The Planning and Zoning Commission met in regular session on November 6, 2000
Chairman Franden presiding.

CALL TO ORDER:

ROLL CALL: The following members were present FRANDEN, DECKERS,
CADWELL. Absent BLOOM, NORDSTROM. A quorum is present.
3.
CONSENT AGENDA:
A. Minutes of October 16, 2000.
B. Findines and Conclusions for CU-12-00 - Trolley SclUare Shoppine Center: The
applicant is requesting conditional use approval for Trolley Square Retail Shopping
Center/Office Park. The 26.9-acre site is located on the north side of State Street
approximately 1O0-feet east of Palmetto A venue.
C. Findine:s and Conclusions for PP-12-00 - Trolley Square Subdivision: The
applicant is requesting preliminary plat approval for Trolley Square Subdivision, a 26.9-
acre, 23-lot commercial subdivision. The site is located on the north side of State Street
approximately 1O0-feet east of Palmetto Avenue. Removed from Agenda.
Remove item 3C from the agenda. Add Williamsburg Subdivision as item 3D.
D. Williamsbure: Subdivision - PP-13-00: Marty Camberlango is requesting preliminary
plat approval for Williamsburg Subdivision, a re-subdivision of Benchmark Subdivision,
(formally Morning Meadow Manufactured Home project). The 9.83-acre, 58-lot
subdivision is located approximately 1f2 mile north of Floating Feather Road, abutting Hwy
55 on the west and Horseshoe Bend Road on the East.
Item 5C, ZOA-6-00 will be continued to the date set in motion to follow.
Deckers pulls Williamsburg Subdivision from the consent agenda and makes a change to
#2 under the Commission Decision, keep a minimum of 75 feet buffer along new State
Highway 55 but strike a minimum of 35 feet along old State Highway 55 and put "the
required 35 feet along Old Highway 55 may be met with an alternate method of
. compliance". (Continue to consent agenda on November 20,2000)
Deckers moves to approve CU-12-00- Trolley Square Shopping Center and the
minutes of October 12, 2000. Seconded by Cadwell. ALL A YE...MOTION

4.
OLD BUSINESS:
A. Arbor Rid2e - PP-I0-00 - Stacia Patterson: Stacia Patterson, represented by Mark
Butler with Land Consultants Inc., is requesting preliminary plat approval for Arbor Ridge
Subdivision. The 52.3-acre, 149-lot (143-buildable) residential subdivision is located west
of State Highway 55 generally north of Hill Road.
Steve Deckers recuses himself from this item.
Mark Butler 222 East State Street, Eagle, representing the applicant discusses the changes
made to the plat. Open space has been increased. Park strips have been widened from 4
feet to 8 feet. Other amenities have been added. Developer will enhance their subdivision
but does not want to improve neighboring subdivisions.
Franden asks question of Mr. Butler regarding stub streets.
Scott Nordstrom arrives at 7:00 p.m.
General Discussion.
Cadwell asks question of staff regarding ACHD requirements for stub streets.
Commissioners ask questions of Mr. Butler.
Franden moves to accept recommendation of staff for PP-I0-00-Arbor Ridge, which
includes the ACHD recommendations for stub streets and that the exact placement of
stub streets should be worked out between staff, ACHD and developer. Accept
conditions brought forth by Mr. Butler this evening, but encourage the developer to
work with the residences of Evans subdivision to see if pedestrian pathways and bike
lanes can be provided in that subdivision. Seconded by Cadwell. ALL
A YEoooMOTION CARRIES.
City Attorney asks Commissioners for clarification on staff recommendation on sidewalks.
Discussion.
Franden moves to reconsider motion. Seconded by Cadwell. ALL A YE...MOTION
CARRIES.
Franden moves to approve recommendations of staff which include
recommendations for stub streets as required by ACHD, but that staff, ACHD and
the developer identify where those stub streets should be. Accept items as presented
by Mr. Butler specifically recognizing the note, as it has to do with the meandering
side walk along Arbor Way, there will be only one sidewalk on the east side.
Developer work closely with Evans Subdivision in an attempt to adequately provide
for bikeways and pedestrians. Seconded by Cadwell. A YEoooMOTION CARRIES.
5. PUBLIC HEARINGS:
A. Zonine: Ordinance Amendment - ZOA-3-00 - City of Eae:le: The City of Eagle is
proposing to amend Eagle City Code Title 9 "Land Subdivisions", Chapter 1 "General
Subdivision Procedures", Section 6 "Rules and Definitions", and Chapter 2

"Subdivision Plats and Procedures", Section 8 "Lots Splits" to change the definition
of a subdivision and to narrow the applicability of the lot split procedure. (The Public
hearing for this item will be continued to the November 20, 2000 Planning & Zoning
Meeting)
B. Zonine: Ordinance Amendment - ZOA-5-00 - City of Eae:le: The City of Eagle is
proposing to amend Eagle City Code Title 9 "Land Subdivisions" Section 9-4-1-2 &
9-4-2-2, to require completion of roadway asphalt prior to the issuance of building
permits, to exempt street construction from the guarantee of improvement provisions,
and to eliminate negotiable bonds therefrom.
Franden introduces the item.
Jeff Lowe, city staff presents the staff report.
Discussion between Lowe and Commission.
Deckers asks questions of city attorney regarding language of ordinance in section 9-4-1-2.
Discussion between Attorney and Commissioners.
Franden opens the public hearing.
Bill Clark 479 Main Street Boise, Idaho. Mr. Clark states this will hurt small projects
more then large projects.
Roy Johnson, Civil Engineer agrees with Mr. Clark but as long as you can justify the load
the streets can handle the project. Better to begin construction.
Nordstrom moves to continue this until Mr. Vaughan can address this item.
Deckers would like Vaughans comments on this, the attorneys review, and to find out
how other cities address this item.
Nordstrom moves to continue this item to the November 20th Planning & Zoning
Meeting. Seconded by Deckers. ALL A YE...MOTION CARRIES.
c.
Zonine: Ordinance Amendment - ZOA-6-00 - City of Eaele: The City of Eagle is
proposing to amend Section 8-2-4, Eagle City Code, to require an offsetting increase
in open space (of the same footage) for any decrease in minimum lot size within a
planned unit development subdivision.
Item 5C will be continued at the request of staff.
General Discussion, PUD issues need to be clarified. Staff would like more time to clarify

Deckers moves to continue item SC to the December 18th Planning & Zoning Meeting.
The public hearing will be preceded by a workshop open to the public. Seconded by
Nordstrom. ALL AYE...MOTION CARRIES.
6. NEW BUSINESS:
A. V AC-5-00 - Vacation to the final plat of Banburv Meadows Subdivision No.3-
Banburv M.£!!flows LLC. represented bv Rov Johnson: Banbury Meadows LLC,
represented by Roy Johnson, is requesting City approval of a vacation to the final plat
of Banbury Meadows Subdivision No.3 to satisfy a lot line adjustment and remove
the utility, drainage and irrigation easements along the side lot line of Lot 1, Block 27.
The utility, drainage and irrigation easement required for all side lot lines will be
satisfied with the existing 6-foot wide easement along the western side lot line of Lot
14, Block 2. The site is located on the north side of W. Co1chester Drive
approximately 112-mile west of Eagle Road.
Franden introduces the item.
Roy Johnson, representing the applicant presents the application.
Lowe addresses the item.
Deckers asks questions of staff on wording in staff report, would like to strike condition
#1 and is also concerned about the wetlands.
Nordstom moves to approve V AC-S-OO- Vacation to the final plat of Banbury
Meadows Subdivision No.3. Strike staff recommendation #1. Seconded by Deckers.
ALL A YE...MOTION CARRIES.
B. V AC-6-00 - Vacation to the final plat of Channel Center Subdivision - B.B. One
LLC. represented bv Dennis M. Baker: B.B. One LLC, represented by Dennis M.
Baker, is requesting City approval of a vacation to the final plat of Channel Center
Subdivision to remove the pedestrian easement along the boundary line of Lots 2 and
3, Block 1 to allow for a lot line adjustment. The pedestrian easement will be
relocated to the south along the new boundary line between parcels "B" and "C". The
site is located on the west side of S. Rivershore Lane approximately 300-feet west of
Eagle Road.
Franden introduces the item.

application.
Jeff Lowe presents the staff report. Would like verification that there are no utilities

Discussion between Staff and Commissioners.
Deckers would like the letter of November 2000 from Holladay Engineering entered into
record.
Deckers asks questions of Mr. Torfin. What is the access of the pathway?
Mr. Torfin would like to enter a revised plat into the record.
Nordstrom moves to accept V AC-6-00 - Vacation to the final plat of Channel Center
Subdivision as proposed with staff recommendations including item #3. Seconded by
Deckers. ALL A YE...MOTION CARRIES.

REPORTS:
Commission: Asks City Council President, Nancy Merrill to speak on the
transportation board advisory committee which would serve under the direction of
the Planning & Zoning Board.
Nordstrom moves to form a Citizen's Transportation Advisory Board for the
purpose of getting imput and guidance for the City of Eagle on transportation
issues. Seconded by Franden. ALL AYE... MOTION CARRIES.
