all internal streets whether
attached or detached. Seconded by Bloom. Discussion. 4 AYE... 1 NAY

D. Castleburv Subdivision - PP-lS-00 - Capital Development Inc.: Capital
Development Inc., represented by Jim Howard with JJ Howard
Engineering, is requesting preliminary plat approval for Castlebury
Subdivision. The 78.87-acre, 89-lot (77-buildable) residential subdivision

E. RZ-14-00 - Rezone from R-4 to MU-DA - IFI Partners II: IFI Partners
ll, represented by John Evans is requesting a rezone from R-4 (Residential)
to MU-DA (Mixed Use with Development Agreement). The 2.82-acre site
is located on the south side of Hill Road approximately 700 feet west of
State Highway 55.
Franden introduces the item.
John Evans 5699 N Ripple way Garden City, representing the applicant
presents the application. Questions permitted and non-permitted uses in this
zone.
Jeff Lowe presents the Staff Report. Reads into the record uses under zoning
classifications.
Deckers asks questions of staff.
Franden opens the public hearing.
No one is signed up to speak at this time.

Deckers asks questions of Mr. Evans, why was the parcel not developed at the
same time as the Picadilly Subdivision?

Picadilly.

provide the approved City Councils Facts and Findings for Picadilly

Motion to approve PP-15-00 Castlebury Subdivision - Steve Deckers

Approve PP-15-00 with Staff Recommendations and Site Specific Conditions
of
Approval with the following corrections and additions.
CHANGES
Strike Site Condition #1 (because there where no requirements proposed
by
the City Engineer).
Strike Site Condition #3 (see added Site Specific Condition to extend
Crooked Stick Court)
ADDITIONS
12. Approval of this application is contingent upon ITD accepting and
approving a center turn lane plus acceleration and deceleration lanes at
the
intersection of Chinden and proposed Castlebury Street. No building
permit
shall be issued until this center turn lane and accel/decelation lanes
are
built.
13. Extend Crooked Stick Court to stub out to the west. This will serve
both vehicle and pedestrian access to the west. (thus the intent of
stricken condition #3 is complied with)
14. Meandering the proposed internal streets, specifically Stansbury,
Ashbury, Kingsbury and Westbury.
15. As per applicant proposal, construct sidewalks on both sides of all
internal streets including connections to adjacent subdivisions and stub

outs to adjacent undeveloped properties.
16. Complete the transitional landscaping at road connections to
Spyglass
subdivision and Sugarberry Woods subdivision, even if this requires some
minimal offsite improvements.
17. Construct traffic calming landscape islands at all connections to
adjacent subdivisions.
18. Provide a greater variety of lot sizes. Use larger lots to
transition
to the lot sizes in adjacent Creighton Heights and Sugarberry Woods.
19. Provide a mini neighborhood park on the order of 1/2 to 1 acre to
serve
as a communal gathering place.
NOTES
My motion did request to add to Site Specific Condition #4 "or show
legal
record that this lot has been legally split from the subdivision." But
in
re-reading #4, I see that it already contains that language. So, no new
language is required for #4.
Please note in BOTH the Meeting Minutes and Findings of Fact that the
commission discussed the issue of impact on schools. The commission
felt that
overcrowded schools could be a basis for denying this application, but
decided it would be best to approve the application with conditions.
The
additional revenues generated from this development, if approved, could
help
support a bond issue to construct new schools.
